Abstract:
The present collection of short papers is an experimental, explorative and introspective German Institute of Development and Sustainability (IDOS) project on international and transnational cooperation for development and sustainability. It is the product of internal brainstorming discussions at IDOS in mid-2022 that aspired to conduct a preliminary, exemplary mapping of the use of “transnational lenses” and their understandings across various work strands at the institute. This might lead to new questions in our work, or it might simply be an attempt to look at our topics of interest with a different perspective.

Abstract:
Günümüzde mali suçların önlenmesi ve tespit edilmesi, ülkelerin en önemli konularının başında yer almaktadır. Bu konu aynı zamanda mali istihbarat birimlerinin de temel mücadele mekanizmasını oluşturmaktadır. Mali suçların doğası gereği sınıraşan nitelikte olması beraberinde bu suçlarla mücadele açısından bir takım zorluklar ortaya çıkarmaktadır. Bu zorluklardan bir tanesi mali suçların ekonomik olarak ölçülmesinin imkânsız olmasıdır. Bu zorlukların ortadan kaldırılmasında en önemli etkenlerin başında mali istihbarat ve uluslararası işbirliği gelmektedir. Mali istihbarat, mali suçlarla mücadele edilmesinde ve suçun önlenmesinde etkili ve verimli bir şekilde mali istihbarat birimlerine yardımcı olmaktadır. Mali istihbarat, mali suçlarla mücadelede mali istihbarat birimlerinin verilerden yola çıkarak oluşturduğu analiz ve tipolojilerden meydana gelmektedir. Mali suçlarla mücadelede mali istihbaratın doğruluğu ve ortaya çıkacak olan finansal zekâ, suçun önlenmesi ve işlenmesi durumunda çözüme kavuşturulması için gereken en önemli olgu olarak kabul edilmektedir. Mali suçlarla mücadele eden pek çok uluslararası kurum bulunmaktadır. Başta FATF ve EGMONT Grup genel çerçevede mali suç faaliyetlerine ve mali istihbarat birimlerine yönelik çalışmalar sürdürmektedir. Bunun yanı sıra yerel olarak faaliyet gösteren ülke mali istihbarat birimleri tarafından da mali suçlarla mücadele edilmektedir. Bu çalışmanın amacı, mali suç türlerinin nelerden oluştuğunu belirtmek, mali istihbarat birimi kavramının üzerinde durmak ve mali istihbaratın mali suçlarla mücadeledeki rolünü incelemektir. Mali suçlarla mücadele edilirken mali istihbaratın rolünün değerlendirilmesi üzerine oluşturulan bu çalışma ile mali suçların durumu değerlendirilecektir.

Abstract:
The reflections made in this writing, bring to discussion the importance of transnational law, in the face of the occurrence of the current pandemic. From this, considerations are made about the transnational law produced by the WHO against Covid-19. Also, an analysis is made of the central categories and their relationship with the prefix ‘trans-’ and transnational law. Subsequently, the WHO is discussed, its emergence and performance in the elaboration of a transnational legal framework to be considered when internalizing its guidelines by each Member State. In the context of final considerations, it is emphasized, in addition to the importance that should be attributed to transnational law that the work of the WHO, as a transnational actor, practices materialized acts such as transnational law, both in terms of guidance and in connection with public health matters. The methodology used was based on the inductive method, using the bibliographic research.

Abstract:
The definition of various growth models is the latest innovation of comparative capitalism (CC) research. Yet, the literature has its weaknesses in explaining the dynamics within and the interdependencies between different growth models. I argue that this weakness stems inter alia from an inadequate conceptualization of transnational corporations (TNCs). I provide empirical evidence on the footprint of international capital in the global economy and outline how including TNCs as a unit of analysis can help us to better understand economic outcomes. This leads to several implications for the growth models literature, which I conclude my argument with.

Abstract:
Where does transnational jihadism come from? Why did militant Islamists start targeting the West in the 1990s after decades of operating locally? In this lecture, Thomas Hegghammer revisited the historical origins of the phenomenon often referred to as "global jihadism". Using insights from his latest book, The Caravan: Abdallah Azzam and the Rise of Global Jihad (Cambridge, 2020), he argued that the standard narrative established in the years after 9/11 was too West-focused and state-centric, and that local politics and technology played a greater role than is often acknowledged.

