Abstract:
The vast majority of trans people around the world cannot obtain legal recognition of—or official documents that match—their gender identity. Where laws do recognize trans people, they often require that trans people have undergone gender affirming surgeries or hormone treatment, which result in sterilization. This forces trans people to choose between legal recognition of their gender identity or medical treatments they do not desire. In many cases these requirements amount to forced or coerced sterilization. This brief explains legal requirements that affect the recognition of trans and intersex people. It examines case law and addresses key arguments made by those who defend required medical treatments. It is the second of four resources for activists that accompany Open Society’s 2014 report on legal gender recognition across the world, License to Be Yourself.

Abstract:
The Commission’s 2014 report broke ground by advancing and globalizing the debate over drug control measures and its alternatives. Anticipating the 2016 United Nations General Assembly Special Session on drugs (UNGASS), the report provides clear-cut pathways for Member States. The five recommendations for more effective drug policies include: putting health and community safety first; ensuring equitable access to controlled medicines; ending the criminalization of people who use or possess drugs; promoting alternatives to incarceration for low-level participants in illicit drug markets, including cultivators; and encouraging policy innovations such as legally regulated markets, beginning with, but not limited to cannabis, coca leaf and certain other psychoactive substances. Never had so many former world leaders spoken out in support of legal, regulation of currently illicit drugs.

The hepatitis C epidemic fueled by the “war on drugs” is sweeping amongst injecting drug users around the world, yet continues to be largely ignored. Access to preventive services is far too low and diagnosis and treatment are too expensive and inaccessible for most people in need. The report provides an overview of the hepatitis C virus, while exploring how the ‘war on drugs’ and repressive drug policies are failing to drive transmission down. Hepatitis C is one of the harms caused by repressive drug policies, yet it s both preventable and curable when public health is the focus.

114. Transforming Health: International Rights-Based Advocacy for Trans Health

Abstract:
Trans people across the world face substantial barriers to adequate health and health care. They are targets of discrimination and violence, are at greater risk of contracting HIV, and experience a higher incidence of mental health problems like depression. They face discrimination from health care providers, a lack of doctors trained to address their needs, and the refusal of many national health systems and insurance providers to cover their care. Yet trans communities are building alliances to promote trans health and to fight for policies that respect gender diversity and human rights. This report profiles projects from 16 organizations in twelve countries that address these barriers. These projects offered general health services as well as those related to gender transition, trained health care providers to respond to the needs and concerns of trans patients, conducted public education campaigns about discrimination against trans people, advocated for legal and medical policy changes, and organized trans communities to empower themselves. Collecting insights from these projects, Transforming Health makes recommendations to governments, rights advocates, health professionals and public health organizations, and health and rights donors.

115. Treatment or Torture? Applying International Human Rights Standards to Drug Detention Centers

Abstract:
People identified as drug users in many countries are confined to abusive locked detention centers for months or even years. Such detention centers are supposedly mandated to treat and "rehabilitate" drug users, but the "treatment" they receive in some cases amounts to torture or other cruel, inhuman, and degrading punishment. In Treatment or Torture? Applying International Human Rights Standards to Drug Detention Centers, legal experts review common forms of abuse in drug detention centers and show how these practices in many cases are in violation of basic human rights treaties widely ratified by most nations worldwide. International health and drug-control agencies—including the UN Office on Drugs and Crime, UNAIDS, and the World Health Organization—all endorse comprehensive, evidence-based drug dependence treatment services. Yet drug detention centers rarely provide treatment that meets these standards. Depending on the country, so-called rehabilitation consists of a regime of military drills, forced labor, psychological and moral re-education, and shackling, caning, and beating. Treatment or Torture? comes in advance of the International Day against Drug Abuse and Illicit Trafficking and the International Day in Support of Victims of Torture—both on June 26, 2011. The report was published by the Campaign to Stop Torture in Health Care, a coalition led by the Open Society Foundations, and featured legal analysis by Human Rights Watch, Harm Reduction International, and the Canadian HIV/AIDS Legal Network.

