1. Large-Scale Land Deals and Social Conflict: Evidence and Policy Implications

Abstract:
How do large-scale land acquisitions (LSLAs) increase the risk of conflict, and what kind of policies can mitigate this effect? We address these questions with a systematic and poli-cy-oriented synthesis of prior research. First, we suggest a simple conceptual framework linking LSLAs to social conflict through relative deprivation. Second, we present empirical evidence on the associations between land investments and social conflict, drawing on pre-existing quantitative and qualitative studies as well as on own descriptive analyses and case studies. Taken together, this evidence suggests that conflicts accompany a sub-stantive share of LSLAs (10 to 20 percent). Specifically, contentious dynamics often start with violations of community interests, which spur largely peaceful community protests that trigger coercion and violence at the hands of armed actors associated with national governments and investors. Third, we develop a set of policy recommendations in high-lighting the need for thorough regulatory frameworks, meaningful consultation, and full transparency.

While many actors within government wish to advance more responsible approaches to land-based investment, there are often political barriers for bringing law and policy proposals to fruition and translating those ideas into practice. This primer focuses on how government officials can improve the governance and practice of responsible land-based investment by building stronger political support. This is especially important given that government champions or "reformers" frequently interact with peers or superiors who have differing and sometimes opposing interests. The primer outlines strategic approaches which champions within government can take to improve the chances that their ideas are implemented, and examples of how the approaches could look or proceed in reality.

Indigenous peoples have long asserted and defended their rights and customary land tenures against the unlawful enclosure of their territories. Yet, despite normative recognition of the right to free, prior, and informed consent (FPIC)—and public commitments by major multinational companies, international financial institutions, and global banks to apply the standard of consent—power imbalances continue to undermine the quality of agreements being reached. Negotiating Consent distills lessons from Oxfam’s work defending community consent in Peru. Drawing on research published by Oxfam partners in Peru—Cooperacción, Organización Nacional de Mujeres Indígenas (ONAMIAP) and Pueblos Indígenas Amazónicas Unidas en Defensa de Sus Territorios (PUINAMUDT), which have published research examining the politics and practices of the implementation of this law—it seeks to contribute to collective thinking around ways to improve the implementation of FPIC processes, processes that are manifestly political. With land inequality worsening, land grabbing continuing unabated, and basic environmental and social protections being rolled back, upholding the standard of consent is more important than ever. It is time companies, investors, and others look beyond paper commitments and take the steps necessary to ensure quality agreements are reached with Indigenous peoples and are maintained across the life of projects.

4. Food security in the long-run: a macroeconomic approach to land use policy

Abstract:
It is important to dedicate substantial parts of the global land supply to public good uses in the 21st century, for purposes of climate change management and biodiversity provision. But will it also be possible to meet the food requirements of 12 billion people while doing so? Using a macroeconomic model (MAVA), we demonstrate that it may be possible to provide both for food security and environmental services in the long run. We first show that it may be possible to provide for food security with very substantial constraints on the amount of land used in agriculture with relatively minor welfare losses. We then show that global policies that reallocate labour across sectors of the economy may have the capacity for directing the economy toward reduced reliance on land in agriculture. Focusing on education, research and development, and fertility costs may be the best way to meet these combined goals. Details

5. Innovative Financing Solutions for Community Support in the Context of Land Investments

Abstract:
Communities affected by agricultural, forestry, and other resource investments urgently need increased funding for legal and technical support. Without support, communities risk losing access to critical land and resources, suffering human rights violations, or missing opportunities to benefit from investments. A lack of community support can also lead to conflict and challenges that are damaging for companies and host governments. Donors and support providers have found ways to finance support for communities, but such efforts can only extend so far. Promising new opportunities exist for filling the financing gap, yet they will require sustained efforts by a range of actors. This report presents a call to action to help communities secure the support they so crucially need. The report explores options for tapping new funding sources for community support. These include: Government marshaling of funding from companies and others, through taxes, fees, and penalties Basket funds, operated by independent, trusted entities and funded by contributions from multiple actors Market-based impact investments and social impact bonds Direct company funding Third party funding Other solutions for increasing funding or reducing costs, including crowdfunding, generating profits from social enterprises, affordable user fees or in-kind services, contingency and uplift fees, and court-ordered fee shifting. The report also presents overarching considerations for developing a new financing initiative. These include: the initiative’s likely cost, efficiency and financial sustainability, political complexity and obstacles, political economy implications, the importance of strong governance mechanisms, and the logistics required to link funding, communities and support providers.

