61. State of Legal and Social Support for Refugees and Displaced Foreign Nationals in Asia: Comparison of Five Asian Countries

Abstract:
The 2020 Myanmar military coup was a wake-up call for Asian countries regarding the refugee crisis. Although there are 1.1 million displaced citizens from Myanmar alone, many Asian countries do not have concrete policies in defining and protecting the rights of refugees and displaced foreign nationals. Jinkyung Baek, Director of the Research Department at East Asia Institute (EAI), and Ha Eun Yoon, Research Associate at EAI analyze the refugee situation, legislative policies, and government and civil society response in 5 Asian countries: Bangladesh, Indonesia, Thailand, Japan, and Korea. The authors then offer possible points of improvement on the current situation in Asia. They argue that Asian governments should create a refugee emergency response, share policy-making and implementing roles with local CSOs, and form a sort of Asian consortium for knowledge sharing and enhancing universally shared norms and rules.

Abstract:
Myanmar’s fight for democracy endures amid violent crackdowns inflicted by the military government. While the number of fatalities and casualties, especially those among the youth and children participating in the nationwide civil disobedience movement (CDM) continues to increase, democracies in the region have become increasingly alert towards the situation in Myanmar. Hun Joon Kim, professor at Korea University, and Sook Jong Lee, professor at Sungkyunkwan University and senior fellow at the East Asia Institute, state that while middle power democracies of India, Indonesia, Japan and South Korea have made significant moves against the military coup in support of Myanmar’s path towards democracy, they should coordinate among themselves to pursue more substantial ways of engagement. Civil societies of Asian middle power democracies have shown moral and financial support to the CDM in Myanmar and have manifested unusually high levels of empathy and support for the restoration of democracy in Myanmar. To sustain such support and facilitate change towards democratic transition remains a challenge – one that requires unequivocal support from Asian middle power democracies.

Abstract:
Amid the ongoing military rule in Myanmar, the public health crisis has been reaching new heights. According to Khine Win, founder and director of Sandhi Governance Institute, hopes were high among citizens in Myanmar for a healthcare system that could aptly combat the COVID-19 pandemic upon the election of the NLD in November 2020. However, progress has been reversed and is yet stalled under the elongated military rule. Despite dire civil health and poverty predictions issued by the UNDP, World Food Programme, and other international organizations, the military government turned a blind eye to their warnings, exacerbating the ongoing health crisis. COVID-19 cases have been increasing exponentially, with the number of actual COVID-19 cases expected to be higher than official numbers. News that military rule is expected to continue into 2023 paints a dull future for the public health situation in Myanmar.

Abstract:
The rapidly unfolding Myanmar crisis is presenting Southeast Asia with one of its most severe security and stability threats in the past three decades. While the region is certainly familiar with military coups and violent changes of government, the ongoing crisis in Myanmar carries risks far more acute than previous coups d’etat in the region. One of them is the risk to the sustained modus operandi of the region’s key institution—the Association of Southeast Asian Nations (ASEAN). The outcome of ASEAN’s involvement in the Myanmar crisis is consequential not only for the Myanmar people, but also for the association’s ability to credibly lead efforts to preserve peace and security in the region into the future. In this report, we assess the security situation in Myanmar, ASEAN’s collective response and the individual roles of key ASEAN member states in the mediating process. We focus on the effect that the Myanmar crisis has on the overall ASEAN political and security situation, and highlight Indonesia’s leadership, and limitations, in the process. We also detail the legal instruments and responsibility of ASEAN—in the form of the ASEAN Charter—to uphold the rule of law. The report concludes with some policy implications for the wider region, particularly Australia.

Abstract:
Conditions in the camps have changed significantly during the COVID-19 pandemic, and Rohingya refugees face intensified challenges. As outlined, the lack of sustainability regarding food and water distribution is acutely apparent. Without suitable rations or the ability to supplement rations, refugees cannot fulfil their nutritional needs. Through the new requirements which necessitate staying close to home or indoors for long periods, the existing housing has been exposed as being less than adequate. Appropriate healthcare is more critical, and other services, such as education, are needed to sustain young refugees’ wellbeing. As in all communities, reliable information is vital to lessen the impacts of rumours and misinformation, which cause fear. Finally, gender-based inequities are aggravated by the tenuous situation.Concerning the camps, the pandemic blatantly reveals that the camps urgently require a long-term political solution. Currently, Bangladesh does not issue exit visas to Rohingya refugees, and many refugees do not hold official refugee status. This means that they cannot leave Bangladesh to be resettled in a third country. At the same time, safe repatriation is not an option due to the ongoing coup d’état and the likelihood of continued persecution upon return. This impasse, heightened by the pandemic, demonstrates that the Rohingya communities in the camps need to be able to access more permanent solutions to their plight within-country or have the option to be resettled abroad.

66. Forging a Bay of Bengal Community is the Need of the Hour

The Bay of Bengal, the world’s largest Bay, is strategically located in the Indian Ocean. On its western rim, lies the coastline of the Indian Peninsula and to its south, the island nation of Sri Lanka. To the east the bay connects key parts of Southeast Asia including Myanmar, Indonesia, Thailand as well as the Andaman Sea and the Malacca straits. At its very northern cusp lies Bangladesh, which is also the delta of the great rivers of Ganges, Brahmaputra, and Meghna. These rivers connect the Bay in a unique “mountain to sea” ecosystem with natural connectivity to the Bay for the landlocked states of North Eastern India and the Himalayan nations of Nepal and Bhutan. In turn, the monsoon currents which regulate the climate of the Bay of Bengal gather moisture from the bay and dictate precipitation patterns in the mountains and plains in the hinterland. The hills of Meghalaya in North Eastern India record the highest rainfall in the world as they are first hit by the monsoon clouds that gather moisture from the Bay. An interlace of snow and rain fed rivers, their basins, and their estuaries at the Bay nurture a large diversity of aquatic and terrestrial wildlife flora and fauna (e.g., the Sunderban mangroves spanning parts of Myanmar, India and Bangladesh) and offer a great diversity of agricultural produce. The Bay and the countries along and connected by its littoral are a compact maritime sub region connected at the level of economy and ecology, having an enormous impact on the hundreds of its inhabitant who live on its coasts and in its hinterlands.

Abstract:
In this issue of BeeHive, Ariel Koch analyzes the Jihadist propaganda directed to the Muslim population of Myanmar, including the social media discourse. One of the less familiar arenas of jihad is Myanmar (formerly Burma), a country known for the ongoing conflict between the government-backed Buddhist majority and the Rohingya Muslim minority in the Rahkine state (formerly known as Arakan). This ethno-religious conflict has gained worldwide attention following massacres and forced deportations led by Myanmar’s army against the Rohingya. Recently, the army overthrew the elected government, raising concern about the Rohingya’s fate. This conflict has also been reflected in the discourse of various Islamist and Salafi-Jihadist organizations, which try to radicalize Myanmar’s Muslims, or encourage Muslims to defend their coreligionists.Al-Qaeda was the first to address the situation.
