1. Survivor-Centred Justice for Gender-Based Violence in Complex Situations

The report Survivor-Centred Justice for Gender-Based Violence in Complex Situations is the result of new research conducted by IDLO, in partnership with the Global Women’s Institute at George Washington University, in six countries across the globe with the aim to identify approaches that centre survivors in all efforts to address gender-based violence (GBV) in complex situations. The report is informed by country case studies in Afghanistan, Honduras, Papua New Guinea, the Philippines, South Sudan, and Tunisia, to provide different perspectives of complexity in accessing justice and an analysis of diverse justice mechanisms dealing with GBV in situations of conflict, organized crime, climate disasters, and health emergencies, often intersecting with contexts of legal pluralism and political transition. Research findings show that, in order to be effective, measures and programmes aimed at ensuring access to justice for GBV survivors need to be responsive to women’s specific needs and vulnerabilities, as well as relevant to contextual challenges, while firmly anchored in international gender equality and human rights legal obligations.

2. Follow the Money: Few Federal Grants are Used to Fight Cybercrime

Like traditional crime, not all cybercrime rises to the level that requires a federal response. And like other crimes, victims will call upon state and local law enforcement to respond.1 They are unprepared. The 18,000 law enforcement agencies in the United States lack the tools, personnel, and resources to respond to cybercrime effectively. State and locals have turned to federal funding to fill these gaps, but federal government grants do not prioritize combatting cybercrime. The Justice Department (DOJ) has never identified cybercrime as an “Area of Emphasis” for their main criminal justice grant that awards state and local criminal justice agencies $400-$550 million annually.2 And while DOJ and the Department of Homeland Security (DHS) provided nearly $2 billion that state and local officials could use for cyber enforcement purposes in Fiscal Year (FY) 2019, data from DHS implies that very little is used for cybercrime. Only 2% of all DHS preparedness grant programs were used for all cybersecurity needs in FY 2019.3 Moreover, just three grants in FY 2019 were solely dedicated to cybercrime with a total budget of $12.7 million.4 As a result, only 45% of local law enforcement agencies have access to adequate digital evidence resources, according to one survey. This leads to a backlog of un-analyzed evidence needed to investigate cybercrime and a sense of futility about law enforcement’s ability to close cases.5 While Members of Congress have introduced several bills to create dedicated cybersecurity grant programs for state and local entities, these proposals tend to not include cyber enforcement needs as an eligible expense.6 Moving forward, Congress should: Call on DOJ and DHS to prioritize combatting cybercrime as a main law enforcement issue within their grants. Require prioritization of cyber enforcement needs in grant programs administered by DOJ and DHS in annual appropriations bills; and List cyber enforcement spending as an eligible expense in any bills creating new cybersecurity grant programs for state and local governments.

As countries across the world intensify their commitments to mitigating the worst effects of climate change, activists, scholars, and regular citizens are demanding more from this transition than the mere substitution of fossil fuels with low-carbon forms of energy. Increasingly, many call for an energy system that better distributes the benefits that energy provides and more fairly spreads the costs that its production and use creates. However, it is not only those seeking to right past inequities that call for a just transition: justice is a rhetorical device that opponents of the clean energy transition can use to slow its progress. This paper will engage with the conflicting roles that various actors’ sense of justice plays in Canada’s transition to a decarbonized economy. First, it will consider how opposition to Canada’s carbon price was fueled by a sentiment that it would unjustly destroy an industry that many Canadians depend on for employment. The following section explores how the strategic use of energy democracy, or the involvement of people in the decision-making and ownership of clean energy infrastructure, could build political will for the clean energy transition across Canada. This paper ultimately argues that by designing this transition so that it directly benefits as many Canadians as possible, and ensuring that every citizen understands those benefits, Canadian decision-makers can fortify climate policies to withstand false claims and perceptions of injustice.

