111. Reconstructing Gaza – Lessons from Lebanon

Abstract:
Last week's international donor conference to address the question of humanitarian assistance to Gaza underscores the myriad challenges confronting the process. Namely, how should the international community respond to the complex issues surrounding assistance in post-conflict recovery and reconstruction, particularly when several key donors reject any contact with Hamas, the governing authority on the ground? By any estimation, the Gaza reconstruction process will face several perplexing issues: How can billions of US dollars be effectively, transparently and accountably dispersed in a coordinated way, when several key donors and the Government of Israel reject any moves that will bolster the fortunes of Hamas, who m they classify as a terrorist organisation? What impact will an emerging Palestinian National Unity Government have on the mechanisms for overcoming many donors' reluctance to deal directly with Hamas? What opportunities and challenges does the reconstruction of Gaza pose for a rapprochement between Hamas and Fatah? Who will lead the reconstruction process and how will meaningful activity take place in the face of severe restrictions on access and movement? With Hamas in power in Gaza and Israel ref using to consider opening their common borders until kidnapped Israeli Defence Forces Corporal Gilad Shalit is released by Hamas, how is meaningful recovery and reconstruction even possible? In the absence of a credible political process, what use is reconstruction anyway if it merely returns the population of Gaza to their pre-conflict socio-economic imperilment? Lebanon faced a similar situation following the 2006 war between Hezbollah and Israel.

Abstract:
Since the Middle East peace conferences in Madrid (1991) and Washington (1991–1993), Europeans have gradually stepped up their political involvement in the Middle East. While Europeans have had strong trade and cultural relations with their neighboring region for decades, they have, in parallel with the Middle East peace process and the development of European Union (EU) foreign policy instruments, moved to assert their political interests more forcefully. These policies have largely been motivated by geographic proximity and geopolitical considerations—chiefly, the fear of security threats emanating from Europe's neighborhood (a spillover of conflict in the form of terrorism, organized crime, migration, and the proliferation of weapons of mass destruction), Israel's security, and access to energy resources. The implicit assumption has been that these different European interests can best be reconciled in an environment where there is peace between Israel and its neighbors (and therefore no contradiction between good relations between the EU and Israel and good relations between the EU and the wider, resource-rich region) and where the people of the Mediterranean and the Middle East find decent living conditions in their countries. As a consequence, Europeans have first focused their efforts on the realization of a two-state solution to the Israeli–Palestinian confl ict, which they consider to be the core of the region's instability. They have, second, aimed at supporting comprehensive peace between Israel and its neighbors. And they have, third, sought to provide an environment conducive to peace in the region as well as to deflect what were (and still are) perceived as security risks emanating from the region.

With its army and its diplomatic posture, the American administration is now deeply part of the Middle East. Many of the problems of the region have been clearly aggravated, and in some cases sparked, by American policy, though many of them are a joint venture between Arabs and is, between Tirrks and Iranians, and between Europeans of different nationalities. But because the United States is such a decisive player in the Middle East, it has inordinate power to affect things in the region for good or for bad.

Therefore, it is uncertain whether the United States will succeed at arranging a trilateral summit involving President Barack Obama, President Abbas, and Israeli prime minister Binyamin Netanyahu at the UN next week that would culminate in the announcement of a formal relaunching of peace negotiations.

117. Iran: Is Productive Engagement Possible?

Abstract:
Although Tehran and Washington appear hopelessly divided, issues of broad mutual concern reveal important overlapping interests. The United States can more effectively support democracy and human rights in Iran with policies that facilitate, rather than impede, Iran's modernization and reintegration in the global economy. The next U.S. president should not immediately seek comprehensive engagement with Tehran, as this might enhance Mahmoud Ahmadinejad's chances of reelection in Iran's June 2009 presidential elections. The United States must deal with those who hold power in Tehran, namely Supreme Leader Ayatollah Ali Khamenei. Given the widespread mutual mistrust between Washington and Tehran, confidence should be built with negotiations on areas of common interest, such as Iraq and Afghanistan, rather than those of little or no common interest, such as the Palestinian–Israeli conflict or the nuclear issue. When it comes to U.S.–Iranian interaction, the record shows that “secret” or “private” discussions out of public earshot have a greater success rate. Building confidence in the public realm will be difficult, as politicians on both sides will likely feel the need to use harsh rhetoric to maintain appearances. It is imperative that Washington maintain a multilateral approach toward Iran, especially regarding the nuclear issue. Tehran is highly adept at exploiting rifts in the international community and diplomatic efforts to check Iran's nuclear ambitions will unravel if key countries approach Iran with divergent redlines. Powerful spoilers—both within Iran and among Iran's Arab allies—have entrenched economic and political interests in preventing U.S.–Iranian reconciliation.

Abstract:
In response to criticisms that its military attacks on Gaza following Hamas Qassam rocket strikes in Sederot were causing unnecessary civilian casualties, Israel's Ministry of Foreign Affairs (MFA) released a background paper in March, excerpted below, to clarify and justify the Israel Defense Forces' (IDF) understanding of the principle of proportionality. This principle, along with the principle of intentionality, forms the jurisprudence of International Humanitarian Law. Citing a number of international legal scholars and Article 52(2) of the Additional Protocol I of the Geneva Conventions (1977), to which Israel is a signatory, the background paper attempts to redefine proportionality in order to legitimate attacks on targets that are not strictly military, placing the blame for any civilian deaths on Hamas for using civilians as "human shields." Although the IDF and the MFA have advanced this argument in response to international criticism about IDF strikes causing civilian deaths in Lebanon and the occupied Palestinian territories, this background paper represents an attempt to subordinate the need to cause as little harm to civilians as possible to Israel's stated need to preempt future attacks. 120. The Williamsburg Conference

Abstract:
Coming in the midst of a very heated U.S. presidential election campaign, where the U.S. is faced with numerous foreign policy challenges in the Asia-Pacific region and at a critical juncture in Islam's relationship with the rest of the world, the Asia Society convened over 50 Asian and American leaders at a very opportune time in Bali, Indonesia from April 3-6, 2008. Delegates discussed the characteristics of Islam in Asian countries with multiethnic or multireligious populations like India, Indonesia, Malaysia, and the Philippines. They also suggested ways of tackling radicalism and extremism by alleviating poverty, improving education, and reforming prisons and rehabilitation Centres, to name a few. During the second half of the conference, delegates engaged in a conversation about the evolving U.S. role in Asia. Contemporary affairs like the protests in Myanmar and Tibet, engagement with North Korea, and the impact of the Iraq war on U.S. foreign policy towards Asia were analyzed in light of the coming presidential election. Asian leaders were invited to give advice to the new U.S. president. Finally, young leaders from the Asia Pacific region shared their thoughts on what kinds of leadership and values are needed in the future.
