1. The Caribbean in the Crossfire Between Covid-19, Narcotics, China, and Russia’s Invasion of Ukraine

Abstract:
The Caribbean is strategically vital as the southeast maritime approach to the United States. It is a key hub and transit area for commercial logistics serving the eastern coast of the United States as well as the Atlantic side of Central and South America. The region is connected to the United States through ties of commerce, geography, and family. Not only is the U.S. territory of Puerto Rico situated centrally in the Caribbean between the Dominican Republic and the Leeward Antilles islands, but significant diasporas of Cubans, Jamaicans, Dominicans, Haitians, and others are found in U.S. communities, from South Florida to New York and New Jersey and beyond. The United States relies on good governance in the Caribbean and partnership on a range of national security issues, including the entry of illegal narcotics (principally moving north from Colombia and Venezuela) and other contraband goods. Even more importantly, the Caribbean touches—or is proximate to—a substantial number of important U.S. ports and military facilities, such as Jacksonville, Florida; Savannah and Kings Bay, Georgia; Charleston, South Carolina; and Norfolk, Virginia. Not only are these facilities critical to U.S. international maritime commerce, but military facilities in some of those areas play important roles in the deployment and sustainment of forces in a range of potential conflicts, be they in Africa, Europe, or Asia. Indeed, during the wars of the previous century, German submarines sought to operate in or near the Caribbean in order to put U.S. facilities and ship convoys at risk.

5. The Limits of Material Benefits: Remittances and Pro-Americanism in Mexico

Abstract:
We explore how the reception of remittances affects perceptions of the bilateral relationship between Mexico and the United States. Scholars have claimed that the economic benefits of the relationship with the US prevail over imperialistic concerns as a result of the asymmetry of power between the two countries. Empirical research shows that Latin American public opinion is indeed more supportive of the US than theory indicates. However, we identify two gaps in this literature. First, scholars have explored the determinants of generic expressions of sentiment toward the US, overlooking more concrete instances of cooperation between the two countries. Second, scholars have focused on trade and investment and have ignored how the material gains of emigration shape attitudes toward the US. The present paper fills these two gaps by using novel survey data on the bilateral relationship between Mexico and the US. On one hand, we find that while the reception of remittances correlates positively with good sentiments toward the US, the recipients of remittances are consistently more opposed to cooperation with the US in the fight against drug trafficking. We argue that this finding can be explained by the different nature of the migratory phenomenon, and the connection between anti-drug trafficking policies and the close scrutiny of illegal flows of money and people.

Abstract:
This document is the result of a project developed by Dejusticia in cooperation with the Ministry of Justice and Law of Colombia and the British Embassy in Colombia, with funds from the United Kingdom through its embassy in Colombia. During 2016, two historic events were held to reflect about drug strategies in Colombia: the United Nations Special Session on the World Drug Problem (UNGASS 2016) and the signing of the Peace Agreement between the Government and the FARC-EP, which includes the agreement on the “Solution to the problem of illicit drugs”. In light of the commitments made by the Colombian State, there are challenges and possibilities for drug policy reform, particularly when hoping to achieve a better balance between a criminalization perspective and the recognition and guarantee of rights to populations affected by prohibition’s harmful effects.

Abstract:
Peace talks between the Colombian government and the Revolutionary Armed Forces of Colombia have created international expectations of an end to the longest internal armed conflict in Latin America. However, peace negotiations are facing crucial obstacles: agreements reached thus far are too general and need further detailed development; both parties are facing internal opposition; the social demand for transitional justice is widespread, but its implementation will be difficult; and, because of this, legitimising a peace agreement would require a protracted political effort, civic participation and a solid communication campaign explaining the terms of the agreement. The post-agreement phase would require the implementation of key public policies to close the rural-urban gap and cut the guerrilla-drug trafficking link; new and more efficient government agencies at the subnational level should be created to deliver public goods; military institutions should have greater civilian control and leadership to transform their role from internal security to that of national defence; and since the peace process has been gender blind, it will be crucial to increase women’s participation in the peacebuilding process. Arms decommissioning and arsenal destruction should have a blueprint, and social movements should oversee the enforcement of peace agreements and peacebuilding policies.

8. Addicted to Punishment: The Disporportionality of Drug Laws in Latin America

Abstract:
This document analyzes the proportionality of drug related crimes in seven Latin American countries through the study of the evolution of their criminal legislations from 1950 until 2012. The study suggests the existence of a regional tendency to maximize the use of criminal law for combating this type of conducts. Addicted to punishment is part of a series of studies carried out by the Research Consortium on Drugs and the Law (CEDD) that critically analyze the application of the proportionality principle in relation with drug crimes. The studies find that the punishments imposed and the punitive treatment of the offenders are disproportional, often generating more damages than benefits.

More than a decade ago, the U.S. Congress established a procedure whereby each year the president must “certify” that a given country is cooperating with us in the eradication of drug production and trafficking. Governments that lag behind, show little enthusiasm for our crusade, or are found colluding with narco-lords are subject to sanctions. Those “decertified” are denied foreign assistance, as well as U.S. votes for loans at the international financial institutions. Such countries–or, rather, our investors in their countries–also become ineligible for premiums from the Overseas Private Investment Corporation (OPIC).
