121. Estonian corporate tax: Lessons for Poland

Abstract:
Estonia has Europe’s most transparent tax system (while Poland is second-to-last, in 35th place), and is also known for its pioneering approach to taxation of legal persons’ income. Since 2000, payers of Estonian corporate tax don’t pay tax on their profits as long as they don’t realize them. In principle, this approach should make access to capital easier, spark investment by companies and contribute to faster economic growth. Are these and other positive effects really noticeable in Estonia? Have other countries followed in this country’s footsteps? Would deferment of income tax be possible and beneficial for Poland? How would this affect revenue from tax on corporate profits? Would investors come to see Poland as a tax haven? Does the Estonian system limit tax avoidance and evasion, or actually the opposite? Is such a system fair? Are intermediate solutions possible, which would combine the strengths or limit the weaknesses of the classical and Estonian models of profit tax? These questions are discussed in the mBank-CASE seminar Proceeding no. 163, written by Dmitri Jegorov, deputy general secretary of the Estonian Finance Ministry, who directs the country’s tax and customs policy, Dr. Anna Leszczyłowska of the Poznań University of Economics and Business and Aleksander Łożykowski of the Warsaw School of Economics.

122. The Story of the Open Pension Funds and the Employee Capital Plans in Poland. Will It Succeed This Time?

Abstract:
Poland’s new Employee Capital Plans (PPK) scheme, which is mandatory for employers, started to be implemented in July 2019. The article looks at the systemic solutions applied in the programme from the perspective of the concept of the simultaneous reconstruction of the retirement pension system. The aim is to present arguments for and against the project from the point of view of various actors, and to assess the chances of success for the new system. The article offers a detailed study of legal solutions, an analysis of the literature on the subject, and reports of institutions that supervise pension funds. The results of this analysis point to the lack of cohesion between certain solutions of the 1999 pension reform and expose a lack of consistency in how the reform was carried out, which led to the eventual removal of the capital part of the pension system. The study shows that additional saving for old age is advisable in the country’s current demographic situation and necessary for both economic and social reasons. However, the systemic solutions offered by the government appear to be chiefly designated to serve short-term state interests and do not create sufficient incentives for pension plan participants to join the programme.

Abstract:
This report, prepared by a team of economists from CASE, is a continuation of the 2018 analysis The significance of the tobacco product manufacturing to Poland’s economy commissioned by JTI Polska Sp. z o.o. The purpose of the research whose results are presented in this report is to assess the economic significance, challenges and development prospects of the tobacco product manufacturing, trade and distribution sector in Poland. In the report we analyze a cross-section of the tobacco industry and its significance for the economy as a whole. We also present the significant barriers to the sector’s growth, i.e. the illicit market, costs of compliance and regulatory uncertainty, and we also model the long-term macroeconomic effects of potential changes in the industry. To the best of our knowledge, at the moment this is the most comprehensive economic study of the sector.

Abstract:
The rule of law, by securing civil and economic rights, directly contributes to social prosperity and is one of our societies’ greatest achievements. In the European Union (EU), the rule of law is enshrined in the Treaties of its founding and is recognised not just as a necessary condition of a liberal democratic society, but also as an important requirement for a stable, effective, and sustainable market economy. In fact, it was the stability and equality of opportunity provided by the rule of law that enabled the post-war Wirtschaftswunder in Germany and the post-Communist resuscitation of the economy in Poland. But the rule of law is a living concept that is constantly evolving – both in its formal, de jure dimension, embodied in legislation, and its de facto dimension, or its reception by society. In Poland, in particular, according to the EU, the rule of law has been heavily challenged by government since 2015 and has evolved amid continued pressure exerted on the institutions which execute laws. More recently, the outbreak of the COVID-19 pandemic transformed the perception of the rule of law and its boundaries throughout the EU and beyond (Marzocchi, 2020). Against this background, this study examines the rule of law as a determinant of economic development in Germany and Poland from both the de jure and de facto perspectives.

125. Guidebook: Direction: An Efficient State

Abstract:
The Polish Decentralisation Guidebook aims at presenting in a synthetic way the experience of Poland regarding the re-introduction of local government and the decentralisation process since 1989. Its main goal is to provide representatives of central and regional authorities, experts, and representatives of opinion-forming circles in Armenia and Georgia with relevant information and knowledge. The idea of the authors of this Guidebook was to facilitate mutual learning between the countries, the exchange of good practices, and lessons learned. The territorial division of Armenia was established in 1995. Now the country has two levels of administrative division – regions and communities – and the local self-government is exercised only on the level of communities. In the case of Georgia, administrative reform aimed at introducing local government started in 1997. Currently, self-government in Georgia is exercised on just one level – in municipalities (including self-governing cities and self-governing communities). Poland’s experience, in which local government units are established on all three levels of territorial division, might be useful to Armenia and Georgia, if they wish to further reform their territorial administration and pursue decentralisation. This Guidebook is comprised of four main parts. The first part is devoted to the presentation of the Polish experience in five selected areas: Empowerment of local communities Financing of local government units Providing public services Absorption of external funds by local governments Crisis responses The second part is dedicated to the presentation and analysis of needs and main blocking points in decentralisation in Armenia, while the third one concentrates on Georgia. Both of them are structured around the five above-listed areas. The last but very most important section of this Guidebook provides a set of recommendations for Armenia and Georgia based on the Polish experience in introducing local government and decentralisation. The country-specific sections of this Guidebook were prepared mainly on the basis of the results of desk research. This included reviewing the existing literature, relevant state strategies and action plans as well as reports developed by local and international organisations. Key legal acts were also reviewed. In addition, interviews with representatives of local municipalities and other stakeholders were carried out in Armenia and Georgia. This Guidebook was developed as part of the project called ‘Direction: an efficient state. Polish experiences of decentralisation and modernisation, lessons learned for Armenia and Georgia’ co-funded by the Ministry of Foreign Affairs of the Republic of Poland. It is the joint work of three partner institutions: CASE – Center for Social and Economic Research based in Warsaw, the Tbilisi-based Georgian Institute of Politics (GIP), and the Analytical Centre on Globalization and Regional Cooperation (ACGRC) from Yerevan.

