1621. North Caucasus Weekly: Rebels Reportedly Kill Dozens of Servicemen in Ingushet

Abstract:
Following the capture of the foothill villages of Muzhichi and Yandare in Ingushetia on the evening of October 16 (North Caucasus Weekly, October 16), militants from the Ingush Jamaat “Shariat” carried out another series of high-profile actions against Russian troops. According to various sources, more than 50 Russian military personnel were killed and wounded in two assaults by the militants on the Galashki Highway on October 18, which would make this the most audacious attack by the jamaat members in Ingushetia to date. According to the media reports, the attack on the Russian military motorcade took place on the Alkhasty-Surkhokhi road in Ingushetia's Nazran district at ten in the morning. According to Ingush Prosecutor General Yury Turygyn, only two soldiers were killed and five were wounded in the attack. All of them were from Interior Ministry detachments based in the village of Alkhasty (RIA Novosti, October 18) According to Turygyn, the assault was carried out by members of “illegal armed formations” with the purpose of destabilizing the situation in the region. Turygyn, however, was apparently referring to the casualties in an attack on another column of servicemen that had occurred earlier on October 18, and the Regnum News Agency quoted a source in the Interior Ministry department forIngushetia's Sunzha district as saying that all the soldiers in the column targeted in the second attack were killed except forone and that the total number killed was around 50. The surviving serviceman was transported to the Sunzha Central District Hospital, the source said (www.regnum.ru/news/1071507.html). Thus, according to the Ingush police, two attacks took place, not one, as the Ingush Prosecutor General's Office claims.

Abstract:
The closure case against the ruling AK Party pending before the constitutional court occupied the center stage of Turkish politics throughout the summer. After months of speculation on the fate of the party, the court finally reached a verdict in late July, deciding not to close down the AK Party, and averting what had otherwise promised to be an unprecedented level of political uncertainty, social and economic turmoil, and potential chaos. With the closure case now behind it, the AK Party is expected to be more restrained, and to act responsibly – as it did during the proceedings of the case – while building up its democratic and secular credentials through a reform policy in keeping with the EU accession process. For some time, the ruling AK Party had been under pressure for neglecting, if not abandoning, the EU membership process. In response to critics the government may refocus its energy on the issues that have stalled Turkey's accession.

Abstract:
Georgia's military gamble in South Ossetia in August 2008 opened a Pandora's Box of misfortunes. Tbilisi is now faced with the loss of its breakaway republics of South Ossetia and Abkhazia, meanwhile creating a potential opportunity for Russia to assume a much-coveted control over the energy transit routes passing through Georgia. While the conflict has further spoiled the relations between the West and Russia, setting in motion stiffer competition between the two to secure the energy sources of Central Asia and Azerbaijan, the pragmatic calculations of the players involved in the Eurasian energy game may eventually change the tone of the game. With unresolved issues surrounding doubts over the sufficiency of energy supplies and the availability of means to deliver them from Central Asia and the Caucasus to Europe, Russia's preeminent position as a supplier of energy to the West will be maintained.

1624. The History of International Legal Theory in Russia: a Civilizational Dialogue with Europe

Abstract:
This review essay examines the main breaks and continuities in the history of international legal theory in Russia. In particular, it draws on works by leading Russian international law scholars: Peter Pavlovich Shafirov (1670-1739), Fyodor Fyodorovich Martens (1845-1909), Baron Mikhail Taube (1869-1956), Vladimir Emmanuilovich Hrabar (1865-1956), Fyodor Ivanovich Kozhevnikov (1893-1998) and Grigori Ivanovich Tunkin (1906-1993). The reception of these theoreticians' works in today's Russia is also examined. The history of the discipline in Russia opens itself up as a civilizational dialogue with (Western) Europe. The main questions have been: Is international law universal or fragmented; what is the progressive force in international law? The Russian theory of international law has moved from proving that 'we too are civilized/European' in the early 18th century to an aspiration towards Western European civilization in the 18th and 19th centuries to the break with the West and an affirmation of Russia's own distinctiveness and primacy in the 20th century. Those who hurriedly celebrated Russia's reunion with Europe (and Western liberal theory of international law) following the end of the Cold War should not lose sight of the longer historical perspective and especially the experiment of the 'civilizing'/Europeanizing/liberalizing project in 19th century Russian and Baltic German international law scholarship.

