3521. Building a democratic Palestine: an Australian contribution to legal and institutional development in the Palestinian territories

Abstract:
The current fragile ceasefire between Palestinian militants and Israel has raised hopes of an end to four years of violence. To sustain that ceasefire both Israel and the Palestinian Authority must meet their respective commitments under the "Road Map for Middle bast Peace". For the PA this means preventing terrorist attacks against Israel and undertaking political, legal and security reforms. These reforms are also critical to meeting the Palestinian public's own demands for an end to lawlessness and corruption. Given Australia's expertise in legal and institutional development, the Australian government's commitment to promoting democracy and peace in the Middle bast and its sound relationship with both the PA and the government of Israel, Australia should lend what support it can to the Palestinian effort to establish strong foundations for a stable, prosperous and democratic Palestinian state.

Abstract:
Arafat may have suffered a lingering physical demise, but politically he has long been in decline. He lost much of his international credibility over his unwillingness to rein in Palestinian terrorism against Israel, and domestically his authority had gradually been eroded. While lacking an anointed heir, a succession plan is more or less in place. Political infighting is a possibility, though a desire for unity will probably prevail in the short term. But Arafat's successors will struggle to end the chaos and lawlessness into which the West Bank and the Gaza Strip have descended. Over the longer term Arafat's passing will remove the main obstacle to internal Palestinian reform. It has the potential to re-invigorate the peace process although it will not solve the fundamentals of the current impasse. It will also complicate Israeli Prime Minister Ariel Sharon's plans for a unilateral withdrawal from Gaza and parts of the West Bank, even if his instinct will be to press ahead.

3523. Explaining Middle Eastern Authoritarianism

Abstract:
Arab political regimes are both unusually undemocratic and unusually stable. A series of nested statistical models are reported to parse competing explanations. The democratic deficit is comprehensible in terms of lack of modernization, British colonial history, neighborhood effects, reliance on taxes for government finance, and the Arab population share. Interpretation of the last variable is problematic: It could point to some antidemocratic aspect of Arab culture (though this appears not to be supported by survey evidence), or it could be a proxy for some unobservable such as investment in institutions of internal repression that may not be culturally determined and instead reflect elite preferences. Hypotheses that did not receive robust support include the presence of oil rents, the status of women, conflict with Israel or other neighbors, or Islam. The odds on liberalizing transitions occurring are low but rising. In this respect the distinction between the interpretation of the Arab ethnic share as an intrinsic cultural marker and as a proxy for some unobservable is important-if the former is correct, then one would expect the likelihood of regime change to rise only gradually over time, whereas if it is the latter, the probabilities may exhibit much greater temporal variability.

Financial collapse usually triggers a flurry of market, academic, and policy innovation. The Latin American debt crisis of the 1980s produced the Brady Bonds and led to the rise of today's emerging markets. In the late 1990s, crises in Pakistan, Ecuador, and Ukraine helped teach the markets how to restructure international sovereign bonds. Crises in Mexico, Russia, Brazil, Turkey, and throughout East Asia raised doubts about the international system's ability to manage vast and rapid capital flows, and prompted a big-picture reassessment under the rubric “international financial architecture.” This included most famously the sovereign bankruptcy proposals discussed elsewhere in this volume.

Abstract:
In addition to abuse, or alleged abuse, by U.S. and allied forces against detainees in Iraq, allegations have surfaced of Iraqi-on-Iraqi abuse by Iraqi government agents, such as Iraqi police, against Iraqi prisoners. Such reports are especially troubling given that a primary rationale advanced for the U.S. and allied invasion of Iraq was humanitarian intervention: to overthrow a brutal dictatorship and attempt to replace it with a government founded upon principles of democracy, rule of law, and respect for human rights. Additionally troubling is the question of whether the U.S.-led alliance “bit off more than it could chew” by taking on such a daunting task, with detainee abuse by the alliance and the Iraqis perhaps exemplifying not only moral and legal challenges but also tests to the logistical limits of selecting, training, and holding accountable large numbers of personnel in such a monumental undertaking. The same poor planning and lack of capacity resulting in shortages of armor arguably could be said to be exemplified by the chaos at Abu Ghraib and apparent problems at staffing the Iraqi police forces fully with law-abiding professionals.

