Abstract:
When Israel reacted with military force to the Hamas and Hezbollah raids of June and July, world leaders recognized Israel's right to respond, but some charged it was using disproportionate force. International law supports both points. States may take defensive measures, but every use of force must be proportionate to the harm inflicted. These rules are found in the law regulating resort to force (jus ad bellum) and the law regulating the conduct of force (jus in bello). The most important rule in either category may w ell be the principle of proportionality. Respect for proportionality in the use of force can help foster stable, long-term peace.

The second phase of the Center for Strategic and International Studies' Transatlantic Dialogue on Terror took place against a backdrop of rapid change. When the first conference in this series took place in Berlin in the spring of 2005, scholars and practitioners were still absorbing the details of the previous year's attacks against the Madrid light rail system, the murder of Dutch artist Theo van Gogh and a host of other attacks and foiled plots. Global radicalism continued to be shaped by the deepening insurgency in Iraq, in which radical Islamists from inside and outside that country play a pivotal role. In the months following the Berlin meeting, the bombing of the London Underground, the attacks in Sharm el-Sheikh and Amman, and a stream of revelations about radical Islamist activity from Europe to the Middle East to South Asia and Australia — where a group of conspirators were arrested for plotting an attack against that country's sole nuclear facility — had also to be taken into account.

363. The Rise and Fall of the Bush Doctrine: the Impact on Transatlantic Relations

Abstract:
Between 2002 and 2005, a relatively coherent and profoundly renewed strategic approach to international relations was developed by the Bush administration. Premised on an optimistic assessment of great power relations (”a balance of power that favors freedom”), it emphasized the importance of promoting democracy as a way to solve many of the long-term political and security problems of the greater Middle East. It rested on the view that American military power and assertive diplomacy should be used to defeat tyrannies, challenge a pernicious status quo and coerce states into abandoning weapons of mass destruction and support for terrorism - without worrying too much about legitimacy or formal multilateralism. The Bush doctrine led to tensions with the Europeans, who for the most part shared neither the world view that underpinned it nor its optimism about possible results, especially as far as geopolitical stability, terrorism and weapons of mass destruction were concerned. Then, in 2005, two silent developments took place: the Bush administration, while insisting on staying the course rhetorically (through “transformational diplomacy”), reverted to classical realism in its actual diplomacy - largely for reasons of expediency. China and India, on the other hand, imposed themselves on the global agenda, bringing multipolarity back into the picture of the world to come. While generally closer to European views, the new American realist line remains distinct from the European insistence on strengthening the rules and institutions of global governance.

364. Iraq's Muqtada Al-Sadr: Spoiler or Stabiliser?

With stepped-up U.S.-led raids against Muqtada al-Sadr's militia, Jaysh al-Mahdi, and media allegations of the militia's responsibility for widespread and particularly horrendous sectarian killings in Baghdad on 9 July, the Shiite leader and his movement have become more central than ever. The war in Iraq radically reshuffled the country's political deck, bringing to the fore new actors and social forces, none more surprising and enigmatic, and few as critical to Iraq's stability, as Muqtada al-Sadr and the Sadrist movement he embodies. Largely unknown prior to the fall of Saddam Hussein's regime and bereft of resources Shiites typically must possess to assert their authority, Muqtada al-Sadr at first was dismissed as a marginal rabble-rouser, excluded from the political process and, after he flexed his muscles, decreed wanted “dead or alive” by the U.S.-led coalition. Learning the hard way, the U.S. and its allies have had to recognise the reality of the Sadrists' strength.

365. Iraqi Tribunal Imposes Death Sentence on Saddam Hussein

The Iraqi High Tribunal (IHT), or Iraqi Higher Criminal Court, previously known as the Iraqi Special Tribunal (IST), announced Nov. 5, 2006, that it was sentencing former Iraqi dictator Saddam Hussein Al-Majeed to death by hanging. The verdict comes in the first prosecution Saddam has faced before the tribunal, for the 1982 mass killing of villagers in the Shia town of Dujayl and related atrocities. Bringing Saddam and his henchmen to justice has posed unique challenges to an Iraq that seeks to make a former totalitarian dictatorship subject to rule of law, and in the process respect rule of law by providing fair trials. Unclear is the extent to which efforts to establish an historical record of atrocities, and undertake national healing, would be thwarted by executing Saddam before he can be tried for additional incidents. Of added significance are concerns raised by some voices that the death penalty itself is immoral and inconsistent with rule of law.

366. Cop Out - Why Afghanistan Has No Police

When rioting sparked by a fatal traffic accident involving the U.S. military suddenly broke out in Kabul in May, most in the city were taken by surprise. Less shocking was the response of the Afghan National Police (ANP) to the unrest. Rather than dispersing the mobs and restoring order, Kabul's cops were reported fleeing their posts and, in some cases, joining the looters. “The reaction of our police was really shameful,” acknowledged Jawed Ludin, chief of staff to President Hamid Karzai. Unfortunately, the sorry performance of the ANP was not an isolated event, but a reflection of a much bigger problem. Nearly five years since the ouster of the Taliban and more than three since the fall of Saddam, the Bush administration has repeatedly stumbled in its efforts to create effective foreign police forces. In marked contrast to the army-building efforts in Iraq and Afghanistan, which have begun to yield encouraging results, the indigenous police in both countries appear stuck in a transition to nowhere, slaughtered by insurgents and infiltrated by militias and warlords.

September 11 happened when Osama bin Laden looked at us and thought we were ready to be had. We were politically divided and squabbling over everything. We clearly were not prepared to take casualties in direct combat. The newly elected president seemed unable to make a tough decision. And so bin Laden attacked, expecting to deliver a decisive blow to our national will, expecting that we would turn tail and run as we had in Somalia and that he would then be free to concentrate his energies on the defeat of local apostates, the creation of his caliphate, and the organization of Muslim revenge for the catastrophes of past centuries. Within a few months he was driven out of Afghanistan, his organization was shattered, the Arab street he had hoped to mobilize was silenced by the shock and awe of the total victory of the Americans, and he became an instrument of forces greater than himself. If he still lives, he is the servant of the Shiite mullahs, making propaganda movies and audiotapes to bolster the morale of the constantly shrinking number of his admirers, while the mullahs order his followers to martyr themselves against Iraqi civilians.

Abstract:
Israel's summer war with Hizballah has again raised legal questions about the imprisonment of terrorists in Israel. From its founding, the state of Israel has been forced to confront belligerent activities by hostile states and organizations seeking to destroy it. The struggle against Palestinian terrorism has taken an enormous toll over the course of the second intifada, during which time more than one thousand Israelis have been killed and thousands more wounded. Enemy combatants are imprisoned in order to prevent them from causing further destruction. Therefore, terrorist detentions play a central role in the struggle to prevent terrorist activities, and the legal issues surrounding these detentions pose crucial concerns for the entire international community. There are two major processes for the prosecution of terrorist detainees in Israel: (1) through the normal civilian criminal track based on penal legislation, and (2) through special administrative measures under the minister of defense.

As part of the international effort to ensure that the cessation of hostilities between Lebanon and Israel can become a sustainable ceasefire, much attention has been paid to blocking arms shipments to Hizballah, as called for in UN Security Council Resolution 1701. But another threat to peace in the region is Hizballah's potent terrorist wing. Arguably its most dangerous offensive weapon, Hizballah's terrorist wing was active throughout this recent conflict.