From the vantage point of 2008, some of the most memorable initiatives of U.S. international economic leadership—the Paris and Louvre Accords, the support for Poland and Russia after the fall of communism, the Uruguay Round, and the Mexican Financing Loan—seem like quaint reminders of a simpler time. In the coming years, the exercise of international economic leadership will surely prove more complex than in the past. The very success of the American vision of a global spread of vibrant and competitive markets has created a huge, rapidly integrating private economy of trade and finance much less amenable to guidance, let alone control, by governments. Unlike in diplomacy and defense, where non state actors are growing in importance but still a side show, in inter- national economics, households, corporations, labor unions, and non-profits are now the dominant players in most parts of the world. While they respond to national laws and policies, their interests are varied and their operations often span borders.

1627. The Struggle for a Civilised Wider European Order

Abstract:
Europe's two crises – the Georgia-Russia war of August and the ongoing global financial and economic crisis – point to huge challenges for the organisation and policies of the European Union. The present paper concentrates on the risks that the crises represent for one of the EU's prim e objective, to achieve a civilized wider European order. At least the current episodes show that with leadership the EU can act fast in both diplomacy and finance. But the next question is how to follow through, beyond a passing moment of an effective six-month presidency of the EU. This is the subject of the present note, which advocates a comprehensive upgrading of the EU's policies in the wider European area, and contributes ideas for the revision of the European Security Strategy currently being prepared. The aim would be to strengthen EU policies towards South-East Europe, East Europe and Central Asia, and defuse the current confrontation between a normative Europe and an aggressive Russian realpolitik; better still Russia might, after reflecting on what the two crises mean for its fundamental interests, conclude that the time had come for a more genuinely cooperative understanding with the EU.

Abstract:
The “Friendly EU Border” project, as a part of which the present report has been prepared, commences from the assumptions that external EU borders represent an important aspect of the EU's policies in the field of security and of Justice and Home Affairs. Finland, a country with a long external border with Russia, has been a member of the EU since 1995. Thus, Finland's experience is pertinent for other EU Member States that joined the Union in 2004 and 2007, most of which share their external borders with third countries outside the EU. The EU membership has certainly affected the operations of the Finnish border control, but – perhaps even more notably – the Finnish border control expertise has had a crucial influence on the way border control has been developed on European scale.

In recent years, Russia's resurgence has been driven by favourable conditions rather than solid foundations. Despite the favourable conditions, Russia's resurgence has only achieved mixed results. Buoyed by economic growth, Russia has become wealthy, assertive and confident; but the country has also alienated and provoked its neighbours and the West. Sustaining these conditions is unlikely due to problems resulting from Russia's internal structural weaknesses and assertive foreign policy. Without change, these problems are likely to worsen. Energy exports – the cornerstone of Russia's resurgence – are set to decline. The end of this boom threatens Russia's domestic stability and ability to tackle other long-term threats as external resistance to Russia hardens.

1630. From Hegemony to New Geopolitical Competition: Assessing Russia's Strategic Footprint In Central Asia

Abstract:
Russia's conduct in the post-Soviet space in general and its policies toward Central Asia in particular should be seen within the context of Russia's post-imperial readjustment. The notion of the sphere of “privileged interests” currently advanced by the Kremlin is a clear indication that Russia's search for a new modus operandi with its ex-Soviet neighbours is a painful and, essentially, an open-ended process. Moscow views Central Asia as an area of great strategic importance as it presents both considerable opportunities (due to the region's rich energy resources) and serious threats (stemming from the region's inherent instability and its proximity to volatile Afghanistan). Russia's key interests in Central Asia appear to be preservation of the region's stability, strengthening control over the region's energy resources, and balancing other major actors that are increasing their presence in the region – the United States and China. The effectiveness of the Kremlin's policies in Central Asia seems to be constrained by the nature of Russia's current socio-political system whose key features are authoritarianism and rent-seeking. The latter prompts Moscow to act as a conservative rather than reformist force in the region. Russia's goal of maintaining strategic pre-eminence in Central Asia underpinned by Moscow's significantly increased economic and political clout may ultimately not be realized. The odds are that, given the rise of China, Russia may prove to be a weaker competitor. The European Union's strategic interests increasingly compel the bloc to engage the Central Asian nations, particularly in the spheres of energy and security. Eventually, Russia's wariness of China's growing economic and political clout might prompt Moscow to seek deeper cooperation with Brussels in Central Asia.
