171. Mexico Alert: Mexico State Election

Abstract:
On March 9, 2003, the citizens of Mexico state (Edomex) will elect 124 municipal government officials and 75 members of the state legislature. Although local contests, these elections have attracted national attention for several reasons. First, with 13 million inhabitants Edomex is the most populous of Mexico 31 states–with approximately 4.5 million more citizens than Mexico City. Second, Mexico state also boasts more than 8 million voters, the most of any state and 12.55 percent of the nationwide total. Third, Mexico state is a microcosm of the country–with (1) a vibrant manufacturing sector, (2) one-third of its income arising from agriculture, (3) a small indigenous population, (4) a plethora of middle-class residents who work for the government, own small businesses, or practice professions such as medicine, dentistry, accounting, and teaching, and (5) poor people who eke out a living in Chalco, Texcoco, and other sprawling slums contiguous to Mexico City. Fourth, Edomex is an arena of intense political activism, involving the country's three major parties: the once-hegemonic Institutional Revolutionary Party (PRI), the center-right National Action Party (PAN), and the nationalist-left Democratic Revolutionary Party (PRD). In addition, the Mexican Green Ecological Party (PVEM) boasts its largest support base in the state, while several new or small parties will also compete in the upcoming election. These include the centrist Convergencia, the leftist Workers' Party (PT), the right-wing Social Alliance (PAS), the conservative Party of the Nationalist Society (PSN), the reform-oriented México Posible (MP), the Mexican Liberal Party (PLM), Citizens' Force (FC), and the Citizens' Parliament (PC). Fifth, the importance of the state means that any major Edomex politician who distinguishes himself will wind up on the short list of contenders for the presidency in 2006. Finally, the outcome of the Mexico state balloting will provide an insight into the relative strength of contending parties as they prepare for the July 6 election of 500 members of the Chamber of Deputies and six governors (Campeche, Colima, Nuevo León, Querétaro, San Luis Potosí, and Sonora).

172. NAFTA Dispute Settlement Systems

Drawing on the 1989 Canada-US Free Trade Agreement (CUSFTA), the North American Free Trade Agreement (NAFTA) extended dispute settlement provisions to cover more ground. In fact, within NAFTA there are six dispute settlement systems. NAFTA Chapter 11 is designed to resolve investor-state disputes over property rights; Chapter 14 creates special provisions for handling disputes in the financial sector via the Chapter 20 dispute settlement process (DSP); Chapter 19 establishes a review mechanism to determine whether final antidumping (AD) and countervailing duty (CVD) decisions made in domestic tribunals are consistent with national laws; and Chapter 20 provides government-to-government consultation, at the ministerial level, to resolve high-level disputes. In addition, the NAFTA partners created interstate dispute mechanisms regarding domestic environmental and labor laws under the North American Agreement on Environmental Cooperation (NAAEC) and the North American Agreement on Labor Cooperation (NAAL C), respectively. This chapter examines the first four dispute settlement systems; the NAAEC and NAALC systems are evaluated elsewhere in this book.

173. The Gender Impact of Pension Reform in Latin America—and Broader Policy Implications

Abstract:
Over the past two decades multipillar pension systems that include both a public defined benefit (DB) and private defined contribution (DC) pillar have been adopted in many countries. Critics of these pension reforms argue that the tight link between payroll contributions and benefits in the DC pillar will produce lower pensions for women. In contrast, supporters of these reforms argue that multipillar systems remove distortions that favored men and permit a more targeted public pillar that will help women. To test these conflicting claims about multipillar reforms, and to analyze more generally the gender impact of alternative pension systems, this paper examines the differential impact on the two genders of the new and old systems in three Latin American countries—Chile, Argentina, and Mexico. On the basis of household survey data, we simulate the employment histories of representative men and women and the pensions that these are likely to generate under the new and old rules.

174. Determinants and Repercussions of the Composition of Capital Inflows

Abstract:
The Mexican, Asian, and Russian crises of the mid- and late 1990s have renewed the interest among policymakers in the determinants and effects of private capital flows. This paper analyzes whether policies can affect the composition of capital inflows and whether different compositions aggravate crises. We find that, while fundamentals matter, capital controls can affect the mix of capital inflows that countries receive. We find that during the Asian crisis countries with more Yen denominated debt faired worse, while during the Mexican crisis larger short-term debt stocks increased the severity of the crisis.

