Abstract:
The European Union (E.U.) has served as an anchor of order and stability in Europe for decades and continues to play an important role in shaping its external environment through enlargement, or the process of expansion through the accession of new member states. However, the logic that informs contemporary E.U. enlargement policy has undergone a significant shift. This paper argues that this change is attributed to the desire by the E.U. to ensure internal security in the aftermath of the Yugoslav and Kosovo wars. E.U. internal security and enlargement policy, therefore, are inextricably linked. This has resulted in a variable and differentiated enlargement process, with the emergence of a Europe characterized by metaphorical concentric circles of fading political authority as one moves from the E.U. “core” into the European “periphery.

Abstract:
The monitoring of Iraqi media reveals that inflammatory coverage does not • necessarily consist of a direct call to violence, but instead takes the form of indirect or coded terminology that still has dangerous potential to foment conflict. Current regulatory and self-regulatory efforts designed to prevent media incitement to violence have, thus far, been insufficient. Lessons learned from post-conflict Bosnia, Kosovo and Sri Lanka can assist Iraqis in creating their own legal and self-regulatory mechanisms to limit inflammatory media coverage. There are a wide range of measures to mitigate inflammatory media coverage, including targeted training for media and government officials, broad support for a professional code of conduct, a full review of existing legislation relating to incitement, and the creation of a lexicon of inflammatory terms with guidelines for the proper use of these terms.

More than two years after declaring independence, Kosovo struggles with uneven rule of law and a weak justice system that is failing its citizens. The police, public prosecutors and courts are erratic performers, prone to political interference and abuse of office. Organised crime and corruption are widespread and growing. Realising that prosperity, relations with the European Union (EU) and affirmation as an independent state depend on the rule of law, the government has taken important steps, replacing key officials and passing long-delayed reforms. But critical weaknesses remain, notably in the courts, and the government, supported by the international community, must act swiftly to curtail them.

The Balkans face more trouble in Kosovo as well as Bosnia and Herzegovina unless the United States and European Union take dramatic steps to get both back on track towards EU membership. In Bosnia, the international community needs to reconstitute itself as well as support an effort to reform the country's constitution. In Kosovo, Pristina and Belgrade need to break through the barriers to direct communication and begin discussions on a wide range of issues. This brief proposes specific diplomatic measures to meet these needs.

Abstract:
On February 17, 2008 Kosovo, hitherto the internationally recognized territory of Serbia, unilaterally declared its independence. Three of the five permanent members of the UN Security Council (the USA, UK and France) immediately recognized the independence of Kosovo, while the other two, Russia and China, sharply criticized Kosovo's step and have thus far refused to recognize Kosovo as an independent state. In October 2008 the UN General Assembly requested the International Court of Justice (ICJ), upon the initiative of Serbia, to render an advisory opinion with regard to whether the unilateral declaration of independence adopted by the provisional institutions of Kosovo was in accordance with international law. In its non-binding advisory opinion, delivered on July 22, 2010 the Court stated that the unilateral declaration of independence of Kosovo did not violate international law. Nonetheless, this conclusion is not so clear and simple as it at first might seem, nor so “dangerous”, as it was described in the media and in some reactions, especially upon a closer reading of the entire text of the advisory opinion.

EULEX Kosovo is the flagship of EU civilian crisis management operations. It is the biggest and the most expensive operation ever conducted under the CSDP, employing almost 2,000 international experts and over 1,000 local staff members. All 27 EU member states agreed on sending the EULEX mission to Kosovo on 4 February 2008, only 13 days before the Kosovo independence declaration. Its mandate to assist and strengthen the Kosovo rule of law institutions has been extended until June 2012.

Throughout three issues of the Goettingen Journal of International Law we are trying and answering the same question: with the recognition of responsibility to protect, is humanitarian action at last guaranteed? Will this concept avoid some avoidable deaths and lack of rescue? Our first issue was devoted to the long quest for a legal regime in favor of humanitarian action effective delivery. After a step by step review of the many solutions which have been tried, the paper ended with the “discovery” of physical protection. After mentioning the Kosovo (and Serbia) air strikes and the 3rd millennium UN field missions, the paper ended with a worrying assessment: no device over the past 150 years has succeeded in guarantying neither assistance' provision nor protection. And we raised the issue of responsibility to protect (R to P) as a possible help to solution. Our today's paper goes down this way.

Abstract:
In July 2010 the International Court of Justice rendered its Advisory Opinion on the legality of Kosovo's declaration of independence and the Constitutional Court of Spain rendered an opinion concerning the autonomy of Catalonia. Two very different cases, from very different places, decided by very different courts. Nonetheless, they each provide insights on the issue of separatism in the midst of European integration. Does the Kosovo opinion open the door for other separatist groups? Does the process of European integration increase or undercut separatism? In addressing these questions, this article proceeds in three main parts. Part A briefly recaps the legal issues involved in the Kosovo Advisory Opinion. Part B discusses the relationship between self - determination and EU institutions and practices with a particular focus on Catalonia and the Basque country. Finally, part C assesses the seemingly contradictory impulses of separatism and European integration.

Abstract:
This article discusses the concept of the internationalized pouvoir constituant with regard to the ICJ's Advisory Opinion on Kosovo. It argues that independence and constitution - making under external influence in Kosovo represent two faces of the same internationalized constituent power aspiring for self - determination. It is submitted here that the ICJ‟s Opinion implicitly recognizes the constitutional law concept of pouvoir constituant and its relevance in international law. While the Court's reasoning is limited to the legality of the declaration of independence, international involvement in constitution - making in Kosovo equally raises questions of legality and legitimacy under international law. The paper discusses some of these questions by drawing from constitutional law and theory. In order to do so, the article briefly sets out the historical and political context, before describing how the two faces of the internationalized pouvoir constituant evolved during the period of international administration in Kosovo. In the next step, it analyzes the treatment of the constituent power in the ICJ‟s Advisory Opinion , and then attempts to assess the legality of international involvement in constitution - making in Kosovo. Finally, it discusses some potential standards of legitimacy for the internationalized pouvoir constituant.
