1. 18TH Constitutional Amendment: Implications for the Federation of Pakistan

Abstract:
Eighteenth Amendment to Pakistan’s Constitution has made the Prime Minister of Pakistan, and hence the parliament, stronger instead of the President by abolishing Article 58(2) (b) just as the ‘Glorious Revolution’ of 1688-1689 in England made the parliament stronger by abolishing ‘Divine Rights’ of the kings and paving the way towards the constitutional monarchy by passing the ‘Bill of Rights’ in 1689. Just as the ‘Bill of Rights’ constituted a new era of democracy in England, the 18th constitutional amendment has promised the same. Furthermore, this constitutional software has removed the Concurrent List from the Constitution of 1973, thereby assigning more administrative, legislative and fiscal responsibilities to the federating units. The paper finds that by the passage of the 18th amendment, concrete constitutional measures were taken to transform a ‘centralized federation’ into a ‘participatory federation’ and now it is the constitutionally-driven responsibility of the provinces to chalk out development projects, addressing the people’s demands through enhanced fiscal discipline and well-coordinated public policies at their levels. In addition, consensus over the 7th NFC award was an historically important event in the politicoconstitutional annals of the federation of Pakistan.

Abstract:
The article studies the dynamics of ethnic conflict in Balochistan and its relation to the paradigm of democracy in Pakistan during the first elected government in the Bhutto Era. Like many third-world countries, the language controversies in Pakistan have provoked ethnic and political conflicts. Due to disagreements over the national language, the government was unable to develop a constitution for nearly 9 years after independence. Though the dispute was theoretically resolved in 1956, it continues to haunt the state. Although Bhutto was an elected leader, his rule was not immune to ethnic conflicts. Ethnic sentiments garnered attention in Balochistan, triggering confrontations and secessionist tendencies. An insurgency began in Balochistan, causing harm to both the Baloch and the state, and it still exists. The article affirms that in this context, ethnic conflicts have political objectives; the main causes of such conflicts are political, such as under-representation in state institutions, unequal distribution of resources, economic disparities, and, in many cases, the state elite's reluctance to recognise the identity of a particular ethnic minority.

3. Paradoxes of Judicial Independence: Issues and Challenges of Constitutionalism in Pakistan

Abstract:
Pakistan has oscillated between weak civilian rules and military regimes throughout its history. Military co-option with the judiciary, alongside few exceptions commenced an era of dissolutions in 1988. This led to develop an institutional imbalance which undermined the representative institutions by upholding the presidential orders to dismiss federal and provincial assemblies in Pakistan. The judiciary in Pakistan largely remained a reactionary institution as it endeavored for the self-preservation rather than upholding the constitutionalism and enforcing the rule of law. Judiciary‟s political assertiveness during the decade of 1990s by addressing the political questions led to decline of its impartial character. This research expounds that judiciary‟s informal support for military increased the federal challenges of Pakistan and enhanced the authoritarian features of the state. This paper also explicates that by validating the dismissals of the representative institutions and authorizing the military regimes to amend the constitution, Judiciary compromised its judicial independence, which is one of the salient features of Constitution of 1973. Keeping in view the nature of case study and employing qualitative approach of research, this paper largely addresses the key question that how judicial Independence is relevant to the issues of federalism and democracy in Pakistan.

4. Water and Federalism: Working with States for Water Security

Abstract:
India’s poor water security indicators are partly a result of the poor translation of federal spirit in governing its water resources. The limited scholarship on the subject recognizes the vacuum in federal water governance and the weak articulation of Centre’s role to work with states in pursuing India’s long-term development and security goals. Besides, coherent federal responses are critical to address the new governance challenges and emerging risks such as those linked to climate change, floods, dam safety, etc. Yet the national discourse on water federalism is dominated by interstate river water disputes. The study breaks new grounds by going beyond the narrow frame to engage comprehensively with the idea of water federalism in India. It explores the range of policy, institutional, legal and financial instruments for improved water governance. Conceptualised as the Centre’s leverage, the study investigates into these instruments to explore opportunities for the Centre to work with states for improved outcomes. Using mixed methods of qualitative and quantitative approaches, the study looks at the transforming Indian federal state from two contrasting viewpoints: the shifting stakes of the Centre and states in water resources development; and the converging forces of development goals and security concerns. The analysis is supported by case studies of Maharashtra, Punjab and Karnataka states revealing the diverse territorial imaginations and priorities of water resources development and, their implications for national water security. It also examines the experiences of central schemes through intergovernmental fiscal transfers and federal water governance practices internationally to incentivize states’ progressive pathways in water resources management. Identifying federal consensus-building about the Centre’s role and autonomous institutional architecture for data as the two foundational pillars, the study makes concrete recommendations to improve federal governance for long-term development and water security.

