Abstract:
In recent years, the just transition to a low carbon economy, supporting climate resilient development has become an issue of global concern for all the right reasons. The response measures to address climate change through switching to a cleaner energy mix and enhancing the adaptive capacity of society – businesses, workplaces and communities will entail significant disruptions particularly, to the lives and livelihoods of the working poor and the marginalised communities across the world. For the most vulnerable countries like Bangladesh, achieving a just transition is important. In countries like Bangladesh, which are not big users of fossil fuels, just transition as a response to climate change impacts relates more to strengthening the resilience and adaptive capacity of communities and rehabilitating the displaced people, ensuring their livelihoods and income opportunities. With this perspective, this policy brief reviews how workers and other vulnerable people are coping with the twin crises of climate change and COVID-19, and looks at the roles the Government of Bangladesh and the trade unions can play to strengthen the just transition measures.

Abstract:
Failure to plan realistically for needed changes in Afghanistan’s security sector following a peace settlement—and failure to start phasing in changes now—will lead to post-settlement instability. This report examines the particular challenges Afghanistan will face, with examples from the climate following peace settlements in other parts of the world offering insight into what may occur and possibilities for response. An Afghan-owned and Afghan-led strategy that incorporates some of this report’s recommendations can help create a lasting foundation for Afghan and regional stability.

Abstract:
When Pakistan’s Federally Administered Tribal Areas were officially merged into Khyber Pakhtunkhwa Province in May 2018, the five million residents of the former tribal areas acquired the same constitutional rights and protections—including access to a formal judicial system—as Pakistan’s other citizens. This report, based on field research carried out by the authors, explores the status of the formal justice system’s expansion, finding both positive trends and severe administrative and capacity challenges, and offers recommendations to address these issues.

4. Protection of Civilians from the Perspective of the Soldiers who Protect: Ghana and India in United Nations peacekeeping

Abstract:
UN peacekeeping missions are deployed in increasingly violent contexts, such as Mali and South Sudan. It leaves such missions suspended somewhere between traditional peacekeeping and peace enforcement. Concurrently with this transformation, protection of civilians has become increasingly important. How do countries like Ghana and India, two of the main contributors of troops to UN missions, define, approach, and experience the task of protecting civilians? What do they consider its key components to be? And what do they think is required to protect well? This new DIIS report concludes that the individual combat experience of troop-contributing countries is a defining feature of how protection of civilians is approached in peacekeeping missions. The report suggests that it is important to understand how difference plays out across missions, and how countries that contribute troops to missions understand and respond to their roles in these missions. This understanding is required in discussions about how effective and coherent we might expect peacekeeping to be as a form of intervention. This report is based on fieldwork in India and Ghana. Data on the Ghana case has been partially collected through the project Domestic Security Implications of Peacekeeping in Ghana (D-SIP), funded by the Danish Ministry of Foreign Affairs.

Abstract:
The Centre for Policy Research-Namati Environmental Justice Program trains and supports a network of community paralegals or grassroots legal advocates who work with communities affected by pollution, water contamination and other environmental challenges. They use the legal empowerment approach to make communities aware of laws and regulations that can help secure much needed remedies for these problems that often arise out of noncompliance or violation of environmental regulations. As part of their work, the community paralegals write about their cases to create public awareness on the use of law outside of courts as well as engage the readers in these issues. This is an updated collection of published stories written by paralegals and their team members working in coastal Gujarat, Northern Karnataka, Chhattisgarh and Keonjhar, Odisha. These are a combination of case stories and opinion pieces on issues of industrial non-compliance that have adversely affected many local communities. Each article tries to highlight the gap between the law on paper and its implementation in reality, while putting forth the conviction that putting law in the hands of ordinary people can shift the balance of power in support of justice.

7. Closing the Enforcement Gap: Groundtruthing of Environmental Violations in Bodai-Daldali, Chhattisgarh

Abstract:
Janabhivyakti, the Centre for Policy Research-Namati Environmental Justice Program and Oxfam India have jointly conducted a groundtruthing study of environmental violations in the Bodai-Daldali bauxite mine located in the Kabirdham district of Chhattisgarh. A groundtruthing study is the process of comparing the facts as mentioned in official documents with the impacts being reported by affected communities. The methodology included undertaking group discussions with the affected communities. During the group discussions, impacts which the communities were facing were discussed first. This was followed by brief discussions on the various laws and institutions which are available for dealing with impacts arising out of environmental violations. The violations were confirmed by government reports and independent research studies. These reports and studies date back to the year 2007, and some of the impacts have been in existence since the beginning of the mining operations, and have been recorded in the aforementioned reports.

Abstract:
According to Human Rights Watch there are estimated to be over fourteen million child brides worldwide, many of whom are traded for debt, bondage, and in contexts where polygamy and sexual activities with children go hand in hand, justified by religion or custom.(United Nation, 2013:31) There occurs a victimization of a new rising class of feminists in countries like Pakistan, where Islamist extremism from 1977 to 1988 especially targets and instances even murders or attempts to murder women who challenge their patriarchal power base. The analysis that represents these forms of violence against women and women’s struggles for justice delivery in Pakistan by using their voices and their stories, from their frame of analysis have been failed miserably.

Abstract:
India’s immense diversity is unique with its pluralism based on myriad ethnic communities, cultures, religious identities and tribes. Since independence, the country failed to produce one single dominant nation’s concept because identities have not yet forged a common national outlook and its ethnic, religious, and cultural identities remains strong and quite distinctive. Moreover, the Indian federal structure seems to be failed to accommodate the expectations of diverse communities and socio-political cultures. Consequently, the federation is asymmetric with the separatist movements in many parts of the country specifically violent movements in Kashmir, Nagaland, Assam, Manipur and Mezoland which have severely challenged the country’s sovereignty. Furthermore, the insurgencies in Northeast of India and violent movements of Naxalites and Maoist have also challenged India’s territorial integrity. In the same manner the Dalits (Harijan) and minorities (Christians and Muslims), are the victims of superior Hindu caste and Hindu chauvinism. Hence it is perceived that India has lost sight of vital constitutional spirit of secularism and federalism. Further, the worst internal security situation lies on India’s unfair, unbalanced and discriminatory policies with the communities and especially with its judicial system. Nonetheless, it has proved that various socio-economic and political imperatives are not fulfilled by the ruling elites or society. Thus, ethno-religiousideological fault lines, which exist in India, have to be managed with a sense of fairness and transparent federal policies and there is no need to use forces to suppress people. In this context, India requires peaceful and development manual at the national level in order to stabilize all section of society. Without a coordinate approach, the domestic security threats will lead the country to the worst situation.

10. Paralegals for Environmental Justice (Version 2.0)

Abstract:
Large parts of the world, irrespective of their level of economic development, are at the cusp of severe environmental crises. In these regions, the operations of extractive projects such as large scale plantations, mining and industrial development have negated or worsened the economic, social and physical well-being of communities in their neighbourhoods and beyond. Their robust national and regional laws and institutions for the protection and governance of the environment and natural resources have remained on paper and the non-compliance by governments and corporations has had profound effects on community livelihoods, health, access to land and quality of life. CPR-Namati's Practice Guide for Environment Justice Paralegals is a step in the direction of closing this environmental enforcement gap. The guide provides a methodology for community mobilisers, activists and citizens groups to shift their attention from stating the problem to getting grievances addressed by environmental institutions. The guide is based on four years of work done by the paralegals of CPR-Namati Environment Justice Program to assist affected communities file complaints and seek remedies in over 150 cases of non-compliance in India. We hope that this guide will help local organisations and community groups to address environmental conflicts and seek useful remedies for affected people.
