1. Characterizing Future Authoritarian Governance in the Space Domain

Abstract:
Traditionally, discussions of governance beyond Earth have largely been held to the purview of debates about space law and global governance regimes. Yet, the priority of space exploration among ambitious, tech-industry associated billionaires and its continued potential for militarization suggest that a more dynamic approach may be needed, given that state-sponsorship of extraterrestrial colonial projects may be more akin to partnerships between private and public actors rather than nation-states assuming traditional roles as sole sources of decision-making. Permanent settlements in space will require forms of localized government that may look distinct from contemporary models of political order. This article thus asks a provocative question associated with the empirical record of human colonization and settlement in prior eras: What sort of authoritarian governance is most likely to form in human space settlements during the medium term? Reviewing variations on political order in small-scale colonial settlements in light of recent conceptual work on authoritarian rule, the article identifies three theoretical models of governance that may emerge once beyond Earth settlements become permanent fixtures of human society.

In an age where space warfare is becoming more likely and a militarized space is already a reality, it is imperative to develop a strong legal framework to try and prevent nation-states from engaging in warfare. By implementing legal standards, improving on the existing legal framework, and taking input from outside legal sources, outer space can be made safer and the potential for armed conflict more protected against.

3. Governing Outer Space – legal issues mounting at the final frontier

Abstract:
In 2022, the private space firm SpaceX successfully launched 61 rockets, adding hundreds of satellites to its burgeoning, globe-spanning mega-constellation. SpaceX´s Starlink-project now comprises more than 3,000 satellites. For comparison, the European Space Agency launched six rockets in 2022 and operates less than 50 satellites in total. In the span of a few years, private space companies have dethroned nation states as the dominant actors in outer space. Today the vast majority of satellites are owned and controlled by commercial companies. During the first months of the Russian assault on Ukraine, several commercial space companies stepped in to provide vital satellite images and space-based Internet in support of the Ukrainian defense. This exemplifies the three currently dominant trends of human space activities: expansion, securitization and privatization. The global space industry is undergoing the most fundamental and swift changes since the original space race ended when Neil Armstrong placed the first boot marks on the moon in 1969. The rapid changes raise a number of serious governance issues in areas such as national security, environmental protection and the rule of law in outer space. Denmark, Europe and the international community at large all have an acute interest in insisting on space being a global commons in which conduct can and should be regulated to benefit all of humanity – not just a few profit-seeking billionaire-owned space companies. Developments in the space industry are fast and accelerating. As with other global governance issues, like climate and cyber issues, achieving global accord on new regulations for space activities will be difficult and time-consuming, so prudent policymakers should get started right away.

4. Developing Good Practices in Export Control Outreach to the NewSpace Industry

Abstract:
NewSpace is changing the nature of the space industry, exacerbating missile proliferation risks and posing challenges for the effective implementation of export controls. NewSpace companies develop, test, produce, use and market missile-related emerging and dual-use technologies, including small and micro launchers. One of the measures states can take to address these developments is to step up targeted outreach to NewSpace actors, raising awareness of such risks to strengthen compliance with export controls and foreign direct investment (FDI) screening mechanisms. Key elements of an effective outreach strategy for the NewSpace sector include tailored use of established outreach tools, mapping stakeholders, incentivizing participation in outreach activities, consistently engaging with launch vehicle manufacturers, inter-agency cooperation and raising awareness of FDI-related risks. The Missile Technology Control Regime, the Hague Code of Conduct and the Wiesbaden Process provide multilateral forums through which states can begin sharing experiences and develop good practices for outreach to the NewSpace industry.

5. Advancing Norms for Outer Space Security

Abstract:
In the last decade the outer space sector has undergone a revolution. The number of space objects and missions has increased like never before,2 with many new public and private actors and renewed ambitions in space exploration. Commercial actors are playing a more prominent role alongside governments. The so-called “New Space” industrial dynamic is largely supporting these developments by offering cheaper and faster production in numerous space-related areas, as well as new kinds of products and services. The value of the global outer space economy is estimated to have reached US$547 billion in 2022 and could grow to US$1 trillion by 2030.3 From the origins of the exploration of outer space, this domain has been a strategic site where states could develop and demonstrate their technological capacities. Space-based technologies and satellite applications are currently providing essential information, services and tools in many areas of socioeconomic development, including in support of the implementation of the UN Sustainable Development Goals. The collaboration between the public and private sectors in outer space is becoming ever more varied and entangled, leading to the establishment of strong ties and common interests. Military space-related capabilities may be used to impede the development of foreign commercial outer space systems4 and vice versa, while private actors may be directly involved in the development of military space capabilities or provide services to support them.5 Furthermore, pressure on the outer space environment, which is used both for military and civilian purposes, results in sustainability and safety considerations becoming intertwined with security concerns. Outer space activities are thus particularly sensitive to geopolitical tensions between countries, which have reached new highs since the start of the Russian Federation’s invasion of Ukraine in February 2022. Given the intrinsic competition between space actors and the risk of confrontation in outer space, it has become clear that new norms are required to keep misunderstandings and misperceptions at as low a level as possible and to ensure that outer space remains a stable and secure environment where activities can be conducted safely in the long term.

