22. Hamas: Ideological Rigidity and Political Flexibility

- Although peaceful coexistence between Israel and Hamas is clearly not possible under the formulations that comprise Hamas's 1988 charter, Hamas has, in practice, moved well beyond its charter. Indeed, Hamas has been carefully and consciously adjusting its political program for years and has sent repeated signals that it may be ready to begin a process of coexisting with Israel. As evidenced by numerous statements, Hamas is not hostile to Jews because of religion. Rather, Hamas's view toward Israel is based on a fundamental belief that Israel has occupied land that is inherently Palestinian and Islamic. For Hamas, “recognition” of Israel would represent a negation of the rightness of its own cause and would be indefensible under Islam. It considers unacceptable for itself the actions of those Muslim countries that have recognized Israel, such as Egypt and Jordan, and those that have indicated their willingness to do so, such as Saudi Arabia and the rest of the Arab League, because they have provided no theological justification for their policies toward Israel. Although Hamas, as an Islamic organization, will not transgress shari'a, which it understands as forbidding recognition, it has formulated mechanisms that allow it to deal with the reality of Israel as a fait accompli. These mechanisms include the religious concepts of tahadiya and hudna and Hamas's own concept of “Palestinian legitimacy.” Tahadiya refers to a short-term calming period between conflicting parties during which differences are not put aside. A tahadiya stopped most violence between Hamas and Israel from June to December 2008. Hudna is a truce for a specific period, which is based on the practice of the Prophet Mohammad and on subsequent events in Muslim history. Hamas has indicated on a number of occasions its willingness to accede to a hudna with Israel, assuming basic Palestinian rights as set forth in the Arab Peace Initiative (API) are agreed to first. Palestinian legitimacy is a term employed by Hamas to describe its willingness to consider accepting a binding peace treaty, such as the proposal set forth in the API, so long as the treaty is first ratified by the Palestinian people in a referendum. Although Hamas would not directly participate in peace negotiations with Israel, Hamas has indicated that it would be willing to be part of a Palestinian coalition government with Fatah under which Fatah would negotiate the actual treaty. Although a peace process under such circumstances might, for Israelis and Westerners, seem involved, arcane, and of dubious utility, it is necessary to consider the possibility of such a process because there is no realistic scenario under which Hamas will disappear. Understanding the Islamic bases of Hamas's policies and worldview will be essential for the success of any process in which it is engaged.

- Insurgency and counterinsurgency as types of warfare are currently subject to considerable attention due to the nature of the high-profile struggles underway in Afghanistan and Iraq. It is prudent to note that neither insurgency nor the strategy and tactics required to combat it represent new phenomena. A large body of experience and literature from the twentieth century and earlier exists that addresses both sides of the insurgent struggle. Some characteristics of insurgencies are largely immutable, since insurgency is ultimately a form of warfare that is adopted when a combatant has limited resources and limited choices for how to fight against a more powerful adversary. Today as in the past, these characteristics include employment of small-unit attacks, ambushes, assassinations, propaganda activity, and the development of covert infrastructure. Nevertheless, the primary insurgencies active in the twenty-first century are marked by important differences from earlier struggles, particularly in the areas of motivation and inspiration. Rather than being quintessentially political and interested in local or national grievances, many contemporary insurgencies are at their core linked to a particular interpretation of Islam. Thus, these insurgencies represent a war of religion, not of politics, economics, or ethnicity. Islamist insurgencies are likely to be uncompromising and averse to negotiation, absolutist and pan-national in their goals, and willing to justify the mass slaughter of non-combatants who do not share their religious vision.

- This week, Saudi Arabia is organizing a global interfaith conference in Madrid, with more than 200 Muslim, Christian, Jewish, Hindu, and Buddhist religious leaders from 54 countries expected to attend. The conference, in the words of its main organizer, the Mecca-based Muslim World League, will "focus on common human values." Many in the West, however, will likely judge the conference as a Saudi public relations effort to emphasize its leadership of the Islamic world, and to ward off criticism, especially from the United States, that Saudi Arabia bears continuing responsibility for political and financial backing of Sunni extremists across the Middle East.

- In the aftermath of a wave of deadly terrorist attacks that began in 2003, the Kingdom of Saudi Arabia launched a wide-ranging counterterrorism campaign. Central to Saudi counterterrorism efforts has been the use of unconventional “soft” measures designed to combat the intellectual and ideological justifications for violent extremism. The primary objective of this strategy is to engage and combat an ideology that the Saudi government asserts is based on corrupted and deviant interpretations of Islam. The impetus for this soft approach came in large part from the recognition that violent extremism cannot be combated through tradition security measures alone. This Saudi strategy is composed of three interconnected programs aimed at prevention, rehabilitation, and postrelease care (PRAC). Although only in operation for the past four years, the Saudi strategy—especially the rehabilitation and counter-radicalization programs—has generated very positive and very intriguing results. To date, recidivist and rearrest rates are extremely low, at approximately 1 to 2 percent. Similar programs designed to demobilize violent extremists and their supporters are increasing in popularity, with a number of countries adopting comparable counter-radicalization programs. Algeria, Egypt, Jordan, Yemen, Singapore, Indonesia, and Malaysia have all established rehabilitation and engagement programs, as has the U.S. military through Task Force 134 in Iraq. As such, the importance of understanding the Saudi strategy, and counter-radicalization broadly, is increasing in relevance in the fight against violent radical Islamist extremism

- During the last several months, the question of whether women in Saudi Arabia should be allowed to drive has become a lively topic of debate within the kingdom. Support for the issue has come from the newly enthroned King Abdullah; the most prominent opponent is the long-serving interior minister, Prince Nayef. The men are viewed as political rivals frequently at odds over a range of policies. Increasingly, women driving seems a metaphor for the series of security, economic, and educational challenges facing the kingdom—and therefore a tempting policy opportunity for the United States.

This has raised a storm of criticism from supporters of the Palestinian intifada against Israel. However, the mufti may have been thinking more about Osama bin Ladin than recent Palestinian actions.
