141. Mapping the U.S.-Canada Energy Relationship

Abstract:
he United States and Canada are each other’s largest energy trading partners as measured by the value of energy commodity trade, which in 2017 stood at U.S.$95 billion. The energy relationship between the two countries extends beyond just the trade of commodities, encompassing a variety of common, though not always identical, economic, security, and environmental priorities. In March 2018, the CSIS Energy and National Security Program undertook a project with the Embassy of Canada in the United States to create a physical map depicting the U.S.-Canada energy trade relationship. The following CSIS brief explains the various aspects of the energy trade relationship using this map, as well as highlights some of the important issues in the development of this partnership moving forward.

Abstract:
Section 337 of the Tariff Act of 1930 has been a powerful tool for protecting U.S. intellectual property (IP) rights and the U.S. market from unfair competition for nearly 100 years. The statute empowers the U.S. International Trade Commission (ITC) to ban imports of goods that inappropriately use U.S. intellectual property. Since it was last amended in 1988, however, new issues have emerged with the law and the Commission’s role in enforcing its provisions. As the economy modernizes and intellectual property enters the digital realm, we examine the ITC and its role in enforcing IP rights and suggest possible ways the ITC can modernize its operations to better confront the challenges of the twenty-first century.

Abstract:
The fundamental rules of conventional sovereignty are that states will refrain from intervening in the internal affairs of other states, are afforded the right to determine their own domestic authority structures and are freely able to decide what international agreements they choose to enter or not. In principle these concepts have been widely accepted, but are often violated in practice. While conventional sovereignty would appear favourable in theory, realistically, the domestic affairs and foreign policy decisions of states can and do have consequences for others. Poor governance in one state can produce regional instability, from uncontrolled migration across borders, uncontrolled arms trade and other illicit trafficking or the rise of militant nonstate actors. Economic, environmental and health policies of one state can affect the food, water, health and economic security of another. These transnational issues are increasingly complex because the world is more globalized than ever before. No state exists in a vacuum. Therefore, it is often within a state’s interest to influence the policy decisions of its neighbours. Pragmatism often trumps abstract theoretical ideals. The lead package of this issue examines the challenges of securing Canada’s sovereignty from modern threats. When discussing Canadian sovereignty the Arctic will invariably be mentioned, and indeed is the focus of fully half of this edition. David Bercuson, Andrea Charron and James Fergusson argue that the perceived threats to Canada’s sovereignty in the Arctic are overblown, resulting in alarmist rhetoric. Robert Hage, Rob Huebert and Petra Dolata, however, content that Canada must be vigilant if it does not wish to erode sovereign control of its Arctic territory. Going beyond the arctic circle, Hugh Segal and Heidi Tworek discuss the challenges of defending against hybrid threats and outline possible steps in response to such perils. From coordinating with our closest allies to no longer tolerate attacks against the integrity of our most valued institutions, to increasing transparency of activities and strengthen public trust in Canadian democracy via domestic measures. Finally, this package concludes on the issue of border control. Vanja Petricevic discusses the shortcomings of Canada’s current management of asylum seekers and how the concept of sovereignty is being adapted to address modern migration challenges. While Kyle Matthews asserts the importance of holding Canadian citizens responsible for their actions abroad because to do otherwise is not only dangerous, but an affront to Canadian ideals. Contemporary transnational challenges are complex and dynamic. The climate is changing, technology is enabling previously unimaginable feats, and global demographics and migration are creating new points of contention. If Canada is to navigate these issues, and defend its sovereignty, it must work closely with its international partners and ensure that it is capable and willing to stand on guard for thee.

145. Power and Crisis: Explaining Varieties of Commercial Banking Systems in Argentina, Brazil and Mexico

Abstract:
In the early 1980s Argentina, Brazil, and Mexico had commer- cial banking sectors that were dominated by local banks. The largest countries in Latin America were subjected to common international economic pressures during both the neoliberal 1980s and 1990s – includ- ing the expansion of capital markets in the periphery and integration into the regional trade agreements NAFTA and Mercosur – and the post- 1998 financial turmoil. By 2015, however, the three countries had con- solidated alternative commercial banking systems: domestic private group dominated (Brazil), mixed (i.e., ownership more evenly divided among public, private domestic, and foreign banks (Argentina), and foreign bank dominated (Mexico). The article traces these alternative outcomes to the power of prereform private financial groups, the viru- lence of “twin crises” in the transition from fixed to floating exchange rates, and the (contingent) role played by government ideology.

Canadian softwood lumber exports to the US have been a perennial trade irritant since at least the 1980s. But recently a “perfect storm” of factors, including a year of increased exports with the ending of the 2006 SLA (Softwood Lumber Agreement) restrictions in October 2015, the recent fall in the Canadian dollar and the unexpected election of the protectionist Donald Trump, all have conspired to make this fifth round of disputation, front-and-centre to the challenged US-Canada bilateral relationship.

