1. Iraq’s Quest for a Social Contract: An Approach to Promoting Social Cohesion and State Resilience

Abstract:
This study sets out to examine state-society relations in Iraq through the conceptual lens of the social contract and also provides a starting point for deriving potential areas of activity for external actors, such as German development cooperation (DC) and technical cooperation (TC). These players could provide support for the re-negotiation of this fraught mesh of relationships. This analysis is founded on a concept of the social contract in which the relationship between the government and those it governs is viewed primarily as a process of negotiation and can be operationalised, for instance, on the basis of the three Ps (participation, provision and protection). As such, the concept is informed both by contemporary approaches and by traditional reflections of French and Anglo-Saxon thinkers, who focus on the restriction of individual freedoms in return for the provision of legal certainty by the state. This study is divided into three sections. The first section explores weak statehood and the breakdown of society in the heuristic context of the social contract. The role of external actors in Iraq’s post-2003 development is then examined in the next section, which takes a closer look at the political system of proportional representation and its socio-political implications. Finally, the third section synthesises the first two by considering how external actors from the development cooperation sector might contribute to the peaceful negotiation of Iraq’s dysfunctional social contract. These reflections are made against the systemic backdrop of a rentier state with a hybrid form of governance and take account of the extremely fragile government-society relationship on the one hand, and external interventions, which have largely failed to date, on the other. In this context, the shortcomings of the largely dysfunctional Iraqi social contract become apparent and at the same time provide starting points for its improvement and renegotiation.

Grand flips the analytical script on the spate of notable publications covering “how democracies die.” Grand examines what happens when autocratic rule corrodes and what pushes it to ultimately crumble. Under what circumstances do kings and queens, emperors and caliphs, cease to rule — either because their throne is transformed into a more ceremonial post or because they lose power entirely? For the eight remaining Arab monarchs, the downfall of their former global peers offer critical insights and parallels. The issue brief examines these topics and provides strategies for managing challenges to power, as well as a series of lessons for Arab monarchs to consider.

With little to no prospect for accountability within Iran’s domestic courts, victims and survivors of serious violations of international law are turning toward an increasing number of foreign jurisdictions—most commonly in Europe and North America, but also in Latin America, Africa, and other regions—to pursue justice for human rights violations carried out by the Islamic Republic of Iran. Under the principle of universal jurisdiction, certain domestic justice systems allow prosecutions in national courts for crimes committed abroad, regardless of the victim’s or perpetrator’s nationality. Universal jurisdiction stems from the concept that certain crimes are of such gravity that they harm the international community as a whole, so national courts outside the country where the violations took place may prosecute them to protect the international order. Although the crimes subject to universal jurisdiction provisions differ by state, they generally include crimes against humanity, torture, war crimes, and genocide. Limitations on universal jurisdiction also vary between states, however, as do the processes for filing complaints and procedures for investigations, trials, and appeals. As was shown by the trial and conviction of Hamid Noury in Sweden for his involvement in the massacre of Iranian political prisoners in 1988, national prosecutions of international crimes can be a fruitful avenue to justice for victims of the Islamic Republic. To this end, the Atlantic Council’s Strategic Litigation Project has compiled a guide to aid practitioners and independent investigators in navigating the legal systems of European states with the highest likelihood of prosecuting Iranian human rights violators. Focusing on five states—France, Germany, the Netherlands, Sweden, and Switzerland—this manual outlines the crimes and violations subject to universal jurisdiction, best practices for investigating and documenting crimes, and processes for requesting investigations and participating in prosecutions as a victim, witness, or NGO. For information that is beyond the scope of this manual, the annex includes printed resources to consult and organizations to contact for additional assistance.