116. The Role of Human Rights in Ensuring Universal Access to HIV Testing and Counselling

Recent years have seen a significant expansion of HIV testing and counselling, a necessary pre-condition for achieving the goal of universal access to comprehensive HIV/AIDS prevention, treatment, care, and support. However, HIV testing and counselling is not implemented fully and correctly unless human rights approaches are integrated into all aspects of its delivery. This includes not only respect for the "three C's" of pre-test information or counselling and post-test counselling, informed and voluntary consent to testing, and confidentiality of test results, but also ensuring an enabling environment that protects people from discrimination, violence, abandonment, ostracism, and other potential negative consequences of a positive test result. On October 12-13, the Open Society Public Health Program, the Secretariat of the Joint United Nations Programme on HIV/AIDS (UNAIDS Secretariat), and the World Health Organization cosponsored the meeting, “The Role of Human Rights in Ensuring Universal Access to HIV Testing and Counselling." The purpose of the meeting was to bridge the gap between international guidance on HIV testing and counselling and the implementation of this guidance. The meeting participants represented a wide variety of constituencies, including people living with and affected by HIV, implementers of HIV testing programs, donors and representatives of multilateral agencies, researchers, and human rights advocates. They sought to reach a consensus on concrete strategies and specific activities to overcome two types of barriers to ensuring human rights in the practice of HIV testing and counselling: political/systemic barriers and technical barriers.

117. Inequality and Suicide Rates: A Cross-Country Study

Abstract:
This paper tests whether economic inequality is related to suicide mortality. Using an unbalanced panel of 40 countries for the period 1947-2001 allows us to control for the effect of unobserved factors that may have an impact on suicide rates. Our results indicate that there is a statistically insignificant positive effect of inequality on the incidence of suicide. The latter result seems to be robust to a number of specification issues explored in a sensitivity analysis. Our results also suggest that female labour participation has a significant positive effect on the total (males and female) suicide rates, supporting the sociological argument that the role conflict dominates more than the role expansion. Contrary to the total and male suicide rates findings, the fertility rate matters in explaining female suicide rates. Finally, in contrast to previous studies, suicide rates were not sensitive to income levels, divorce rates and alcohol consumption.

Abstract:
The Agreement on Trade Related Aspects of Intellectual Property Rights (TRIPS), governed by the World Trade Organization, provides for stringent patent protection in the name of intellectual property rights. This international agreement has elicited public health concerns in developing countries, worried that they will be unable to access essential medicines as a result of increasing patented drug costs. This paper confi rms legitimate attempts to promote global public health and, more specifi cally, ready access to medicines through ‘fl exibilities’ including compulsory licensing and parallel importation, outlined in TRIPS, and reaffi rmed in the Doha Declaration on TRIPS and Public Health. However, it is determined that, in practice, barriers exist which erode or have the potential to erode the implementation of these fl exibilities in developing countries. These include a lack of local production capabilities and technological know-how, lack of economies of scale, needed legislative reform, and pressure from TRIPS-plus bi-lateral and regional agreements. Policy recommendations highlight the need for developing countries to cooperate on regional levels, developed countries to focus foreign aid strategies on building capacity, and for non-state institutions to create more proactive policies to assist implementation and information sharing amongst developing countries.

119. Why is There No AIDS Vaccine?

Abstract:
We argue that differences in timing of drug and vaccine consumption will lead firms to be biased against developing vaccines. Vaccines are sold before consumers are infected, when they still have private information regarding their infection risk, whereas drugs are sold after consumers are infected, when those with positive valuation have no private information on infection risk. Calibrations suggest that, for sexually transmitted diseases, for which infection risk is highly heterogeneous across consumers, producer surplus from drugs may exceed that from vaccines by a factor of four. Consistent with the model, empirical tests suggest vaccines are particularly unlikely to be developed for sexually transmitted diseases. Biases against vaccines are exacerbated by the durability of vaccines and by the interaction between the timing of vaccine and drug consumption and the temporary protection of intellectual property rights. We extend the analysis to allow for government procurement and for income heterogeneity among consumers. Given that antiretroviral drugs are difficult to deliver in the poor countries where most people infected with HIV/AIDS live, biases against developing a vaccine raise enormous public health concerns.
