Abstract:
Every year ILGA World publishes its annual Treaty Bodies reports, a compilation and analysis of SOGIESC references made by UN Committees. This is a key tool for advocates to clearly identify what has been recommended to their State, and also to see how they can influence future recommendations to better-serve local needs. Since the first 2014 edition, the reports cover data on country-specific recommendations made, general comments issued and individual cases reviewed by UN Treaty Bodies. Each of the reports include both general analysis of trends and gaps, and information on specific Treaty Bodies, including references to (de)criminalisation and trans and intersex persons’ situations. The compilation also touches on the intersection of our movements with others, looking at sex work and HIV/AIDS references too.

Abstract:
This article responds to the literature gap within both discourses on ‘sexual citizenship’ and statelessness studies on the nexus between statelessness and sexual orientation, gender identity and expression, and sex characteristics (‘SOGIESC’). It explores the intersectional experiences of stateless lesbian, gay, bisexual, transgender, intersex and queer plus (‘LGBTIQ+’) individuals as well as circumstances in which discrimination on SOGIESC grounds can cause statelessness for LGBTIQ+ persons or their children. In addition to rare reports of arbitrary deprivation of citizenship from LGBTIQ+ persons, the non-recognition of post-transition statuses and intersex realities may lead to situations of statelessness. Finally, complex legislation and administrative practices around assisted reproductive technology — and especially international commercial surrogacy — can leave children born within ‘rainbow families’ at particular risk of statelessness. In arguing that a global nexus does indeed exist between SOGIESC and statelessness, this article calls for further empirical research in order to provide greater nuance and context-specific understandings of the intersectional experiences and causes of statelessness for LGBTIQ+ individuals around the world.

24. Meet the Moment: A Call for Progressive Philanthropic Response to the Anti-Gender Movement

In early 2020, Global Philanthropy Project worked with our member organizations and philanthropic partners to develop two related pieces of private research: 1) a report mapping the funding of the global “anti-gender ideology” or “anti-gender” movement, and 2) a report mapping the progressive philanthropic response. We offer the following public document in order to share key learning and to offer additional analysis gained in the comparison of the two reports. Additionally, we share insights based on comparing global and regional LGBTI funding data as documented in the 2017-2018 Global Resources Report: Government and Philanthropic Support for Lesbian, Gay, Bisexual, Transgender, and Intersex Communities. These findings offer a clear call to action: progressive movements and their philanthropic partners are being outspent by hundreds of millions of dollars each year, and the institutions providing that opposition funding have developed sophisticated and coordinated systems to learn, co-fund, and expand their influence. The philanthropic community is called to recognize the scale of the fight and to be both rigorous and creative in our response. Let us seize this remarkable opportunity to work together and engage our collective learning, spending power, and institutional knowledge to help transform the conditions of our communities. Together we can leverage the collective power that this generational crisis demands.

Abstract:
For centuries, protests have been used to mobilize citizenry in efforts to bring about sweeping change in different parts of the world. Protestors have protested to convey their discontent, to demand a moral response, and to speak truth to power. In 2010, antigovernment protests in Egypt inspired similar uprisings in other Arab countries, which became known as the Arab Spring. This year, the killings of Ahmaud Arbery, Breonna Taylor, and George Floyd have led people in the US and across the world to march against racism and police brutality. Despite a global pandemic, thousands have taken to the streets to demand justice for Black lives, demonstrating that the principle of equality, a common moral good, is worth risking both health and life. “Human Rights: An Uprising,” the second issue of our twenty-first volume, sheds light not only on the right to protest itself, but the human rights that have inspired them. Mahmood Monshipouri explores the variations and similarities in contemporary protest while discussing the Black Lives Matter movement. Joudie Roure addresses gender-based violence and LGBTQI rights in Puerto Rico, especially the murder of trans women. Debra DeLaet explains the importance of soft law approaches in making progress toward the realization of gender-based human rights and LGBTQI rights. Randolph Persaud and Jackson Yoder apply the concept of homo sacer to examine differential rights within two key areas: migrants/refugees/asylum seekers in Europe and the effects of COVID-19 on African Americans in the US. Nicholas McMurry argues that the right to be heard is developing in human rights law as expounded in the practice of the UN treaty bodies. Kathleen Mahoney discusses Indigenous rights in Canada. Morten Andersen argues that an investigation of the relationship between corruption and human rights is best viewed as a framework of socially constructed norms, political power, and the complex interrelation of political, legal, economic, and social systems. Finally, David Johnson writes about the origins, causes, and contemporary implications of extrajudicial killings in the Philippines. This issue sheds light on the strata of protests and human rights. It further affirms the growing political salience of human rights and the power of social movements to overcome the tyranny of exclusion, greed, and special interests which have always undermined them.

This Tool is part of the DCAF, OSCE/ODIHR, UN Women Gender and Security Toolkit, which comprises nine Tools and a series of Policy Briefs. Tool 1 is mainly intended for use by policymakers and practitioners working in or working with security and justice sector institutions to increase gender equality – be it equality within the institutions themselves, or achieved through the work of the institutions within society. Some users might be approaching these issues through implementation of Women, Peace and Security (WPS) commitments, or in relation to a security sector reform (SSR) process. The Tool also aims to be of use more widely to justice and security providers, people involved in oversight and management, civil society organizations, the media and academic researchers. The other Tools and Policy Briefs in this Toolkit focus on specific security and justice issues and providers, with more focused attention on what gender equality looks like and how to achieve it in particular sectors. It is intended that the Toolkit should be used as a whole, with readers moving between Tools and Policy Briefs to find more detail on aspects that interest them. The Tool: Introduces why gender matters in security sector governance (SSG) and in SSR processes, and outlines the benefits of integrating a gender perspective. It explains key concepts that are used in the Toolkit: gender, intersectionality, masculinities, femininities, LGBTI, gender equality and gender perspective, and also SSG and SSR. It gives an overview of some of the relevant international, regional and national legal obligations with respect to gender and SSG and SSR processes. It presents a vision of what integrating a gender perspective and promoting gender equality mean for security and justice providers, for management and oversight of sector and justice services, and for SSG and SSR processes. It presents several different pathways for the security and justice sector to integrate a gender perspective into SSG and SSR processes and advance gender equality. It focuses upon: defining security needs in an inclusive, gender-responsive manner; adopting policy frameworks to integrate gender equality into justice and security governance; gender training for security and justice providers; using staff with specialized gender expertise; changing masculine institutional cultures to increase women’s participation and diversity. It offers advice on how to overcome resistance to working on gender equality within the security and justice sector. It suggests elements of an institutional self-assessment checklist on integrating a gender perspective. It lists other useful resources to support work on gender equality with the security and justice sector, and in relation to SSG and SSR.

Global Philanthropy Project and Funders for LGBTQ Issues are pleased to present the 2017-2018 Global Resources Report: Government and Philanthropic Support for Lesbian, Gay, Bisexual, Transgender, and Intersex Communities, a comprehensive report on the state of foundation and government funding for lesbian, gay, bisexual, transgender, and intersex (LGBTI) issues. This report documents over 19,764 grants awarded by 800 foundations, NGO intermediary funders, and corporations and by 15 donor government and multilateral agencies over the two-year period of 2017-2018. The report provides detailed data on the distribution of LGBTI funding by geography, issue, strategy, and population focus, offering a tool for identifying trends, gaps, and opportunities in the rapidly changing landscape of LGBTI funding. This report draws from six years of data on global LGBTI funding, documented in three editions of the Global Resources Report including grants awarded from 2013 to 2018.
