211. Civil-Military Relations in Marcos' Philippines

Abstract:
After gaining its independence in 1946, the Philippines stood as a "showcase of democracy" in Southeast Asia. Both Spanish and American colonization had bequeathed to the islands Western values and institutions. The Americans had provided for the establishment of a democratic constitutional government. The Philippine press was widely considered one of the freest in Asia.[iii] Yet, on September 21, 1972, President Ferdinand E. Marcos issued Executive Order No. 1081, declaring a state of martial law throughout the nation.[iv] In the years following, Marcos' rule would be marked by harsh political repression, human rights violations, and a massive statewide kleptocracy. The Philippines' fall from grace left scholars scrambling to answer just how did a promising young democracy fall so quickly.

As this book was in its final stages of preparation, contributing author Professor Octavio Dinampo of Mindanao State University was taken hostage while he guided journalists to meet a leader of the Abu Sayyaf Group (ASG) in Sulu province in June 2008. Instead of considering him to be among the civilian hostages, security force officials cast suspicions over the possible culpability of Dinampo, a former member of the Moro National Liberation Front (MNLF) and now respected academic and peace advocate. He was released ten days late.

Abstract:
Since April of this year, I have had the honor of representing President Obama and the American people as Ambassador to the Republic of the Philippines, a major ally with whom the United States has an enduring partnership based on respect, shared values, and a desire for stability and prosperity. The Philippines is at a pivotal moment in its history. The election of Benigno S. “Noynoy” Aquino III, son of slain Senator Benigno “Ninoy” Aquino and his late widow, President Corazon C. Aquino, has brought fresh hope to the country for a better future, even in the face of enormous challenges. The United States strongly supports President Aquino's goals of peace, prosperity, and stability. To those ends, as Ambassador to the Philippines, my top priorities are raising awareness of the scourge of human trafficking in the Philippines, promoting business opportunity and investment, and deepening mutual understanding between the United States and my host country. I have also promoted investment in “green” sources of energy, not only to stimulate economic and job growth but also to protect the environment of this beautiful country and the world we share. My Embassy team and I are working vigorously to enhance our people-to-people ties through cultural and professional exchanges, the Peace Corps, and other programs that build mutual understanding so that we may expand our partnership in the spirit of mutual respect in the years ahead.

Abstract:
High-level US efforts to convince Burma's military government to open its political system to the democratic opposition and release political prisoners prior to scheduled 2010 elections accelerated this quarter. President Obama, Secretary of State Clinton, and Assistant Secretary of State Campbell all weighed in during meetings in Burma and at the first ASEAN-US summit in Singapore after the annual APEC leaders meeting. The ASEAN states welcomed the first US summit with all 10 members. Secretary General Surin Pitsuwan noted that President Obama's praise for ASEAN's key role in Asian international organizations debunked claims by some that ASEAN is no longer the centerpiece of the region's architecture. Singapore's prime minister insisted that the US continues to be Asia's “indispensable” player despite the rise of China and India. In the Philippines, the Visiting Forces Agreement continues to be a political football in domestic Philippine politics as President Arroyo's political opponents claim that the US military violates the Philippine constitution by engaging in combat – an allegation denied by both the US embassy and the Philippine government. On a tip from the US, Thai authorities detained a cargo aircraft coming from North Korea with a load of sophisticated weapons in violation of a UN Security Council Resolution.

Abstract:
In mid-May, long-simmering political tension in Thailand between the Bangkok elite establishment and urban lower classes as well as those in northern Thailand who feel ignored by the center erupted in the worst political violence in decades. Tentative US efforts to mediate were rejected by the Thai government, though the opposition appeared to welcome a US role. A tense calm has been restored, but the prospect for renewed violence is palpable. While the Indonesian government expressed understanding for President Obama's second postponement of a visit to his childhood home because of the disaster in the Gulf of Mexico, opposition Muslim politicians claimed the real reason for the postponement was the Israeli attack on a Turkish flotilla running Israel's Gaza blockade. A number of Muslim leaders stated that Obama wished to avoid encountering Indonesian ire for his country's pro-Israeli stand. The election of Benigno Aquino III as the Philippines' 15th president was greeted by international observers as a generally fair and transparent process. The president-elect has stated he plans to review the country's Visiting Forces Agreement with the US to modify its pro-US bias. Washington continues to criticize Burma's preparations for elections scheduled for October as marginalizing the political opposition. The US is also concerned that Burma may be clandestinely importing materials from North Korea for a nascent nuclear weapons program.

Abstract:
Contrary to the conventional wisdom, we argue that democratic institutions are not a prerequisite to an independent judiciary. Rather, the need for foreign investment is a necessary and, in some cases, perhaps sufficient condition for the establishment of at least nominally independent judicial institutions. We consider Chile immediately after Pinochet and the Philippines at the outset of the Marcos regime. We consider the similarity of court reforms implemented by these two regimes. These cases illustrate two distinct points in the life span of an authoritarian government. The Chilean case features the time period that begins a transition to democracy prior to consolidation. The Philippine case features the time period of ascension of the authoritarian. Despite the different environments, both regimes implemented court reforms primarily designed to attract foreign direct investment into their troubled economies.

Over the past several years, U.S. Government agencies have been revising their thinking on counterinsurgency and stability operations. Despite recent doctrine and guidance about better ways to end conflict and promote lasting peace, however, something has been missing from the dialogue: a successful model of reintegration and economic growth in an Islamic insurgency that has taken combatants off the battle field permanently. One of the best places to look for such a case study of fighting and winning "smart" is in Mindanao in the southern Philippines.

219. Striking the Right Balance: Economic Concentration and Local Government Performance in Indonesia and the Philippines

Abstract:
The relationship between economic concentration and governance remains controversial. While some studies find that high economic concentration strengthens collective action and reform cooperation, others stress dangers of rent-seeking and state capture. In this paper I argue that effects are neither strictly positive nor negative: they are best described as an inverted-u-shaped relationship, where better governance performance emerges with moderate economic concentration. Decentralization reforms in Indonesia and the Philippines Q unprecedented in scope and scale Q provide a unique opportunity to test this hypothesis. Subnational case studies and cross-sections, from both countries, indicate that moderately concentrated polities are accompanied by better service and lower corruption. The presence of Scontested oligarchiesT Q small circles of multi-sectoral interest groupsQ creates a situation where economic elites are strong enough to influence policymakers and, at the same time, diverse enough to keep each other in check. The results of this paper suggest that contested oligarchies compensate for weakly-developed societal and juridical forces and can become a stepping stone to good governance.

Abstract:
In 1946, the Philippines raised claims in the South China Sea over an area already known as Spratly Islands. This claim advanced through peculiar stages, starting when Thomas Cloma allegedly discovered islands in 1946, later named as Freedomland, and maturing to some extent in 1978 by the government\'s claim over the so-called Kalayaan Island Group. Considered as an oceanic expansion of its frontiers, this paper reviews the basis of the claim, first over the nature of Cloma\'s activities, and secondly over the measures the Philippine government took as a reaction of Cloma\'s claim of discovery of an area already known in western cartography as the Spratlys. Eventually, what is the nature of the link between the 1978 Kalayaan Islands Group\'s official claim and 1956 Cloma\'s private one?