4. Shrinking Spaces in the Middle East and North Africa: Supporting Civil Society Resilience

Abstract:
Civil society organisations (CSOs) in the Middle East and North Africa (MENA) face mounting challenges, especially in authoritarian states, where they encounter closures, persecution and smear campaigns. Consequently, their crucial work in advancing human rights, good governance and inclusive human development is increasingly stifled and criminalised. Activists and professionals linked to CSOs also endure surveillance and persecution. This should worry European policymakers since a vibrant and free civil society in MENA is in their interest, as it is key for human development. This policy brief proposes seven ways for development cooperation to protect CSOs in authoritarian regimes in the MENA and beyond. European foreign and development policies in the MENA region have led to governmental partnerships that often sustain authoritarian regimes at the expense of citizens’ rights, for instance on migration (Francavilla, 2023; Grimm & Roll, 2023). Although substantial humanitarian aid reaches conflict zones, one of the root causes of the continuing political violence and conflicts – absence of accountable democratic governments – remains inadequately addressed (Barakat & Fakih, 2021). To avoid further empowering authoritarian rule in the region, European policymakers should reassess their multi- and bilateral governmental cooperation. The prevalent assumption amongst many policymakers that the incumbent authoritarian regimes in MENA can provide political stability needs to be discarded. The stability paradigm guiding European relations with the Arab World should instead be replaced with a do-no-harm approach. Although “do no harm” is a core principle of European development cooperation policy, it often is ignored in practice or trumped by other interests (Leininger, 2023). Development cooperation benefitting citizens must prioritise inclusive human development through cooperation with a wide range of actors, including elected state bodies, independent media and watchdog CSOs (Rutzen, 2015). This policy brief develops seven recommendations for European policymakers in development cooperation. The first step is to overcome the prevalent stability-through-cooperation paradigm to prevent further negative effects on human rights, democracy and civil society. Therefore, it is important that European policymakers recognise these authoritarian regimes’ unwillingness to implement reforms that would reduce their control over political institutions. Second, it remains crucial that policymakers acknowledge the increasingly shrinking space for critical voices in civil society. Third, governments and regional organisations should give CSOs a voice at international summits and in international organisations to increase the visibility of their demands and show support for oppressed voices. Fourth, European development cooperation professionals should establish flexible crisis funding lines for at-risk CSOs and their staff. Fifth, at-risk journalists, activists or human rights defenders (HRDs) need access to fast-track visa programmes to ensure they can continue their work from abroad when the authorities want to silence them. Sixth, European development cooperation profession-als should continue to support marginalised voices and groups and push for more inclusive governance. Lastly, European governments should limit arms exports to authoritarian regimes.

In a new Scowcroft Middle East Security Initiative issue brief, “The Minilateral Moment in the Middle East: An Opportunity for US Regional Policy,” the Atlantic Council’s nonresident senior fellow Jean-Loup Samaan analyzes how regional powers are reconsidering the multilateral balance of their foreign policy arrangements, and the emerging implications for US Middle East policy. Over the past three years, the Middle East has experienced major intra-regional changes. After a decade of fierce competition between two blocs—one led by Saudi Arabia and the United Arab Emirates (UAE) and the other by Qatar and Turkey—both parties now seem willing to cooperate. One of the key features of this new regional environment, according to Samaan, has been the growth of so-called minilateral initiatives that regroup several countries on an ad hoc basis. Samaan also addresses how powers outside the region have embarked on a similar path of building relationships with countries in the Middle East. Russia’s recent attempt to build a similar framework with Turkey and Iran, he argues, provides evidence of how minilateralism is increasingly considered an effective instrument of regional diplomacy.