175. Economic Analysis in Environmental Reviews of Trade Agreements: Assessing the North American Experience

Abstract:
Beginning in the late 1990s, Canada and the United States began requiring "Environmental Reviews (ERs)" of all trade agreements to be negotiated by each government. This paper, commissioned by the North American Commission for Environmental Cooperation, outlines how ERs have evolved in North America, and evaluates the different methodological approaches that have been employed in ERs thus far. We show that the ERs conducted to date have an encouraging number of strengths that can be built upon. However, we also establish that the art of conducting ERs is still in its infancy. We identify four limitations with the methodological approaches that have been employed in the most recent ERs. Based on an analysis of these limitations, we propose four ways to improve how ERs are conducted in the future.

The paper deals with changes in the regulation and supervision of the Latin American financial sector in the aftermath of the 'Tequila Crisis' of 1994–95. While it finds that both have improved, regulation and supervision cannot resolve all problems; good macroeconomic policy and performance are essential complements. This is especially true because of the procyclical nature of financial activity. The paper presents both regional data for Latin America, contrasting it with other emerging markets, and four country case studies (Argentina, Brazil, Chile, and Mexico). The latter show how individual country characteristics and experiences affect the operation of the financial systems. We close with some policy recommendations.

An interesting aspect of the paper is the fact that it can use the randomization (one-third of the villages in the sample were randomized in the programme for evaluation purposes).

Abstract:
The global economic recovery is continuing but at a somewhat slower pace than was anticipated six months ago. Specifically, using the country weights from the IMF's World Economic Outlook, the forecast for real GDP growth in the world economy during 2002 (i.e., on a fourth-quarter-to-fourth-quarter basis) is cut by about half a percentage point to 3 percent—a pace that is slightly below my estimate of the potential growth rate for world GDP. This downward revision reflects primarily slower growth than earlier expected during the first half of 2002 in most industrial countries and the expectation that growth will remain somewhat more sluggish than earlier expected at least through year-end. For 2003, the forecast for global economic growth is also cut by about half a percentage point—to 4 percent—reflecting both general factors suggesting slightly weaker performance in many industrial and developing countries and the particular economic risks arising from possible military action against Iraq and from potential credit events affecting key developing countries. Despite these downward revisions, however, there is little doubt that the world economy will see significant improvement this year from the 1 percent growth recorded in 2001, and it is still reasonable to expect further improvement to a growth rate modestly above global potential during 2003.

179. Economic Issues Raised by Treatment of Takings Under NAFTA Chapter 11

Abstract:
This working paper examines, from an economic perspective, the treatment of takings (property rights) under NAFTA Chapter 11. To be more precise, the paper examines the treatment of takings as environmental groups fear might be established as the result of investor dispute settlement under this chapter; as of the date of this writing, most of the cases that have the potential to be precedent-setting have not been finally decided, albeit one—the Metalclad case—has been decided in a way that is unsettling to environmentalists. The author attempts to determine whether requiring public compensation of private investors for diminishment of value resulting from government regulatory action has the potential of achieving anything close to an “optimal” outcome from a societal cost-benefit point of view (defined below). This determination makes use of tools of economic analysis and, in particular, Coase's theorem regarding achieving optimal outcomes where negative externalities are present. The overall conclusion is that, although Coase's theorem can be invoked to argue that such an outcome can be achieved either via a “polluter pays” approach or a “public pays” (or “public must compensate”) approach, as a matter of practical application, the first approach is preferable to the second for a number of reasons, including government “fiscal illusion” and “moral hazard.”

Storm clouds signaling trouble with American trade policy have been gathering for some time. In the early 1990s, Congress barely approved creation of the North American Free Trade Agreement (NAFTA), and only strenuous efforts by the Clinton administration and the business community ensured passage of legislation creating the World Trade Organization (WTO). In the late 1990s, President Clinton twice failed to obtain congressional renewal of his trade-negotiating authority. The massive demonstrations during the meeting of the world's trade ministers in Seattle in 1999 reflected a widespread public unease with the impact of trade policy on a range of issues, from clear-cutting practices in the forests of Indonesia to the price of AIDS drugs in southern Africa. Today, public opinion polls consistently demonstrate that, although the American public supports freer trade in theory, it often has profound reservations about trade liberalization in practice. And the current global economic slowdown may only further polarize public opinion on trade issues.