Abstract:
On Jan. 23, the first Monday after being sworn in as president of the United States, Donald Trump signed a presidential memorandum that laid the groundwork for exiting the Trans-Pacific Partnership (TPP). The TPP was the elegant solution to a host of hold-over irritants from the North American Free Trade Agreement (NAFTA) as well as a way to address wholly new issues of trade and commerce. In the wake of this decision, Trump also promised a wholesale reworking of NAFTA, in which everything would be on the table. In the days since, the Trump trade team has been off to a rocky start. Finally, after months of discussion, the notification incumbent for use of the Trade Promotion Authority (TPA) was provided to Congressional leaders on May 18, 2017. Mexico has taken it all in stride, as it took almost immediate advantage of the blusterous U.S. rhetoric to outline its demands for any NAFTA discussion. Canada meanwhile plays the sphinx, open about its willingness to negotiate, but not much else. The U.S. may find that it’s less ready for this round of negotiations than it wanted to be, but its partners are well placed to unite and drive a hard bargain.

148. The Border/Perimeter Security Agenda in the Age of Trump: A Coping Strategy for Canada

The security perimeter agenda is buried, but it’s not dead. U.S. President Donald Trump’s attitudes toward trade, immigration and international institutions make it difficult to work with his administration and may get Canadians thinking about looking for new international partners. At least in the short run, however, Canada has no choice but to try to maintain its bilateral relationship with the U.S., and a crucial part of that relationship is the ongoing effort to make the border more secure and efficient. Significant progress has been made on some of the key policy co-ordination challenges – travel, shipping, border infrastructure and law enforcement co-operation – but there is still a lot of work to be done. Given the priorities and problems of the Trump administration, Canada’s best bet is probably to try to work around the White House on these issues, engaging with other players in the U.S., like bureaucratic agencies, members of Congress, and state and local governments. The focus should be on finding and supporting transgovernmental (state) and transnational (society) allies in the U.S., and Ottawa’s approach should be low key, patient, problem-solving and opportunistic. The most urgent concern is to anticipate and prevent policy changes in the U.S. that might disrupt existing arrangements, but Canadian officials should also continue to look for ways to improve bilateral co-operation on border/perimeter security issues.

149. After the TPP: What’s Next for Canada in Asia?

Abstract:
The Trump administration’s arrival has scrambled the cards in the trade policy world. Not only will the North American Free Trade Agreement (NAFTA) be reopened with uncertain results, but President Donald Trump has scuttled the Trans-Pacific Partnership (TPP) by announcing the United States’ withdrawal from the agreement. Canada, originally cool toward the TPP, pushed hard to be included in it. The TPP became the centrepiece of Canada’s Asia trade strategy, notwithstanding some public ambivalence on the part of the Trudeau government. With the TPP in its present form now in limbo, Canada still has options in Asia. First, it can keep an open mind with regard to the possible reconstitution of the TPP in another form, such as “TPP Minus One” (i.e., minus the U.S.). It should also push to reopen the bilateral negotiations with Japan that were suspended when that country joined the TPP negotiations. Canada is already exploring the possibility of an economic partnership agreement with China, perhaps on a sectoral basis, and simultaneously, it should actively pursue negotiation of a free trade agreement with the Association of Southeast Asian Nations (ASEAN) community. This could in time provide Canada access to the Regional Comprehensive Economic Partnership Agreement (RCEP) currently being negotiated among 16 countries in the Asia-Pacific region and would position Canada well in the eventuality that a Free Trade Area of Asia-Pacific (FTAAP) emerges. In the meantime, uncertainty regarding NAFTA’s future needs to be addressed. This uncertainty makes it more difficult for Canada to attract Asian investment but it also provides further impetus for Canada to diversify its trading relationships and to explore stronger relationships with Asian economies.

After President Trump withdrew the United States from the Trans-Pacific Partnership (TPP) trade agreement earlier this year, it seemed that NAFTA was next in his crosshairs. But soon President Trump is expected to take a measured approach to the issue of trade and step away—at least temporarily—from his threats to dismantle the North American Free Trade Agreement (NAFTA) by signing an executive order calling for a comprehensive study of US trade imbalances. The Trump worldview has consistently blamed foreign trade deficits, especially those with China, for job losses here at home. He has wanted to take down NAFTA to purportedly save American jobs, calling it “the single worst trade deal ever approved in this country.”Much like healthcare, trade networks are complicated, and not all agreements have the same goals. It’s instructive to take a closer look at both TPP and NAFTA, two very different trade agreements, to evaluate how a more protectionist stance might play out. Heavily promoted by the Obama administration, TPP would have allowed the United States to form a trade consortium with eleven Pacific Rim nations (representing 40 percent of the world’s GDP) to secure market access and protections for certain US industries. More than this, the political reason to join TPP was to provide a US-led counterweight to China’s growing dominance in the region’s economy.
