121. Kosovo Countdown: A Blueprint for Transition

Abstract:
Kosovo's transition to the status of conditional, or supervised, independence has been greatly complicated by Russia's firm support of Serbia's refusal to accept that it has lost its one-time province. Recognition of conditional independence has broad international, and certainly European Union (EU) and American, support. Under threat of Moscow's veto, the Security Council will not revoke its Resolution 1244 of 1999 that acknowledged Serbian sovereignty while setting up the UN Mission (UNMIK) to prepare Kosovo for self-government pending a political settlement on its future status. Nor will the Council be allowed to approve the plan for a conditionally independent Kosovo devised by the Secretary-General's special representative, Martti Ahtisaari, earlier this year and authorise the EU-led missions meant to implement that plan.

122. Serbia: Maintaining Peace in the Presevo Valley

Abstract:
Southern Serbia's Albanian-majority Presevo Valley is one of the rare conflict resolution success stories in the former Yugoslavia. Outwardly, it is increasingly normal, with no major incidents in over three years. Yet, tensions linger: massive unemployment is still the single largest problem but the shadow of Kosovo's future status darkens the political landscape. How Kosovo's final status is determined in the next months will have a profound impact. If formal partition or large-scale violence accompanies independence, the peace could unravel; in a worst case scenario, ethnic cleansing in southern Serbia would be accompanied by significant, cross-boundary, two-way refugee flows. All parties – local Albanian politicians, the Serbian government and the international community – need to work with greater urgency on developing the region's economy and ensuring that developments in Kosovo do not disrupt its peaceful progress.

The preferred strategy of the European Union (EU) and the U.S. to bring Kosovo to supervised independence through the United Nations Security Council has failed, following Russia's declared intention to veto. With Kosovo Albanians increasingly restive and likely soon to declare unilateral independence in the absence of a credible alternative, Europe risks a new bloody and destabilising conflict. To avoid chaos on its doorstep, the EU and its member states must now accept the primary responsibility for bringing Kosovo to supervised independence.

124. Serbia's New Government: Turning from Europe

Abstract:
Serbia finally has a new government but one that is deeply divided between pro-Western and nationalist forces. Facing two difficult issues–Kosovo status and cooperation with the International Criminal Tribunal for the former Yugoslavia (ICTY)–its choice is between moving towards European integration or on to a more isolationist path. The government's composition, deep mistrust among many of its members and the parliament's nationalist majority suggest it will follow the second option. Pro-Western forces have suffered a significant setback, the government is vulnerable to manipulation by the security services and oligarchs, and the system of divided responsibility for the security services renders unlikely serious cooperation with the ICTY, especially the arrests of Ratko Mladic and Radovan Karadzic. Although Kosovo independence could destabilise the government, it may surprise and last far longer and prove more stable than expected. The West should prepare for Serbia turning increasingly away from Europe and towards Moscow.

125. Kosovo: No Good Alternatives to the Ahtisaari Plan

The debate on Kosovo's future status has reached a crucial point. The United Nations Security Council (UNSC) has begun to consider elements of a draft resolution to determine the entity's future, which could be put to a vote in the coming weeks. The best way of ensuring regional peace and stability and lifting Kosovo out of an eight-year-long limbo, with a tired, temporary UN administration and an undeveloped, low-growth economy, is a resolution based squarely on the plan of UN Special Envoy Martti Ahtisaari. This would supersede UNSC Resolution 1244 (1999), define Kosovo's internal settlement and minority-protection mechanisms, mandate a new international presence and allow for supervised independence.

126. Kosovo: What Can Go Wrong?

At the end of the NATO/Yugoslavia war almost eight years ago, the Albanian-majority Serbian province of Kosovo was removed from Serbia's governance and placed temporarily under a United Nations protectorate, administered by the UN Mission in Kosovo (UNMIK). Last summer, UN Special Envoy Martti Ahtisaari was tasked by the Security Council with resolving the question of Kosovo's future status, with support from U.S. and European Union envoys (Frank Wisner and Stefan Lehne respectively). Ahtisaari's effort is now drawing to a close. He has delivered to both Pristina and Belgrade a plan that explicitly allows a great deal of protection for Serbs and their religious monuments in Kosovo but implicitly ends Belgrade's sovereignty. His plan opens the prospect of a sovereign and independent Kosovo under continuing international supervision. It is anticipated that Ahtisaari will take his plan, with some revisions, to the UN Security Council this month. This USIPeace Briefing discusses potential drivers of conflict in Kosovo during the status decision and in the period thereafter. These drivers of conflict arise from the international community, the Kosovo Albanians, Serbia and the Kosovo Serbs. They have the potential not only to make Kosovo dysfunctional but also to destabilize the region.

128. Kosovo: Breaking the Deadlock

Kosovo was left at the end of the NATO/Yugoslavia war in 1999 in limbo. It is still there, despite Security Council Resolution 1244, which foresaw a process for deciding its status. That process has occurred, but because of a threatened Russian veto, the Security Council failed to approve the plan prepared under the leadership of former Finnish President Marti Ahtisaari, which provides for Kosovo's independence under international supervision with extensive protection for its Serb population. The UN Secretary General invited the Contact Group—France, Germany, Italy, Russia, the UK and the U.S.—to pursue further, direct negotiations between Pristina and Belgrade, but with little prospect of movement on either side. Belgrade continues to insist on maintenance of its sovereignty over Kosovo, and Pristina continues to insist on independence. On December 10, the Contact Group will report to the UN Secretary General, who in turn will report to the Security Council (UNSC). A small group of experts with long Balkans experience met at USIP September 5 to discuss the situation and suggest ways forward. Others (consulted electronically) join in associating their names with this paper. Listed at the end, all believe that Kosovo's independence must happen without further delay, in order to prevent regional instability. Consideration of the reasons that can justify behaviour resulting in the elimination of human life is as philosophical and ethical as it is political and legal. In the context of exponential increases in the destructiveness of war, particularly with the proliferation of weapons of mass destruction, such consideration assumes an even greater significance.

For international actors seeking to consolidate peace and democracy in disrupted states, the importance of establishing the rule of law is well-recognised. Yet this goal has proven frustratingly elusive. In the hostile intervention environment of the post-conflict disrupted state, international actors in the UN system and elsewhere have struggled to build legitimate state structures to redress disputes peacefully. They have found it even more challenging to instil principles of governance that promote accountability to the law, protect against abuse and generate trust in the state. This brief examines the difficulties faced by UN peace operations in attempting to build the rule of law, with reference to UN transitional administrations in Cambodia, Kosovo and East Timor.
