Abstract:
Over the recent years, the Indo-Pacific has grad- uated from being a geostrategic term reserved for a relatively niche community of analysts to an almost ubiquitous, albeit still fuzzy concept that in generous interpretation could capture as much as five continents. The fact that policymakers around the world are paying greater attention to the region is no doubt a reflection of the impact security and econom- ic developments in this realm have on the rest of the world, and which are by and large a direct consequence, or a by-product of, China’s growing power and asser- tiveness. Thus, a number of NATO Allies have been adjusting their approaches to the region, its key players, and potential Allies and partners. This shift in strategic attention has coincided with a growing foreign policy consensus in the United States and allied states towards ending the “forever wars” in the Greater Middle East, and ceasing the so-called era of out-of-area (OOA) missions by NATO. The Alli- ance has been deemed to have strayed from its orig- inal mission of deterring and defending against Rus- sian aggression in Eastern Europe, which became even more apparent following Russia’s illegal annexation of Crimea and intervention in Ukraine in 2014. Yet, as more NATO member states look towards re- sponding to challenges emanating from the Indo-Pa- cific, the prospects of future OOA operations in this region are becoming likelier than at any point in the post-Cold War era. This in turn leads to a slew of ques- tions around the conceptualisation and execution of potential OOA operations in the Indo-Pacific. At pres- ent, the institutional leadership is adamant: “(T)here is no way that NATO will move into the South China Sea”,1 while some of the major and middle powers in the Alliance are far from foreclosing that option. This Policy Brief first sketches out the strategic vision of those member states that have articulated Indo-Pa- cific strategies, after which it turns to the concept of OOA driven by new strategic imperatives. It concludes by proposing a framework of assessment for the pros- pects of coordination and cooperation among NATO Allies in the Indo-Pacific, and offers some preliminary thoughts on the near- to medium-run OOA activities.

Abstract:
Tax avoidance by multinational corporations has become a central feature of the world economy. After decades of opposition, the US wants to set a global minimum corporation tax rate and limit tax avoidance, but it will need all of Europe to stand behind it. A historic 130-country OECD tax agreement is giving some hope but both sides of the Atlantic will need to confront deeply rooted interests if they want to implement the deal and build a new cooperative tax reform framework.

114. Global Health Governance Post COVID-19: Time for a Hierarchical Order?

Abstract:
The COVID-19 has renovated the debate about global health governance. Many scholars have proposed that the World Health Organization (WHO) should assume the position of a central coordinator with hierarchical powers. This article presents four main objections to this project: the problems with ‘one-size-fits-all’ policies, the heterogeneous distribution of power within multilateral institutions, the risks of crowding out parallel initiatives, and the democratic principle. Testing the WHO’s ability as a provider of technical information, an OLS regression, analyzing the first year of the coronavirus health crisis, from January 2020 to January 2021, in 37 countries reported in the World Values Survey Wave 7, shows a negative relationship between the population trust in the WHO and the number of cases of COVID-19. This indicates that there is a valid case for countries to strengthen the WHO’s mandate, but not to create a hierarchical global health structure.

Abstract:
One of the current issues of criminal law, in general, is the issue of execution of a criminal judgment sentenced by the international criminal court (ad hoc or permanent international criminal court). The issue is ongoing because international criminal courts do not have their institutions for the enforcement of criminal sanctions they impose, but are, in that regard, instructed to cooperate with states that express readiness to execute criminal sanctions - imprisonment sentences imposed by an international criminal court in their prison facilities. Among the numerous issues related to this issue, the paper analyzes only those related to the legal basis for standardization, conditions, and manner of execution of a prison sentence imposed by an international criminal court.

Abstract:
The subject of this analysis was the provisions of the Rome Statute of the International Criminal Court devoted to the leadership requirement of the crime of aggression. The crime in question is the successor of crimes against peace. This paper employed normative and formal dogmatic legal methods in analyzing the particulars of the leadership clause. Besides, this analysis also took into consideration the case-law of certain judicial bodies. This paper aimed to examine whether the leadership requirement of the crime of aggression has been properly constructed for the Statute. The main focus was on the meaning of the conditions stemming from the leadership clause that each perpetrator ought to fulfill to incur criminal responsibility for the crime of aggression. Additionally, this research addressed the criminal responsibility of public and private actors and the modes of participation in the crime in question. The article established that the leadership requirement concerning the crime of aggression has been aptly incorporated in the Statute since this requirement, at the same time, embraces the post World War Two standards concerning crimes against peace and the contemporary notion of aggression as one of the core crimes under international law.

Abstract:
International legal scholarship and practice have reached a point where it is undisputed that the prohibition of genocide has the status of jus cogens and entails erga omnes obligations. It is, however, astonishing how little academic focus has been dedicated to the normative development leading to this extraordinary rank. In a legal regime with as little hierarchical structure as public international law, examining the birth process of such a norm promises considerable insights into normative formation in general and may inform jurisprudential theories on the nature of international law. This article illustrates the evolution of the prohibition of genocide by outlining the way to the 1948 UN Genocide Convention and the later interpretations of the norm. It traces the origin of the genocide prohibition to naturalistic ideas of overarching laws of humanity in international law and follows its development into the early 21st century. An analysis of international jurisprudence reveals that, after the jus cogens status of the prohibition of genocide and its erga omnes dimension had been settled, international judges handled the norm in a surprisingly lackadaisical and perfunctory manner. The very recent ICJ order on provisional measures in the Myanmar Genocide case potentially marks a return towards a deeper focus on moral facts determining the prohibition that point to naturalistic theories persisting, notwithstanding the positivistic mainstream approaches to international law. The article contributes to a more accurate picture of and greater academic interest in these naturalistic undercurrents.

Abstract:
This article draws attention to the need of a reform of the environmental protection by means of international criminal law as enshrined in the Rome Statute of the International Criminal Court. After giving a short overview of the contemporary environmental protection in war- and peacetime offered by international criminal law, it becomes clear that international criminal law fails to succeed at offering sufficient environmental protection. This paper outlines that there is no convincing reason for a differentiated approach in international criminal law to environmental damage in wartime and in peacetime, and that a shift from an anthropocentric to an ecocentric approach would positively contribute to a more effective protection of the environment. It is therefore argued for the introduction of a new integral and ecocentric international crime against the environment in the Rome Statute. The paper then elaborates on existing proposals on such a new crime against the environment before some proper observations on the exact contours of the crime are made. A focus lies on the new crime’s threshold of seriousness as well as on the necessary mens rea requirements. The insufficiency of the contemporary legal framework and the merits of a new crime against the environment are exemplified by an archetype example of peacetime environmental damage, the Chevron/Texaco oil spill scenario in Ecuador.

Abstract:
Globalization, one of the important phenomena of today, has led to political, social and economic changes in both regional and national scale. These rapid changes seriously affect the phenomenon of migration, its target and the quality of life. Especially in EU and OECD countries, various policies have been implemented to prevent the increasing migration rate, fulfill the requirements of the global economy, and to eliminate the developmental differences between countries, regions and sub-regions. Thus, it is of great importance to investigate the causes of international migrant mobility that deeply affects the economic and social structure of nations. The present study aimed to determine the factors that affect international migration towards the OECD countries. A current data set consisting of 79 variables defining the social, economic, environmental structure was created and correlation and regression analysis methods were used to determine the factors that affected international migration in OECD countries. With this work; it has been observed that there are strong relationships between international migration and various economic and social development variables. Hence, it is envisaged to make a descriptive and statistically valid, reliable assessment, to make predictions, and to contribute to the scientific literature in the context of international migration policies.