3526. Law Watch: Abu Ghraib Court Martial: "Ring Leader" Spc. Charles A. Graner, Jr., Sentenced to Ten Years

Abstract:
Spc. Charles A. Graner, Jr., on Jan. 14, 2005, became the fifth U.S. soldier convicted for Abu Ghraib prisoner abuse, all of them reservists. Graner, a prison guard in civilian life, was convicted at a general court martial for maltreatment of persons subject to his orders, conspiracy, assault, indecent acts and dereliction of duty. Unlike several earlier trials for Abu Ghraib prisoner abuse, this trial took place not in Iraq but at Fort Hood, Texas. The jury of 10 officers and enlisted men, all of whom had served in Iraq or Afghanistan, sentenced Graner on Jan. 15, 2004, to 10 years in prison (five less than the maximum possible) and to reduction in rank to private, dishonorable discharge and forfeiture of pay and allowances.

My fellow Americans, we are winning, and winning decisively, in Iraq and the Middle East. We defeated Saddam Hussein's army in just a few weeks. None of the disasters that many feared would follow our invasion occurred. Our troops did not have to fight door to door to take Baghdad. The Iraqi oil fields were not set on fire. There was no civil war between the Sunnis and the Shiites. There was no grave humanitarian crisis. Saddam Hussein was captured and is awaiting trial. His two murderous sons are dead. Most of the leading members of Saddam's regime have been captured or killed. After our easy military victory, we found ourselves inadequately prepared to defeat the terrorist insurgents, but now we are prevailing.

Abstract:
Is retreat from, withdrawal from, or defeat in Iraq inevitable? Almost all opponents of the Bush administration say it is. As Representative John Murtha (D-Pa.) put it in mid-November, when demanding the “immediate redeployment of U.S. troops” consistent with their safety, “The United States cannot accomplish anything further in Iraq militarily. It is time to bring the troops home.” This was echoed more recently by Democratic National Committee chairman Howard Dean: “The idea that we're going to win this war is an idea that, unfortunately, is just plain wrong.” Advocates of withdrawal point to continuing attacks on coalition and Iraqi targets and to the steady, somber flow of U.S. casualties, as well as the increasing fear that our army will break under the strain of prolonged occupation. Administration supporters of course share these concerns, and some seem (privately) to share the view that the war may be unwinnable. Even a few inside the administration may have their doubts. In any case, the administration clearly believes that it has to promise a significant reduction of U.S. forces in Iraq—“conditions permitting”—in 2006. Reports are circulating that preparations for troop reductions have already begun.

Berlin is far from Baghdad, and the Germans at least want to keep it that way. But for all the obvious differences, Germany's inconclusive election results and the impending constitutional referendum in Iraq point to some identical obstacles to effective and constitutional government. These obstacles are proportional representation and “cooperative federalism.” As it happens, well-meaning UN officials, NGOs, and U.S. advisers have been urging these constitutional arrangements upon numerous fledgling democracies, including Iraq. That may not be good advice.

3530. Beware the Arafat Model in Iraq

Iraqis gathered around television sets as midnight approached on August 22. They watched as constitutional-drafting committee members and political elites whispered among themselves. When the speaker of the national assembly, Hachim al-Hasani, declared, “We have received a draft of the constitution,” the assembly erupted in applause. “But,” he added, “there are some points that are still outstanding and need to be addressed in the next three days.” Late into the night, politicians and activists continued to meet in the Baghdad homes of the major powerbrokers, grappling with the roles of federalism and Islam in the new Iraq. While U.S. diplomats and Washington advisers continue to facilitate compromise among Iraq's disparate sectarian, ethnic, and political groups, the reality emerging outside Baghdad is directly challenging Iraq's aspirations to constitutionalism. The U.S. government has spent hundreds of thousands of dollars to bring outside experts to Baghdad for a period of a few days or a few weeks, but Iraqi powerbrokers dismiss their advice as naive or irrelevant. Massoud Barzani in the Kurdish north and Abdul Aziz al-Hakim and Muqtada al-Sadr in the Shiite south have rejected the experts' academic proposals, and have chosen instead a model perfected by Yasser Arafat, the late chairman of the Palestine Liberation Organization.