5. Unlocking Climate Action in Indian Federalism

Abstract:
India’s highly centralized federal structure sits uneasily with the nature of the climate problem. While financial and bureaucratic capacities are concentrated in the centre, the locus of climate decisions lies largely in the states because they steer energy choices and respond to climate impacts. To unlock state action, the roles and capacities of the centre and states must be reimagined in the age of the climate crisis. This brief lays out the contours of an institutional redesign. We attempt to strike a delicate balance between flexibility, essential to innovative and opportunistic state actions, and the structure necessary for a coherent national policy trajectory. Specifically, we call for a specific focus on increasing specialized capacity to deal with climate change; coordination mechanisms; and financial incentives to motivate the states.

6. Compensatory climate governance in Indian federalism

Abstract:
It is on the precarious and ever-shifting terrain of Indian federalism that a modern edifice of climate governance must be built. Where is the firm ground? Are there enduring characteristics of centre-state relations that let us arrive at a relatively stable description of Indian climate governance? In this working paper, we arrive at a synthetic account of the constant forces shaping climate governance in India’s federal architecture, building on descriptions of environmental federalism and state actions in climate policy. We argue that the highly asymmetric nature of Indian federalism — a federal government holds the reins of state finances and constitutes the bulk of planning and bureaucratic capacity — makes compensatory relations between centre and states inescapable in climate governance. Emergent practices have involved the use of institutional channels of fiscal transfer and federally mandated planning processes to help catalyse climate activity across India’s states. States have taken fragments of the national agenda and adapted them to local political contexts that are hitherto innocent of ‘climate’ politics phrased as such. They play the role of marrying broader mitigation and adaptation concerns to local development. In the process, they contribute to the compensatory dynamic by creating a stream of policy ideas that then come to define the national response through channels of federal diffusion.

7. Dynamics of India’s Contemporary Domestic Security Challenges

Abstract:
India’s immense diversity is unique with its pluralism based on myriad ethnic communities, cultures, religious identities and tribes. Since independence, the country failed to produce one single dominant nation’s concept because identities have not yet forged a common national outlook and its ethnic, religious, and cultural identities remains strong and quite distinctive. Moreover, the Indian federal structure seems to be failed to accommodate the expectations of diverse communities and socio-political cultures. Consequently, the federation is asymmetric with the separatist movements in many parts of the country specifically violent movements in Kashmir, Nagaland, Assam, Manipur and Mezoland which have severely challenged the country’s sovereignty. Furthermore, the insurgencies in Northeast of India and violent movements of Naxalites and Maoist have also challenged India’s territorial integrity. In the same manner the Dalits (Harijan) and minorities (Christians and Muslims), are the victims of superior Hindu caste and Hindu chauvinism. Hence it is perceived that India has lost sight of vital constitutional spirit of secularism and federalism. Further, the worst internal security situation lies on India’s unfair, unbalanced and discriminatory policies with the communities and especially with its judicial system. Nonetheless, it has proved that various socio-economic and political imperatives are not fulfilled by the ruling elites or society. Thus, ethno-religiousideological fault lines, which exist in India, have to be managed with a sense of fairness and transparent federal policies and there is no need to use forces to suppress people. In this context, India requires peaceful and development manual at the national level in order to stabilize all section of society. Without a coordinate approach, the domestic security threats will lead the country to the worst situation.

Abstract:
National integration has remained an evolving pursue in all the post-colonial divided societies. Although various approaches and strategies of national integration have been opted , but the situation remained complex. The state of Pakistan is also facing problems in the creation of national integration. These problems are due to conflicting socio-political fibre of Pakistani Society which was not handled properly. The diverse fibre of Pakistani Society was based on its ethnic composition. The state adopted an authoritarian policy to expand and consolidate its power and position. While responding authoritarian policy, ethnic groups provoked ethnic politics and started movements for the preservation of their identity. With due course of time, these ethnic movements become a challenge to the national integration. The study has its focus on various approaches to national integration. The research has also highlighted that although federalism is the best suited system for plural societies but effective working of federal institutions is required. For the creation of national integration, assimilationist strategy should be avoided and a pluralistic approach must be incorporated. Central government’s role as facilitator can diffuse the tension and brighten the process of national integration.