6. Inclusion and Environmental Protection in Space

A push for inclusion has been one of the most striking features of space programs in recent years, with a diverse range of agents going up to the Inter- national Space Station. NASA has been promoting the recognition of the early, but hidden, role of black scientists such as Katherine Johnson within its pro- grams of the 1960s (Johnson was celebrated in the 2016 7lm Hidden Figures).1 Beyond this, private sector activities are emerging with some built-in elements of inclusion. In 2021, Wally Funk fially could make it into space on a private sector Blue Origin suborbital flight, 60 years after being part of the privately trained female Mercury 13 group. These women were not part of the official NASA program, and they never made it into space, despite public criticism and the advantages of sending women in the cramped capsules given their generally smaller size. The women had what Margaret Weitekamp has referred to as “right stu:, wrong sex.”2

Outer space, long the province of peaceful competition and international cooperation, is being rapidly militarized. We stand today at a rare in8ection point in history that deserves careful thought as humanity moves forward. In short, we face the following choice: we can either protect and build on the special nature of space norms and customs to preserve space as a “laboratory of peace,” or we can militarize space as the new “highest ground” under largely the same rules that govern terrestrial warfare.1 4e sad reality is that our history, being inextricably linked to warfare, predicts that the dream of a peaceful future in space will almost certainly remain just that—a dream. 4at said, if you point out a problem, you should always propose a solution. I will propose a solution to the threat of warfare in space at the end of this article. But, before we get there, I will take a step back and explain some of the assertions above. Why do I call space a “laboratory of peace?” And why is this special status of outer space in jeopardy?

Along with this growth in demand from businesses and consumers is the need for more space security and policy approaches to address the potential risks of space exploration. Many dubbed the Gulf War of 1991 the “first space war” due to the US Armed Forces’ extensive use of satellites. The cyberwar in Ukraine, although it is mostly playing out in the shadows, may be remembered as the first space-cyber war. This policy brief makes the case that states should adopt national policies to defend against threats to space-based assets and applications, such as communications satellites, that are both vital to national security and economic security and increasingly vulnerable to cyberattacks. It is time to explore and identify principles for responsible space-cyber behaviour that would represent a broad multilateral consensus. Identifying these principles may not prevent space-cyber hostilities but could provide “rules of the game.” States would also benefit from encouraging a space-cyber security industry that, beyond protecting against space-cyber threats, has the potential to be a significant growth engine.

10. Military ambitions and competition in space: the role of alliances

Abstract:
Emerging trends in space ambitions and capabilities of major state actors have given renewed urgency to efforts by NATO and other coalitions to build stronger alliance relations to secure shared interests in space. This report reviews the military ambitions, operations and capabilities of leading and aspiring space powers in order to assess their likely impact on alliances, partnerships or other national-security coalitions. China wants to overtake Russia as a space power by 2035 and become at least a co-equal with the United States by 2045. For its part, Russia is determined to maintain its standing as a space power. Both are testing the boundaries of the existing order in space through various actions, including weapons testing, and both are keen to demonstrate that they now have the capabilities to attack adversary space assets. Partly in response to this, in 2020 the US declared its intention to radically reshape the operating environment of space to better meet its interests, while its allies and partners have announced new space ambitions as well. India and Japan are setting new strategic goals for space policy in response to China’s threatening behaviour. France is positioning itself to climb higher up the ladder of military space power, while the United Kingdom and Germany have set new aspirations for economic gain and further influence on the diplomatic aspects of space. In this environment, military alliances have become more prominent in shaping space policy. The US has stepped up its engagement with other governments, either through existing alliances or new partnerships, to secure its interests. China and Russia, which have few allies of relevance, except perhaps each other, are concentrating on constraining the effectiveness of the United States’ alliances. The three space powers harbour renewed fears of technological surprise by their rivals, and this makes sharing research on space warfare among allies more important than ever. For example, testing of the most visible space weapons, direct-ascent anti-satellite (ASAT) missiles, is escalating – and this is now only one of more than 20 forms of attack on space assets being tested or already in place. But there remain questions about how to achieve scale and military effect using all these methods for wartime operations, including kinetic ASAT weapons: would China or Russia be able to launch successful attacks against the entire military satellite fleet of the US (all 173 units) in the opening stages of a war? Assuming they could not, what proportion of the fleet would have to be disabled for the attack to have a positive military or strategic effect for the attacker?
