1. The effect of lawful crossing on unlawful crossing at the US southwest border

Abstract:
An increasing number of migrants attempt to cross the US Southwest border without obtaining a visa or any other prior authorization. 2.5 million migrants did so in 2023. In recent years, responding to this influx, US officials have expanded lawful channels for a limited number of these migrants to cross the border, but only at official ports of entry. These expanded lawful channels were intended to divert migrants away from crossing between ports of entry, by foot or across rivers, thereby reducing unlawful crossings. On the other hand, some have argued that expanding lawful entry would encourage more migrants to cross unlawfully. This study seeks to shed light on that debate by assessing the net effect of lawful channels on unlawful crossings. It considers almost 11 million migrants (men, women, and children) encountered at the border crossing the border without prior permission or authorization. Using statistical methods designed to distinguish causation from simple correlation, it finds that a policy of expanding lawful channels to cross the border by 10 percent in a given month causes a net reduction of about 3 percent in unlawful crossings several months later. Fluctuations in the constraints on lawful crossings can explain roughly 9 percent of the month-to-month variation in unlawful crossings. The data thus suggest that policies expanding access to lawful crossing can serve as a partial but substantial deterrent to unlawful crossing and that expanding access can serve as an important tool for more secure and regulated borders.

2. Impeding Access to Asylum: Title 42 “Expulsions” and Migrant Deaths in Southern Arizona

Abstract:
Immigration at the US-México border has drastically changed since the mid-2010s. Instead of adult undocumented Mexican men, generally migrating for economic purposes, there are now large numbers of men, women, unaccompanied minors, and families from diverse countries seeking asylum in the United States, as they are allowed to do under US and international law. In response to these changes, the US federal government leveraged multiple strategies to impede access to the country’s asylum system, including relying on Title 42 “expulsions.” Title 42, a COVID-19-era health measure, prevented migrants from initiating an asylum claim. Instead, asylum-seekers were typically immediately expelled to the closest port of entry in México. The use of public health as a pretext to control the border placed these migrants at risk and led many to attempt repeat border crossings. Given this policy context, we ask: what, if any, is the association between Title 42 expulsions and migrant deaths in southern Arizona? We address this question by drawing on records of recovered undocumented border crosser (UBC) remains investigated by the Pima County Office of the Medical Examiner (PCOME) in Tucson, Arizona. We examined differences in the number and demographic characteristics of UBC remains recovered between what prior studies have characterized as the “Localized Funnel Effect” Era of border enforcement in southern Arizona (i.e., October 1, 2013–March 19, 2020; N = 851), and the “Title 42” Era (i.e., March 20, 2021–September 30, 2023; N = 709). We also assessed how, if at all, the geography of recovered UBC remains shifted between these eras. We found that migrant deaths rose from an annual mean of 133 during the Localized Funnel Effect (LFE) Era to 198 in the Title 42 (T42) Era, representing a 48 percent increase. Compared to the earlier era, remains recovered during the T42 Era clustered closer to the border and near the cities of Nogales and Agua Prieta, Sonora, having shifted from west to east in southern Arizona. Additionally, we found that Title 42 disproportionately affected Mexican and Guatemalan nationals both in terms of expulsions as well as deaths. We propose several policy recommendations based on our study’s findings intended to reduce unnecessary suffering and increase human security: • The US federal government should not impede or limit migrants’ access to the asylum system. Policymakers should instead create clear pathways and procedures that obviate the need for migrants to undertake dangerous journeys and overcome barriers to fair consideration of their claims. • The US government must expand its ability to address these claims, as continued attempts to block asylum seekers will result in additional loss of life and increased violence. It should increase its capacity to screen asylum seekers at the US-México border. We propose an increase in USCIS Asylum Officers to carry out this duty. US Customs and Border Protection agents should not screen asylum seekers, nor should they assume the responsibility of serving as asylum officers, given the agency’s extensively documented record of persistently dehumanizing and mistreating migrants. • The US federal government must take measures to eliminate the backlog of asylum cases in the immigration courts. These measures need to include reforms in the underlying immigration system and in the removal adjudication system, such as greater access to legal counsel and changes to the law that offer legal pathways to imperiled migrants who do not meet the narrow definition of asylum. Absent these reforms, the asylum case backlog will grow, and many asylum seekers with strong claims to remain will be removed after living for years in the United States.