6. A Blacklist is (Almost) Born: Building a resilient EU human rights sanctions regime

In December 2018, the Council of the European Union initiated discussions about the creation of a new sanctions regime designed to address gross human rights violations, following a proposal from the Netherlands. So far, the EU only operates three thematic sanctions regimes: those targeting terrorism, cyberattacks and chemical weapons attacks. Unlike classical sanctions packages addressing crises in specific countries, such as Guinea or Venezuela, horizontal sanctions regimes apply to individuals and entities considered to have committed severe human rights abuses. Once approved, the planned blacklist is set to become the EU’s fourth horizontal sanctions regime, enlarging its vast body of autonomous sanctions regimes, i.e. restrictions adopted in the absence of a United Nations Security Council (UNSC) mandate. Over a year after the initial Dutch proposal was tabled, the sanctions regime is still under discussion, which contrasts with the rapid adoption of previous thematic regimes. On first inspection, the slow pace of preparations is puzzling: the vast majority of EU sanctions regimes were traditionally imposed in response to human rights breaches.3 Most EU autonomous sanctions regimes currently in force cite human rights violations as the rationale for their adoption. Indeed, the emphasis on human rights as a key motivation for the imposition of sanctions sets EU autonomous sanctions apart from the practice of other international sanctions senders like the United Nations (UN).4 Given that the promotion of human rights is a centrepiece of EU foreign policy, consensus among member states in support of such a regime should be forthcoming. If human rights breaches constitute the dominant motivation for the imposition of EU autonomous sanctions, what is holding up the approval of the prospective regime? Designing a horizontal sanctions regime in the EU is a much harder task than meets the eye. The present Brief aims to unravel the challenges that make it difficult for this regime to take shape, and suggests ways in which the obstacles identified may be surmounted or, at the very least, mitigated.

The Covid-19 pandemic appears to be not just a test for healthcare systems around the world, but an international contest for which country has the best political system. As the People’s Daily, the official mouthpiece of the Chinese Communist Party (CCP), boasted in an article published in early March, “China’s battle against the epidemic showed that the CCP, as China’s ruling party, is by far the political party with the strongest governance capability in human history.”1 It pointed the finger at Europe for “acting too little and too late, and largely failing to stem the tide”.2 Slow response time, high rates of transmission, and a general unwillingness to impose restrictive emergency measures were ascribed to the inherent deficiencies of open democratic, liberal systems, making them appear unfit to deal with health crises or indeed for governance generally. In this Brief, we put this hypothesis to the test: did democracies really respond less swiftly than authoritarian systems – and if the determining factor is not the political system, what are the key elements in crisis response?

In recent years, with the globalising world, countries are trying to obtain too many military equipment such as nuclear weapons, continental rockets, and high-tech armours. On the other hand, every service is becoming more private which used to belong to the government in history. After the cold war era, security details such as border security, presidential protection, abroad activities, intelligence, and security strategy are provided by private organisations. This study tries to explain what is ‘cold war? , what is a private military company? What is the change for the private military industry after cold war?’ | Küreselleşme nedeniyle artık bir yerel sorundan bahsetmek zor olmaktadır. Bunun yanında, teknolojik gelişmeler erişim kolaylığı ve sosyal medya gibi yeni imkânlar sunmaktadır. Bütün bunlar göz önüne alındığında, terörist gruplar daha önce görülmemiş bir kolaylıkla propaganda yapıp, takipçilerini yönlendirebilmektedirler. 11 Eylül saldırılarından bu yana, terörizm tartışmaları ve çalışmaları üzerine yoğunlaşma devam etmektedir. Terörizme karşı tek taraflı çabalar meşruiyet eksikliği ve meselelere çözüm bağlamında uzlaşma olmaması dolayısıyla küresel yönetişimi daha karmaşık hale getirmektedir. Güncel küresel meselelerin daha iyi anlaşılabilmesi adına terör ve sınır aşırı organize suçların etraflıca analiz edilmesi gerekmektedir. Oluşabilecek otorite boşluklarına çözüm üretme adına uluslararası örgütler harekete geçmek zorundadır. Aksi halde, yeni terörist örgütlerin tartışmalı bölgelerden ortaya çıkacak ve sınır aşırı organize suçlar dolayısıyla elde edilen gelirlerin bu örgütlerin eylemlerini finanse edecektir. Her ne kadar Birleşmiş Milletlerin küresel problemlere çözüm üretmesi gereken kurum olduğu düşünülse de, BM organlarının terörizm ve sınır aşan suçlar özelinde etkili olduğunu söylemek zor olacaktır. Bunun ötesinde, terörizm tanımının ne olduğu noktasında netliğin olmaması, egemen devletlere çıkarlarına göre bir terörizm tanımı yapmalarına imkân sağlamaktadır. Genellikle devletler çözümün parçası olmak yerine problemin bir parçası olma eğilimindedirler. Böylece, küresel yönetişim çatışmaların çözüme kavuşması noktasında ciddi zorluklarla karşılaşmaktadır. Bu çalışma bu zorluklar üzerine odaklanmaktadır.
