121. EU Sanctions Against Russia: Europe brings a hard edge to its economic power

Abstract:
The EU has responded to the Ukraine crisis with a set of political and economic sanctions against Russia which constitute a qualitatively new step in the EU sanctions policy. The EU sanctions against Russia are exceptional and have strategic importance due to a combination of three factors: big power rivalry, the context of a major European crisis with global ramifications, and the costs of the sanctions for the EU itself. The EU has managed to maintain its fragile unity and has applied its collective diplomatic and economic weight in very difficult circumstances. The sanctions have not provided an alternative to diplomatic efforts to solve the crisis - on the contrary, hardening sanctions have been used as a way to put pressure on Russia to seriously engage in diplomacy. The impact of the sanctions on daily developments in Ukraine has been limited and uncertain, but the sanctions have imposed a long-term cost on Russia for violating key international norms. The policy process of Russia sanctions has exposed problems of leadership and coordination. The latest reform of the EU foreign policy machinery has streamlined the preparation of sanctions, but the current system still lacks the necessary resources to match the growing importance of the EU sanctions policy.

122. Russia's Punitive Trade Policy Measures towards Ukraine, Moldova and Georgia

Abstract:
While EU and US sanctions against Russia over its aggression in Ukraine, and Russia's counter-sanctions, are much discussed due to their evident political significance, less attention has been given to Russia's punitive sanctions against the three Eastern European states – Ukraine, Moldova and Georgia – that have signed with the EU Association Agreements (AA), which include Deep and Comprehensive Free Trade Area (DCFTA) provisions. This paper therefore documents these trade policy restrictions and embargoes imposed by Russia, and provides some first indications of their impact. The immediate impact on trade flows, especially for agri-food products, has been substantial, albeit with some leakage through Belarus. The main instrument for the Russian measures has been allegations of non-conformity with Russian technical standards, although the correlation of these allegations with movements in Russia's geopolitical postures makes it obvious that the Russian technical agencies are following political guidelines dressed up as scientific evidence. These measures also push the three states into diversifying their trade marketing efforts in favour of the EU and other world markets, with Georgia already having taken significant steps in this direction, since in its case the Russian sanctions date back to 2006. In the case of Ukraine, Russia's threat to cancel CIS free trade preferences infiltrated trilateral talks between the EU, Ukraine and Russia, leading on 12 September to their proposed postponement until the end of 2015 of the 'provisional' implementation of a large part of the AA/DCFTA. This was immediately followed on 16 September by ratification of the AA/DCFTA by both the Rada in Kyiv and the European Parliament, which will lead to its full and definitive entry into force when the 28 EU member states have also ratified it. However Putin followed the day after with a letter to Poroshenko making an abusive interpretation of the 12 September understanding.

Abstract:
The Islamic Republic has added to its nuclear negotiating team a law professor who has extensive experience making Iran's case in international disputes. On April 9, Iran and the P5+1 (Britain, China, France, Russia, and the United States, plus Germany) concluded the latest two-day round of talks on a nuclear deal, setting the next round for May 13. Earlier in the week, on April 7, Iranian media reported the appointment of Dr. Jamshid Momtaz as head of a "legal advisory group" to the Iranian negotiating team. A French-educated expert on sanctions, disarmament, and UN procedure, Momtaz has represented the Iranian government in some of its highest-profile international legal proceedings, including in claims against the U.S. government at the Hague-based International Court of Justice (ICJ). Momtaz's familiarity with the United Nations, his extensive practice in Europe, and his proven history of leveraging complex legal arguments to advance Iran's international interests indicate that in these latest rounds of P5+1 talks Tehran is likely looking for unconventional ways to "address" and "bring a satisfactory conclusion to" the UN Security Council resolutions against it, as called for in the Joint Plan of Action (JPOA) agreed to in Geneva last November.

US and Iranian strategic competition is heavily drive by four key factors–the success or failure of sanctions, the im0pact of that competition on the flow of Gulf energy exports, the success or failure of efforts to limit Iran's nuclear options and the broader prospect for arms control, and the prospects for accommodation of regime change. In recent years, the key variable has been ways in which sanctions on Iran have changed US and Iranian competition since the fall of 2011, and helped lead to a tentative set of Iranian agreements with the UN's P5+1--the five permanent members of the UN Security Council, namely United States, Russia, China, United Kingdom, and France, plus Germany--in November 2013.

On June 19, Iran concluded the third round of talks on its nuclear program in as many months, this time in Moscow, with senior officials of the six powers - the United States, the United Kingdom, France, Germany, Russia, and China. Although there were strong incentives for the six to secure limits on Iran's most worrisome stockpiles of enriched uranium and for Iran to avoid an impending tightening of economic sanction, no breakthrough was achieved by the end of the latest round. But neither did diplomatic dialogue come to an end. The sides reached agreement to meet again at a technical level within two weeks in Istanbul, to be followed by renewed contact between the senior negotiators. With perseverance from the parties, the ongoing talks can mark the end of the beginning rather than the beginning of the end of chances for ultimate resolution.

By all reckoning, the latest round of UN sanctions on Iran (Resolution 1929, 9th June 2010), backed up by further extension and expansion of the scope of US sanctions (June 2010) and imposition of EU sanctions on 26th July 2010, should make life very difficult for the Islamic Republic. The continued tightening of the sanctions regime indicates the serious concerns that Tehran have aroused over the development of its nuclear programme. Iran professes its commitment to only a civilian nuclear programme in conformity with its obligations under the Nuclear Non Proliferation Treaty (NPT); a large number of states of the international community suspect Iran of developing a military programme behind the cover of its legitimate civilian one. Tehran's protestations of innocence of the charge have regularly been dismissed by most of its neighbours, and even the International Atomic Energy Agency (IAEA) has not been fully satisfied on this point by Tehran. The issue has generated a set of proposed responses from various members of the international community, ranging from extreme options of surgical strikes against Iran's nuclear facilities (favoured by Israel, and under consideration in some segments of the US administration), through moderate options of international sanctions regime (favoured by most of the states, including USA and the EU) to the softer options of persuasion by continued and growing diplomatic engagement (China and Russia). Over the past two years, international opinion has steadily drifted towards a tight sanctions regime, reflected in the UN Resolution in June 2010 and that of the EU in July. Valid questions are, however, being raised about the efficacy of the international sanctions regime.

Abstract:
Three basic conditions prevailed when the Arab-Israeli peace process began in 1991 in Madrid and accelerated in 1993 at Oslo. First, the Soviet Union crumbled and eventually collapsed, removing what had since 1955 been the strategic backbone of the Arab military option against the State of Israel. Second, Iraq was militarily crushed and under both UN sanctions and monitoring, and was therefore removed from the political and military calculus of relations between Israel and the Arab world. Third, Iran was still recovering from its eight-year war with Iraq and was far from ready to have an impact in the Middle East. Together, these three conditions created a unique moment of Pax Americana, maintained not just by virtue of American power, but by the consent of its potential rivals.
