1. No Peace Without Justice in Afghanistan

Abstract:
Afghanistan’s presidential election took place on September 28, 2019, with less than 2 million people participating out of 9.7 million registered voters. Taking into consideration Afghanistan’s total population of 35 million, the turnout was a historic low—a problem further amplified by the fact that the government poured a huge amount of financial and human resources into election preparation. The main explanation for such low turnout is twofold. On the one hand, security threats such as suicide attacks or gun violence—which reached their peak during the presidential election campaigns—deterred many people from going to polling stations. On the other hand, Afghans have become wary about determining their own political fate because, for decades, regional and international powers have steered the political wheel in Afghanistan, rather the people. After four months, election results have still not been announced, leading to further speculation and anxiety among a population which has already been the victim of four decades of violent conflict in the country. This anxiety is further exacerbated by the ongoing “peace” negotiations with the Taliban. Afghan people have learned from experience that, even in the best-case scenario of the election results or peace negotiations, they cannot hope for new justice measures to heal their wounds. As demonstrated by the experience of Afghanistan and other countries, peace and security will not last without addressing the people’s demands for justice.

In this month’s feature article, Michael Knights assesses the future of Kata’ib Hezbollah (KH) and Iran’s other proxies in Iraq. He notes that in the wake of the death of KH’s founder and leader Abu Mahdi al-Muhandis in a U.S. airstrike on January 3, 2020, “KH is still the engine room of anti-U.S. attacks in Iraq but it is less politically agile and operates in a more hostile counterterrorism environment where deniability and secrecy have become more important again.” He assesses that the “the Islamic Revolutionary Guard Corps Quds Force is also leaning on a more diversified model in Iraq, drawing on non-KH factions like Saraya al-Jihad and Saraya al-Ashura, and engaging more directly with Iraq’s minorities, including Sunni communities and the Shi`a Kurdish Faylis and Turkmen. History may be repeating itself as Iran develops new smaller and more secure Iraqi cells that are reminiscent of the formation of Kata’ib Hezbollah itself.” Our interview is with Drew Endy, Associate Chair, Bioengineering, Stanford University, who has served on the U.S. National Science Advisory Board for Biosecurity. He argues the United States urgently needs a bio strategy to take advantage of rapid advances in biotechnology, protect against the growing danger posed by its potential malevolent use, and prevent the United States from permanently falling behind as a biopower. “First, we need to demonstrate operational mastery of cells by learning to build them. Second and third, we need to build and secure the bio net. And we have to do this now, within the decade, so that we can translate these advances as infrastructure undergirding a uniquely American bio economy that projects power while advancing life, liberty, pursuit of happiness. If we do this, then we have a chance of taking infectious disease off the table. If we don’t develop and implement a coherent bio strategy, it’s game over, not to be dramatic.” In early August 2020, fighters loyal to the Islamic State captured the town and port of Mocimboa da Praia in Mozambique’s northernmost province of Cabo Delgado. They have yet to be dislodged from the town. Tim Lister examines a jihadi insurgency in Mozambique that has grown in sophistication and reach. This month marks 20 years since al-Qa`ida’s attack on the USS Cole, which killed 17 American sailors. Lieutenant Colonel Pete Erickson, Seth Loertscher, First Lieutenant David C. Abstract:
Fatou Bensouda, the chief prosecutor of the International Criminal Court (ICC) at the Hague, has decided to indict senior Israeli policymakers and military officers for committing war crimes in the West Bank and Gaza. Her decision is baseless, preposterous, and discriminatory, and it violates the ICC’s own mission and rules. Bensouda’s action should be placed within the wider context of the Palestinian disinformation, delegitimization, and demonization campaign against Israel at international organizations. Israel should discredit and delegitimize the ICC in turn via aggressive political measures and collaboration with concerned liberal democracies, primarily the US.

6. Breaking the Cycle: Iraq following the military defeat of Islamic State

Abstract:
Despite the Iraqi Security Forces’ success in the military defeat of Islamic State (IS) and reconquering of territory seized by IS in 2014, the Iraqi state faces substantial challenges. These challenges have been exacerbated by IS, but did not emerge with IS and will therefore also not disappear with the defeat of IS. This DIIS Report underlines the fragmentation and policization of the security sector as a concern. Although the continued threat from IS has a destabilizing impact on the Iraqi state, the report especially points to the role of the Popular Mobilization Forces (PMF: an umbrella term for more than 50 armed groups that mobilized against IS in 2014), the sustained focus on identity politics and the pressure on the Iraqi state as key issues for the rebuilding and stabilization of Iraq. The presence of PMFs in Iraq is a challenge to the Iraqi state’s monopoly of violence and the PMFs continue to commit violations with impunity. Moreover, the PMFs (Popular Mobilization Forces) are capitalizing on their role in the defeat of Islamic State to increase their political role. Finally, despite the recent movement towards issue-based politics, identity remains a vital element in Iraqi politics, as seen in the continued practice of power-sharing between Kurds, Shias, and Sunnis. This combined with the Iraqi population’s general lack of trust in the political system challenges reconstruction. Nonetheless, the report asserts that there is a window of opportunity for Iraq, that should be seized by the Iraqi elite and the international community to engage in the difficult process of reconstruction and reconciliation. The report provides a brief overview of some of the main challenges facing Iraq that must be dealt with if Iraq is to break the cycle of violence that has haunted the country for decades.

Abstract:
As the Syrian regime regains territory, there have been growing calls in neighboring countries for refugees to go home. Yet refugees have conditions for a return—conditions that political efforts to resolve the Syrian conflict have largely ignored. To understand refugee attitudes toward return, the Carnegie Middle East Center listened to the concerns of Syrians—both male and female, young and old—struggling to build meaningful lives in Lebanon and Jordan. What is most striking is that despite the increasingly difficult challenges they face, a majority are unwilling to go back unless a political transition can assure their safety and security, access to justice, and right of return to areas of origin. Economic opportunity and adequate housing are important but not requirements. Above all, their attitudes make it clear that both a sustainable political settlement and a mass, voluntary return are contingent upon international peace processes that account for refugee voices.

The report “Local Recommendations for Access to Justice in Turkey” was developed under the project Enhancing Civic Participation and Confidence Building in the Judicial Reform Process and run in partnership with the Turkish Economic and Social Studies Foundation (TESEV) and Turkije Instituut, based in Leiden, Netherlands. The main objectives of the project are to identify, at a local level, the problems that prevent citizens in Turkey from accessing justice in judicial processes, to support local actors serving in the field of justice and law in turning identified problems into significant policy recommendations, and thus, to develop local recommendations for judicial reform.

Abstract:
Penitentiaries and penal policies have been one of the many areas subjected to changes in the context of the judicial reform taking place in Turkey over the last several years. Officials have been inspired to develop new policies in this field by a number of factors: the rise in the number of inmates and the resulting capacity problem; the inefficacy of outdated municipal prisons; and the need to support the resocialization of inmates through new penal policies. Efforts to increase the resocializing impact of the penal system in Turkey and the mentality transformation aiming at overcoming the historical baggage the penal system carries in Turkey are positive. However, these have not yet produced satisfactory results. This is why human rights violations in penitentiaries in Turkey are still continuing. This report argues that the general aim of the penal regime should be based on ‘resocialization’. Therefore, individuals after going through all stages of the penal process and after facing their crime, should be given the opportunity to fully participate in society again. With this perspective the report assesses the current penal reform process in Turkey and puts emphasis on the need for a holistic penal regime that focuses on resocialization of offenders in all penal stages and applies international human rights standards.