In June this year, for the first time in our history, the Global Centre for the Responsibility to Protect published an “Atrocity Alert” for the United States. That alert was issued just nine days after an unarmed Black man, George Floyd, was choked to death by police in Minneapolis. Floyd’s death led to massive protests in more than 100 US cities and towns, and some rioting. As we wrote at the time: “While the murder of George Floyd in police custody does not constitute a mass atrocity crime, it has exposed deep divisions in US society. All law enforcement officials involved in the extrajudicial killing of civilians should be held legally accountable and punished to the full extent of the law. Crowd control measures deployed against peaceful protests must be consistent with international standards. The security forces must also strictly comply with the principles of necessity, proportionality, legality and precaution to help prevent any further deaths or serious injuries.” Now the United States faces an even greater challenge. The election on 3 November is expected to be one of the most divisive and dangerous in US history. Since March the United States has not only endured the largest COVID-19 death toll in the world, but also crushing unemployment levels and a disturbingly fractured political discourse. While the structural problems in US society – such as its history of racial violence and overly-militarized policing – pre-date the presidency of Donald Trump, he has exacerbated them. Trump’s attempt to cast doubt over the legitimacy of the impending election, combined with his unwillingness to commit to a peaceful transfer of power, poses a threat to American democracy. Many Americans believe that existential issues of race, identity and civil rights are also on the ballot.

5. From the Global to the Local: Leveraging International Engagement to Advance Justice at Home

Abstract:
This policy paper is authored by Maha Jweied, who served in the U.S. government between 2006-2018, most recently as the Acting Director of the U.S. Department of Justice’s Office for Access to Justice. Maha is currently a fellow at CIC-NYU and advisor to the Pathfinders for Justice. This paper sets out how the former U.S. Department of Justice’s Office for Access to Justice leveraged international activity and mechanisms, including the UN’s 2030 Agenda for Sustainable Development, to advance its domestic priorities. The strategy resulted in notable accomplishments and even protected a number of them after the office was closed in 2018. The brief also recommends that the incoming Biden-Harris Administration reestablish the Office for Access to Justice, revitalize the White House Legal Aid Interagency Roundtable charged with implementing Goal 16 for the United States, link U.S. domestic priorities to all 17 Sustainable Development Goals, and prioritize the United States’ role as a leader in the global movement for equal justice for all.

he U.S. justice system is under attack as part of a long-term Russian effort to undermine the appeal of democracy and weaken the West. Via multi-platform disinformation opera­tions, Kremlin-backed operatives work to exacerbate existent divisions within populations and increase overall mistrust and paranoia against democratic institutions. In the process, justice systems are portrayed as corrupt, inept, and hypocritical. This report describes the nature of this threat and proposes measures for countering it. The report focuses on activities by the Russian government, including the ways it feeds, is fed by, and amplifies domestic voices to weaken public confidence in the justice system. The insights gained by examining Russia’s efforts can and should inform our understand­ing of both threats from other nations and the challenges contemporary communications technologies pose to a healthy democracy generally.

10. Justice for the Victims: How Canada Should Manage Returning “Foreign Fighters”

The U.S.-led international coalition has dislodged the Islamic State in Iraq and Syria (ISIS) from the cities it had occupied and controlled, namely Mosul and Raqqa. But while the group is weakened, it lives on and remains dangerous. Both the U.S. Department of Defense and the UN estimate that approximately 30,000 ISIS fighters remain in those countries. At the same time, a significant number of “foreign fighters” have fled Iraq and Syria. Numerous countries are struggling to find policy solutions with regards to managing the return of their nationals who had joined the group. The Canadian government has stated publicly that it favors taking a comprehensive approach of reintegrating returnees back into society. Very few foreign fighters who have returned to Canada have been prosecuted. Canada has both a moral and legal duty to seek justice and uphold the most basic human rights of vulnerable populations. ISIS and other jihadist groups engaged in systematic mass atrocities against minorities in Iraq and Syria, including Christians and Shiites. ISIS has demonstrated a particular disdain for the Yazidi minority in Iraq, and the Canadian government has recognized the group’s crimes against the Yazidis as genocide. As a State Party to the Rome Statute of the International Criminal Court and a signatory of the Convention on the Prevention and Punishment of the Crime of Genocide, Canada has a responsibility to uphold these international legal conventions when formulating carefully crafted policy responses that deal with returning foreign fighters. Canada should attempt to prosecute its nationals in domestic courts using the Crimes Against Humanity and War Crimes Act. Open trials can serve as means by which to lay bare ISIS’ narrative and to help counter violent extremism and future atrocities. They can also serve as a deterrent and warning to other Canadians who might try to join ISIS as it mutates and moves to other countries in the world, such as Libya, Afghanistan, Egypt, the Philippines, Pakistan, or heaven forbid, in Mali where Canadian peacekeepers have recently been deployed. If Canada truly stands for multiculturalism, pluralism, the rule of law, global justice, human rights, and the liberal international order, then we must stand firm and take a principled stand to prosecute those who have fought under the ISIS banner. That includes our own citizens.