6. Indigenous Elder Societies as Leaders for Global Protected Areas Governance

Abstract:
Many models for parks and protected areas have been created globally to preserve biodiversity and natural heritage and to provide visitors with “wild places” to experience. This establishment of conventional parks and protected areas has typically been done through governance processes that do not acknowledge Indigenous peoples, including their connections to and their governance systems for such areas. Area-based conservation through parks and protected areas has, therefore, displaced and systematically oppressed Indigenous Peoples, disenfranchising them from their custodial roles and responsibilities within their traditional territories. In addition to oppression, conventional governance systems have also produced intrusive infrastructure and circulated tourists, creating human-wildlife conflict that often results in wildlife mortality. Through disenfranchising Indigenous peoples of their traditional territories, parks and protected areas in colonized regions of the world have separated nature from the societies that have the most deeply embedded place-based knowledge systems and governance structures.

7. Governing Land Investments: Do Governments Have Legal Support Gaps?

In the wave of efforts to encourage and support more “responsible” land investments, one aspect has been largely overlooked: are governments equipped with the legal and technical support needed to effectively negotiate and conclude investment contracts that lead to responsible outcomes? CCSI researched how host governments access legal support in the planning, negotiation, and monitoring of land investments, with a view to better understanding where legal support gaps for governments exist, and how these can be addressed by governments themselves, as well as by donors, support providers and investors. By scrutinizing “legal support gaps,” CCSI sought to identify possible weak links in global and national efforts to achieve more responsible land investments, as well as opportunities to encourage better practice. For example, legal support holds the potential—albeit not yet regularly realized—to be an entry point for incorporating international best practice and guidelines into negotiations and at other stages of the investment. The report also takes stock of how governments are negotiating and concluding land investments in practice, to determine where additional legal support could potentially improve outcomes for governments.

8. The Commitment to Reducing Inequality Index: A New Global Ranking of Governments Based on What They are Doing to Tackle the Gap Between Rich and Poor

In 2015, the leaders of 193 governments promised to reduce inequality as part of the Sustainable Development Goals (SDGs). Without reducing inequality, meeting the SDG to eliminate poverty will be impossible. Now Development Finance International and Oxfam have produced the first index to measure the commitment of governments to reducing the gap between the rich and the poor. The Commitment to Reducing Inequality Index uses a new database of indicators covering 152 countries, which measures government action on social spending, tax and labour rights – three areas found to be critical to reducing inequality. This first version of the CRI Index is work in progress, and DFI and Oxfam welcome comments and additions. We find that there is an urgent need for coordinated global investment to significantly improve the data on inequality and policies to reduce it, and much greater concerted action by governments across the world to reduce the gap between rich and poor.

9. Tools for Change: Applying United Nations standards to secure women’s housing, land, and property rights in the context of HIV

Developed by the United Nations Development Programme and Open Society Foundations, Tools for Change is an easy-to-use resource for advocates working on women’s housing, land, and property rights in the context of HIV. It brings together relevant international human rights documents and highlights core concepts, rights, and means of enforcement, providing examples of successful advocacy from around the world. Moreover, it draws on the voices of women worldwide to explain these rights and their uses in practical terms. This manual was originally conceived during a strategic meeting on property and inheritance rights as they relate to HIV, held during the 2009 United Nations Commission on the Status of Women, where organizations gathered from around the world. It emerged from the realization that through hard work, advocates have managed to get a number of UN instruments to include protection for women’s housing, land, and property rights, and member states have pledged to abide by them. However, many advocates at the national level do not even know of these international instruments, even though they might be helpful in their work, particularly as governments may not be meeting their international human rights obligations. Advocates need a better understanding of international human rights and government obligations in order to ensure government accountability and advance women’s housing, land, and property rights. This manual seeks to empower advocates working in the context of HIV by making the relevant United Nations standards and interpretations clear and accessible—to make them "tools for change."