Abstract:
At the end of January 2020, the Latvian government approved the country’s climate neutrality strategy until 2050, and in March it supported even more ambitious EU targets for reducing emissions. These declarations are connected with the need for a thorough transformation of the economy. The Latvian authorities combine these changes with the outlook for economic growth, including the development of the newest technologies in the energy sector. Latvia’s approach, subordinated to climate action, coincides with the policy of other countries in the region, but differs from the Polish vision of energy transformation.

Abstract:
The phenomenon of climate change, observed for years and constantly intensifying, has had a negative impact on health, significantly deteriorating the quality of life of people in many regions of the world, including Poland. Already now we are dealing with increasingly frequent extreme weather phenomena; hurricanes, storms and increasingly longer heat waves no longer surprise us. Unfortunately, this is merely the beginning of the negative effects of climate change. Others will come before long. In the coming years, many other new threats will be observed, such as flooding of ocean islands, desertification of areas exposed to water scarcity or serious loss of biodiversity, which will translate into food security. Unfortunately, it does not end there.1 The greenhouse effect is a process by which radiation from the Earth’s atmosphere warms the planet’s surface to a temperature above what it would be without this atmosphere. We can differentiate short-term solar radiation (0.15-4.0 nm) and long-term radiation. Thermal radiation escapes into the cosmic sphere and heat radiation returns to the ground, being stopped by a layer of GHG – greenhouse gases (CO2, CH4, N2O, SF6, water vapor etc.), which warm up Earth’s athmosphere to a dangerous level – even a 1°C degree increase (in comparison to pre-industrial level, when emissions stared to rise) in the average world temperature can be detrimental to human health and change the conditions of life on this planet (Figure 1). However, we currently face a risk of global warming even up to 3°C degrees, unless GHG emissions are significantly reduced. Any further rise of the global temperature will have deteriorating impact on people and whole humanity, as well as staying at the current level of emissions.

Abstract:
In its simplest form, privatization is de-statism – that is, removing the state as the owner of property and assets. From the outset of the transformation process in Poland, significant systemic limitations to the privatization process existed1. A developed market infrastructure was absent. Businesses that were being prepared for privatization lacked the ability to conduct market research, and advisory and consulting services were in short supply. Procedures and benchmarks for property valuation were almost non-existent. The financial infrastructure was immature and data on the profitability of firms being prepared for privatization was problematic. In addition, both the quality and level of competency of civil servants (the nomenklatura) and private managers remained low-largely due to the negative legacy of Poland’s communist past.

129. Public and Private Hate Speech in Poland

Abstract:
“W ords can be like tiny doses of arsenic: they are swallowed unnoticed, appear to have no effect, and then after a little time the toxic reaction sets in after all,” wrote Vic- tor Klemperer in his study of the language of the Third Reich (Klemperer 1946/2000: 15- 16). The importance of language for effective persuasion has been acknowledged by the teachers of rhetoric and orators since the age of antiquity. In modern times, there were both politicians who practiced deception through language for political or other gains, and also those who studied the effects of language-based manipulation. Among the most profound research on the mechanisms and effects of propaganda, one could name the writings of George Orwell, Friedrich Hayek, or Michał Głowiński. In this paper, we focus on one particularly disturbing aspect of propaganda: the use of hate speech. The reason for this choice of topic is the unprecedented explosion of populism all over the world, and the spread of perhaps its strongest weapon – hate through political and social fearmongering and use of what Klemperer referred to as ‘poisonous language’. Both political discourse in general and political propaganda in particular, tend to use a number of linguistic mechanisms in order to maximize the way they affect their target audiences and stir up hostility towards certain minorities. The most effective techniques, proven throughout history, include stereotyping for the purpose of singling out individu- als or groups as the proverbial “other” and, making that “other” out to be the scapegoat (cf. Stroińska 1998), as well as ad hominem attacks and redefining the meaning of certain keywords.

130. From a Common to a National State(s) and the Lithuanian-Polish Dispute

Abstract:
On the occasion of the 100th anniversary of the restoration of the independent states of Poland and Lithuania, we will return to a fundamental question, namely, whether the relationship between our contemporary states, which had already become hostile during the restoration process, is a time of missed opportunities? Or maybe the interests of both sides were simply so different that it was impossible for them to agree on a matter of major importance – state territory (partly also on the issue of national minorities) – and to balance their interests, thus avoiding conflict and a particularly hostile bilateral relationship which lasted until the tragic developments for both Poland and Lithuania in 1939-1940, when our countries fell victim to two tyrants. It is necessary to adopt new approaches to history. As time passes, new generations lose the memory of how events developed. Moreover, old beliefs, suspicions, and phobias are even revived. I would like to tell you a personal story in order to illustrate this point. At the end of December 1993, an annual convention of Lithuanian ambassadors was held in Vilnius. I had just flown in from Washington, D.C., and so I was reflecting on the attitude of the U.S. Administration and the conclusions that were arrived at after some friendly dis- cussions with the staff of the Polish Embassy in Washington D.C., and I shared my thoughts.