Abstract:
COVID-19 was first reported in Wuhan, China, in December 2019 and spread rapidly across the globe. Then on March 11, 2020, the World Health Organization (WHO) declared the COVID-19 outbreak a pandemic, causing more than 600 million confirmed cases and 6.49 million deaths around the world so far. The effects of the pandemic on societies can be examined mainly by two criteria: 1) the number of lives lost due to the disease (Mortality Rate), and 2) the number of jobs lost due to social distancing rules (fall in GDP). Both have a wide consequence for economic growth and other key macroeconomic indicators. An important explanatory factor for the significant difference between Case Fatality Rate (CFR) for Iran and Korea can be related to the Worldwide Governance Indicators (WGI) components (Daliri and Asaadi 2021). The WGI is a composite index consisting of six measurement factors, including voice and accountability, political stability, government effectiveness, regulatory quality, the rule of law, and control of corruption. Furthermore, another critical factor is COVID-19 governance which can be monitored by calculating Government Stringency Index. This index is a composite measure based on several indicators which monitor the state of lockdowns and social distancing and range to values between 0-100, while 100 presents the most restrictive. In addition to the governance of COVID-19, from the perspective of public health and lives saved, maintaining jobs and supporting the resilience of industries to achieve SEG has been another important concern for nations and governments worldwide. As stated by Bernanke (2020), it is widely believed that the global economic crisis caused by COVID-19 is different from past crises in terms of cause, scope, and severity that suddenly disrupted economic activity. These necessitate research on the potential determination factors influencing the response of countries, companies, and individuals to the COVID-19 crisis. The key to ensure Business Continuity and SEG is to identify factors that increase the resilience of businesses under COVID-19 circumstances and other potential public health crises. Theoretical and empirical studies confirm that three main explanatory factors are at play: 1) macroeconomic structure and governance, 2) financial resilience of companies which is traced by available capital (i.e., the physical and human capital), and firms' adopted strategies and 3) digital evolution state and momentum and the adaptation of countries to technological innovations and Digital Intelligence, which is an indicator of transmission to KBE. By examining these components, it is possible to evaluate the structure and response of countries to the pandemic and post-COVID era. Thus, the report seeks to contribute to the literature on sustainable economic growth under crisis through a comparative study of Iranian industries with South Korea. The main research question here relates to the components of successful covid-19 governance from the perspective of SEG and business continuity within a KBE environment.

8. A stubborn threat: Islamic State in Iraq in early 2022

Abstract:
In the four years since its territorial defeat, Islamic State (IS) has proved to be resilient as it continues to mount attacks across Iraq. Analysis of IS activity from September 2021 to February 2022 (six months) shows that the geography, type and targets of IS attacks remained broadly similar to the year preceding this period. The volume of IS attacks increased but this mostly took the form of small-scale and local incidents. By and large, the group seems to be stable and shows neither decline nor growth. It operates nimbly and is mostly active in the arc between Sinjar and Baghdad. Counter-terrorism (CT) operations decreased in volume over the same period but are nevertheless keeping IS in check. However, as CT operations are mostly tactical affairs that remain inadequately coordinated and low on intelligence in some aspects, they have not been able to eliminate IS capacity to mount major operations, or to remove it from entire areas. Broadly speaking, IS attacks and CT operations are in a state of equilibrium. As Iraqi CT efforts emphasise security interventions over socio-political remedies, conditions for IS survival, as well as future revival, remain relatively favourable.

Diversity in the public sector that reflects the diversity of a national population is a moral, ethical, social, and legal obligation. However, not one of the target groups in Israel is appropriately represented in the civil service, and in some government ministries and auxiliary units these populations are not represented at all. Israel must change its approach and increase its enforcement of measures to achieve the required diversity, in order to enable equal opportunity for all.

Decades of Israeli–Palestinian hostilities, an occupation and internal political divisions have fuelled a complex protracted crisis in the occupied Palestinian Territories (oPT). With challenges in access to essential services (health care, education, energy and water supply, sanitation), employment opportunities, free movement and trade, almost half of the 5.2 million people living in oPT are in need of humanitarian assistance ( OCHA , 2020; European Commission, 2021). While half of the world’s population now lives in urban environments (UN DESA, 2019), in Palestine this figure rises to 76% (World Bank, 2021). This firmly grounds the humanitarian needs of the Palestinian people in an urban context. The case study explores the International Committee of the Red Cross (ICRC) Gaza Resilience Programme (GRP), an initiative that aims to build the resilience of systems and communities in Gaza. It highlights how the project has applied context appropriate approaches to the Gaza context and identifies the enabling factors and challenges in these approaches. Section 8 presents key takeaways from the case study.