Ten years ago, in August 2014, the Islamic State began its genocidal campaign against the Yazidi community. In our cover article, Devorah Margolin and Gina Vale evaluate how the group’s gendered violence has manifested during and after its caliphate years. “Even without its caliphate,” they write, “the Islamic State’s gendered violence continues, as its supporters and ideology remain. Arguably, the lack of timely and appropriate responses has perpetuated this violence.” Our interview this month is with William Braniff, director of the Center for Prevention Programs and Partnerships at the Department of Homeland Security. In it, he describes his office’s efforts to utilize a public health-informed approach to preventing targeted violence and terrorism. Edward Lemon and Noah Tucker examine Central Asians’ prominent role in recent global terror plots and attacks. They argue that analysis should focus more on “the factors that led to mobilization to Syria and Iraq a decade ago and that have been exacerbated in recent years, especially in Tajikistan, including crackdowns on religion, corrupt ineffective governance, high levels of migration, and well-established terror networks that are holdovers from the peak of the Islamic State” as a way to understand this evolving threat area. When news reports appeared earlier this summer suggesting that the leader of the Islamic State in Somalia, Abdulqadir Mumin, may have quietly become the “worldwide leader” of the Islamic State last year and may have been killed in a recent U.S. airstrike, the news created far more questions than answers. Austin Doctor and Gina Ligon take a nuanced look at what the developments—if true—could mean for the group. Jessica Davis provides analysis of the Islamic State’s post-caliphate financial strategies. “The future of the Islamic State’s financial infrastructure,” she writes, “is networked, resilient, and adaptive.” This reality, she warns, portends “a grim future for efforts to combat the group’s international presence.” Finally, in June, the U.S. State Department designated the Nordic Resistance Movement, the largest neo-Nazi group in Sweden, as a Specially Designated Global Terrorist, only the second white nationalist organization on its terrorist list. Peter Smith outlines the development of the group and considers what the designation could mean for its future.

4. Visa Policy and International Student Migration: Evidence from the Student Partners Program in Canada

Abstract:
This paper examines how visa policy affects international student migration. Using administrative data on community colleges in Canada, we evaluate a reform that introduced a new visa stream - the Student Partners Program (SPP) - with shorter processing times and higher approval rates for student visa applicants able to demonstrate that they have the financial resources and language skills to succeed academically. Using a triple difference estimator, we find that SPP increased student migration from treated countries by 33% relative to what would have occurred without the reform. In line with our theoretical model, we further show that SPP had a large and positive effect on international enrollment only in countries where migration fraud was a major concern, and that higher enrollment was driven by an increase in both the approval rate and the volume of applications to study at treated institutions. We also leverage the SPP reform to investigate potential crowding-out effects. While we find no evidence that the enrollment of international students took place at the expense of domestic students, our results indicate that the recruitment of students from countries eligible to SPP had a crowding-in effect on noneligible foreign students.

5. Will DACA Recipients Return to Their Birth Countries If DACA Is Ended?

Abstract:
Will recipients of Deferred Action for Childhood Arrivals (DACA) leave the United States if a legal challenge succeeds in ending this important program? The fate of over 600,000 current DACA recipients may depend on answers to this question in one expert report and one online survey question, which a Texas District Court found to show “a quantifiable percentage” would leave. Had the District Court in its DACA ruling not credited these sources, Texas’ lawsuit could have collapsed, and DACA would persist. The issue of whether DACA recipients will leave if DACA is ended will matter as this case is litigated, most likely to be decided by the Supreme Court. Drawing on research on immigrant return, DACA recipients, survey questions, priming, and intention-behavior gap, this paper argues that this expert report and the single online survey question used by the District Court cannot support the inferences regarding the return of DACA recipients to their birth countries. Rather, relevant research points toward DACA recipients staying in the United States, even if DACA were terminated. The paper recommends offering DACA recipients and long term undocumented residents a short path to legal status and citizenship, reassessing whether these two sources can support the conclusions drawn by the District Court; and analyzing the benefits accruing from DACA to Texas and all Texans, including US citizen children of DACA recipients, in assessing the claimed injury to the state.

6. An Analysis of Trends in the US Undocumented Population Since 2011 and Estimates of the Undocumented Population for 2021

Abstract:
In 2021, the undocumented population residing in the United States (US) increased slightly to 10.3 million, compared to 10.2 million the previous year. The gradual decline or near-zero growth of this population has continued for more than a decade. However, the large increases in apprehensions at the southern border in recent years, along with continued legislative gridlock in Congress, could portend a new era of growth of this population. Unfortunately, the data needed to determine whether the population will enter a period of growth after 2021 — or whether the era of near-zero growth will continue — will not be available for at least a year or two. The most accurate demographic estimates of the undocumented population are derived from data collected in the US Census Bureau’s American Community Survey. Estimates of the size of the undocumented population in 2022 will not be available until early 2024. This report focuses on the most significant trend in the undocumented population in the past decade — the remarkable decline of 1.9 million in the undocumented population from Mexico from 2011 to 2021. The decline for Mexico in this period was 600,000 more than the total population increase from the seven countries (in order) with the fastest growing US undocumented populations: Guatemala, Honduras, India, Venezuela, El Salvador, Brazil, and China. This paper finds that: • The long-term decline, or near-zero growth, of the total undocumented population that began in 2008 continued in 2021. • The percent of undocumented residents in the total US population declined from 3.8 percent in 2011 to 3.1 percent in 2021. • The undocumented population from Mexico declined from 6.4 million in 2011 to 4.4 million in 2021, a drop of 1.9 million in 10 years. • A total of 2.9 million, or 47 percent, of the US undocumented population from Mexico in 2011 had left the undocumented population by 2021. • The drop in the undocumented population from Mexico from 2011 to 2021 occurred nationwide, and the decline affected the undocumented population in nearly every state. • The fastest growing undocumented populations by country in the last 10 years were from Guatemala, Honduras, India, El Salvador, Venezuela, and Brazil. The combined undocumented populations from these six countries grew by 1.2 million. • Countries that had declining populations after 2011 included Poland, Peru, Ecuador, Korea, and Philippines, in addition to the large drop for Mexico. • California had the largest decline in undocumented residents — 665,000 from 2011 to 2021. The undocumented population from Mexico living in California during this period declined by 720,000. • The combined undocumented population in California, New York, and Illinois fell by more than one million from 2021 to 2011.

