21. Measuring Results and Monitoring Progress of Transitional Justice Processes

Abstract:
Transitional justice processes are complex, politically contested, and not necessarily linear. Because of this, they present unique theoretical and practical challenges for measuring results, which include challenges for gathering data, registering unintended outcomes, reporting progress, providing feedback to interventions, and extracting useful information to establish impact or counterfactuals. Based on a desk research and a series of discussions with practitioners, policymakers, and academics, this report considers the following: The different roles monitoring and evaluation systems can play and the questions they can answer at different stages of a transitional justice process. This report recommends conducting assessments early on to inform design and to build feedback loops into ongoing processes. Key features of transitional justice processes, including their complexity, their political nature, and the difficult contexts where they are usually implemented. Combining qualitative and quantitative methods and designing monitoring and evaluation approaches that allow for capturing rich contextual data and unexpected results. Power dynamics, exclusion, and language, particularly in fragile contexts and when dealing with vulnerable populations. Monitoring and evaluation approaches that are conflict sensitive, victim centered, and participatory. The Sustainable Development Agenda as a framework for measuring results of transitional justice. While a politically legitimate and useful conceptual framework, there is room for improvement as current indicators are not best suited to contexts where a large proportion of the population has experienced human right abuses. Overall, stakeholders in transitional justice should take a “user-centered” approach to measuring progress and results, one that puts the people that a process is meant to serve at the center. In doing so, they can focus on collecting what matters, establishing feedback loops, and learning from and continually improving their interventions.

22. Transitional Justice and Prevention: Summary Findings from Five Country Case Studies

Abstract:
This report summarizes the findings of an ICTJ research project exploring the role that transitional justice can play in preventing both massive and serious violations of human rights as well as violence and violent conflict more broadly. Its conclusions are drawn from case studies of five countries—Colombia, Morocco, Peru, the Philippines, and Sierra Leone—representing a range of complex contexts in which societies are grappling with violent conflicts, repressive governments, or acute inequality. It argues that transitional justice should be an integral element of conflict prevention, peacebuilding, and sustainable development. The report contends that transitional justice can contribute to prevention by: (1) addressing the exclusion and other harms that victims experience due to human rights violations they suffered; (2) addressing the exclusion and related injustices that communities and social groups face as a result of targeted violations and structural marginalization; (3) strengthening the rule of law and making it more inclusive; and (4) catalyzing the reform of institutions and laws that have perpetuated violence and discrimination as a means to exclude marginalized groups. The report also identifies a number of limitations to the preventive impact of transitional justice, including: (1) tensions that can exist between justice and prevention initiatives, especially in the short term; (2) justice processes that may be seen to be insufficiently participatory or even exclusionary themselves; (3) a lack of implementation of measures and reforms that are designed or recommended; and (4) contextual factors such political dynamics, security concerns, and the absence of broader structural change. The report concludes that applying a prevention lens to transitional justice does not fundamentally change how the field is understood, but it does have broad policy implications. First, fostering inclusion should be a primary objective of both the outcomes and the design of transitional justice mechanisms. Second, assessing the preventive role of transitional justice requires a long-term approach to inclusion and reform as these involve changes to social relationships, institutions, and structures. Third, prevention requires a society to confront both the root causes and consequences of injustice, and transitional justice processes can contribute greatly in this regard. However, they alone are not enough.

Abstract:
In the aftermath of Arab Spring, the Middle East (ME) by and large underwent various political upheavals. This change was palpable in some countries particularly where it resulted in a new political dispensation. However, in Kingdom of Saudi Arabia (KSA), the state opted to placate the antagonists by some economic concessions and social flexibility. Under the leadership of Muhammad bin Salman, the Crown Prince of KSA, the country is now following an approach of modernization which has two dimensions: first, moving towards social liberalization and secondly, initiating new sources of revenue and reducing dependence on oil revenue. Behind all initiatives, there is a long-term strategy to maintain loyalty of their people and enhance influence of KSA in the ME particularly. This article evaluates goals of Muhammad Bin Salman’s Vision or Saudi Vision 2030 and strategies which require substantial changes in social setup and developments to the Kingdom’s fiscal and budgetary measures and policies. This study reflects the political, religious, family and institutional challenges that can antagonize the Vision and its probability of accomplishment. While theorizing the study, it will be evaluated that a re-drawing of the ‘social contract’ in the Kingdom seems necessary. This means not only more effective strategic communication and consultation with the stakeholders, but also a greater focus on inclusive growth and social safety.

24. Band-aids, not bullets: EU policies and interventions in the Syrian and Iraqi civil wars

Abstract:
Engaging in the conflict cycle in other countries to gain outcomes favourable to one’s own interests is akin to playing in the champions league of foreign policy. Doing this effectively and responsibly requires a coherent and full-spectrum political strategy as well as the diplomatic, financial, developmental and military means to deliver it. It is clear from the scope of the security interests articulated in the European Union’s (EU) Global Strategy (2016) and its many associated foreign policy statements that the EU intends to meet these requirements. However, study of EU institutional policies and interventions in the Syrian and Iraqi civil wars highlights that it falls well short of doing so. As a result, EU institutions are not well placed to intervene effectively in high intensity conflicts with existential features such as these two civil wars. With this problem in mind, the core recommendation of the paper is to increase the effectiveness of EU interventions in high-intensity conflicts by institutionalising full-spectrum decision making, policy implementation and force deployment modalities for the EU as a whole, as well as for EU coalitions of the willing. The parallel existence of such tracks will enable the EU to act jointly in conflicts where Member States have more or less compatible foreign policy preferences with matching intensity preferences, and to act in part in conflicts where Member States have more or less compatible foreign policy preferences with a mixed distribution of intensity preferences (like Iraq or arguably Syria). EU foreign policy inaction, including institutional paralysis, will continue to occur where Member States’ foreign policy preferences are largely not compatible and have high-intensity preferences.