7. Pathways for Labor Migration from Northern Central America: Five Difficult but Necessary Proposals

Abstract:
Very few labor-based pathways for regular migration are available for people in Northern Central America, often called the “Northern Triangle” of Guatemala, Honduras, and El Salvador. This paper briefly summarizes the state of labor-based migration channels in the region. It then argues that extending those channels is a necessary complement to asylum reform even for the goal of humanitarian protection. It concludes by arguing that five recommendations for long-term reform, though difficult, are needed to unleash the maximum shared benefit of these pathways.

Since 2015, hundreds of thousands of Central Americans—primarily from El Salvador, Guatemala, and Honduras—have left their home countries due to an intertwined set of factors, including poverty, food insecurity, gang-related violence, and human-rights violations. Many have taken perilous journeys to seek protection in neighboring Mexico and the United States, where the scale and diverse profiles of asylum seekers have challenged the governments’ processing capacity. For most of these Central Americans, traveling by their own means to Mexico or the United States is the only avenue to seek international protection. While refugee resettlement programs allow states to vet and select individuals who have fled their country and are living in another, resettlement has typically been used on a very limited basis in the region. Some policymakers, notably in the United States and Canada, have begun to reconsider the role that resettlement could play in addressing these protection needs. This brief assesses how resettlement and other humanitarian pathways have operated in the region to date, and explores the opportunities and obstacles to scaling up these programs.

Migration trends in the Americas recently have undergone a significant transformation. During the past few years, an increasing number of migrants and asylum seekers from different parts of the hemisphere—and other regions of the world, including Eastern Europe, Southeast Asia and the African continent—have been undertaking a very long and arduous journey to the United States. Migrant mobility has been facilitated by sophisticated smuggling networks (that operate often in tandem with other criminal organizations) and corrupt officials. The journey to the United States of economic migrants and asylum seekers from developing countries or countries at war is invariably perilous. At the same time, current migration trends and organized mass irregular migrations pose substantial homeland security risks. This paper proposes the dismantling of migrant smuggling networks through intelligence and targeted actions as important elements both of border security and enforcement and humanitarian migration management. In addition to these policies, the U.S. government should collaborate closely with other governments to cooperatively redesign asylum systems.

10. Child Maltreatment & Child Migration: Abuse Disclosures by Central American and Mexican Unaccompanied Migrant Children

Abstract:
While gang violence, community violence, and domestic violence have been recognized as contributing factors to Central American migration, less is known about the intersection between child maltreatment and migration. This article uses secondary data from United Nations High Commissioner for Refugees interviews with unaccompanied minors from Central America and Mexico to examine child maltreatment. It provides information on the abused children, their abusers, and the questions that led to their disclosure of maltreatment. It finds that girls reported maltreatment at higher rates than boys; only girls in this sample reported sexual abuse and intimate partner violence; and boys experienced physical abuse more than any other form of maltreatment. Overall, girls experienced all forms of abuse at higher rates than boys. Fewer than half of this sample described maltreatment as an explicit reason for migration, even those who viewed it as a type of suffering, harm, or danger. In addition, some disclosures suggest that childhood transitions, such as in housing, schooling, or work status, warrant further inquiry as a potential consequence of or contributor to maltreatment. The article recommends that professionals engaged with migrant children in social services, legal services, or migration protection and status adjudications should inquire about maltreatment, recognizing that children may reveal abuse in complex and indirect ways. Protection risks within the home or family environment may provide the grounds for US legal immigration protections, such as Special Immigrant Juvenile Status (SIJS) or asylum. Practitioners working with unaccompanied migrant children should use varied approaches to inquire about home country maltreatment experiences. Maltreatment may be part of the context of child migration, whether or not it is explicitly mentioned by children as a reason for migration.