Abstract:
This Clingendael policy brief seeks to explain visible manifestations of Turkish politics in European cities. Why does Turkish politics lead to unrest in Rotterdam and Berlin and what institutional mechanisms facilitate this? The brief highlights various drivers, institutional manifestations and historical changes, but also points out that there are a number of uncertainties and questions about the motivations for, and modus operandi of, Turkey’s influence in European societies. These questions are all the more relevant as European policy-makers increasingly seek to take measures in order to curb this. The main argument developed in this brief is that effective policy ‘at home’ (in Europe) will require better knowledge of socio-political developments ‘abroad’ (in Turkey). The first and second parts of this brief, therefore, show how the drivers of Turkish influence on the diaspora have changed over time. The third section highlights how present-day diaspora politics is institutionally anchored in Western Europe. Most of the practical examples in this brief are drawn from the Dutch context, but the dynamics will be familiar to those observing this phenomenon in other Western European countries.

Abstract:
Winds of change are blowing in North Africa and the Middle East. They originate from Washington, where the new Biden administration is expected to abandon its predecessor’s zero-sum, erratic approach and take steps towards supporting regional balances and cooperation. Effects are visible especially in the Gulf, with the US pondering its options to re-activate nuclear diplomacy with Iran and Saudi Arabia and the United Arab Emirates grudgingly agreeing to put their feud with Qatar on ice. One way or another, these winds of change are working their way through the Levant, the Eastern Mediterranean and Libya. Admittedly, they are still feeble and can easily fade out like a morning breeze. Were that to happen, Europeans would be amongst the most affected – aside, of course, from regional populations themselves. It is now high time for the EU and its member states to leave the backseat they have (un)comfortably been sitting in for years, seize the opportunity of a cooperative US administration and work to play a more proactive role in North Africa and the Middle East commensurate with their considerable financial, diplomatic and military resources.

Abstract:
As the term 'civil society' nears the centennial of introduction to public debate, it is nigh time to reflect on the impact and challenges of the Civil Society Organizations (CSOs) in Jordan. Despite noteworthy progress accomplished in the societal and political spheres, there is a number of challenges for CSOs in the current environment. Several crossroads ahead of the more effective and efficient role of the CSOs hinder their future role. The pervasive challenge for CSOs throughout the years has been the delineation of their roles in civic space. Throughout the upturns and downfalls of the last century, the absence of a specific legal definition, by which the local community, governmental and non-governmental institutions and scholars work, the influence of CSOs necessarily remains limited. The lack of a clear definition particularly challenges the impact on political participation and democratization. Over decades, the gap between a false sense of power granted and the actual impactfulness of CSOs in Jordan grew. The crucial challenge seems to remain the regime's effort to install a system of social control over associational activities rendering them easily predictable. Hence civil organizations were encouraged in the appellation of "political liberalization." Jordan essentially introduced a defense mechanism against instability and economic/political crisis. Hardly exceptional case in the region with similar systems, particularly in Egypt and Morocco. Today, CSOs continue to face these challenges, seriously hindering their role in instituting political reform in Jordan. Unable to mobilize grassroots movements on a large scale and rally a broad constituency, many CSOs are closing towards the regime-made glass ceiling. The lack of a clear, unified registration body for CSOs keeps the opportunity for cronyism in finance distribution by the dispersion of the decision-making process. Additionally, for political-oriented CSOs, the diffusion of their efforts and complicated alliance-building hinders their effectiveness in challenging regime democratization. Still, the present conditions to CSOs' governance are but one of several challenges, most important of which is funding related [3]. Even within the stipulated government-granted boundaries, many CSOs face the challenge of attracting financial backing for various reasons, from the lack of "professionalism" for foreign investors to the very niche nature of their purpose and pervasive cronyism. This study aims to help CSOs to help them to adjust and enhance their internal governance and capacities in reaching out to their target communities and improve self-presentation. Therefore, this project is introducing evidence-based data to identify possible gaps and assist in developing necessary capacities. In this paper, we discuss the position of Jordanian CSOs, how their role in political participation and democratization is shaped, what challenges obscure their participation potential in political change and peaceful democratic transition, and the means for activating and better engaging CSOs in the decision-making process.

Abstract:
The institutional set-up of the Port of Beirut is emblematic of Lebanon’s post-war corruption and sectarian clientelism. Any investigation into the 4 August explosion needs to take into account the port’s dismal institutional record and how the current political class ensured its governance remained opaque and messy. This paper provides critical insights into the port’s set-up over the last 30 years highlighting the failing political system, a greedy political class, and entrenched mismanagement and corruption. It demonstrates how the bickering of key actors over the port’s control and the port’s institutional failures set the stage for the blast, pointing to an urgent need to build an accountable port authority as part of any reform effort.
