31. Between Evolution and Stagnation – Immunities in a Globalized World

Abstract:
Immunities here have, on the one hand, been calls for the limitation or even the abolition of immunities, in particular based on the argument of a lack of responsibility for grave violations of human rights. Contrarily, opposed tendencies can be observed which raise ideas such as the extension of the scope of persons to be protected by immunities, resting upon the pluralization of actors in the globalized world. This article examines these two contradictory aspects of development of immunities in public international law and how they might interrelate with each other. It analyses how the simultaneous evolution and stagnation of immunities can be explained. For that purpose the contribution evaluates at first the current state of the legal development. Further, it takes a look at a certain stagnation of legal development and clarifies the structural parameters within public international law which have led to such a stagnation. In this context, it is critically dealt with the question, whether immunities meet the demands of a globalized world. Lastly, this article addresses the development regarding a denial of immunity in cases of grave human rights violations and asks how it could be more cautiously brought forward.

Abstract:
This article examines the experiences of Chinese elite uni- versity students abroad through the lens of temporality. In the strug- gle to get ahead, elite students are expected to carefully deploy their time. Studying abroad, it is argued, has become one more step in a culturally idealised temporal arrangement of how one is expected to go about advancing. The downside to this ethics of striving is shown to be a pervasive sense of restlessness (, fuzao). The article shows how relocating to a different life environment allowed a group of elite students to respond to their temporal predicament in existentially creative ways that registered socially as personal maturation. It is argued that these responses were set in motion by the students’ in- habiting an expanse of not-yet-purposeful time. Treating the tem- poral experience of Chinese elite students as a pronounced inflection of an increasingly global temporal mode of striving, the article en- quires into the temporality of the present human condition.

World news has been full of stories reflecting a profound sense of uncertainty about global futures. In response, this new edition of From Poverty to Power has been fully revised and now includes an in-depth analysis of the human impact of the global financial and food crises. From Poverty to Power, 2nd Edition argues that a radical redistribution of power, opportunities, and assets, rather than traditional models of charitable or government aid, is required to break the cycle of poverty and inequality. Active citizens and effective states are driving this transformation. Why active citizens? Because people living in poverty must have a voice in deciding their own destiny and holding the state and the private sector to account. Why effective states? Because history shows that no country has prospered without a state structure that can actively manage the development process. There is now an added urgency: climate change. We need to build a secure, fair, and sustainable world within the limits set by scarce resources and ecological realities. The book is accompanied by a list of blog resources. The From Poverty to Power blog played a key role in shaping the second edition of the book. Selected posts have now been indexed thematically to create an effective list of background material that can be read alongside the book.

Abstract:
How do globalization and temporality relate to one another? This was the question addressed by a 2011 workshop sponsored by Institute on Globalization and the Human Condition (IGHC) at McMaster University. In the past, globalization and temporality have both been characterized as moving forward independently of human volition, carrying all of us along in their flow. Now there are large literatures challenging this view, and showing how globalization and time are constructed and modified by humans. However, with some important exceptions (Harvey 1990, Sassen 2000, Appadurai 2005, Bauman 2000), the literatures on globalization and on temporality have developed separately from one another. It is important to bring these literatures into closer dialogue, because a great many urgent issues in contemporary human affairs involve interactions between temporality and globalization. These range from individual-level questions, such as managing the accelerated pace of everyday life, to large epochal problems, such as climate change, that may not always be readily apprehended, but are no less significant. The workshop participants, drawing on their backgrounds in a variety of academic disciplines, addressed the relationship between temporality and globalization in a variety of settings. Six of the papers presented at this workshop are gathered in this IGHC Working Paper. The assembled papers, individually and jointly, identify a number of themes of particular relevance to any comprehensive discussion of globalization and time. By way of introduction, it is useful to briefly consider how the most prominent of these themes are addressed by the contributors.

Abstract:
This paper reviews the available evidence and previous research on potential effects of financial globalization, that is, the international integration of financial markets. In particular, we address the questions: Has financial globalization materially increased the influence of external developments on domestic monetary conditions? And, has it reduced the influence of central banks over financial and economic conditions in their own country? We find that central banks with floating currencies retain the ability to independently determine short-term interest rates and thus influence broader financial conditions and macroeconomic performance in their economies. However, domestic financial conditions appear to have become more vulnerable to a wide range of external shocks, complicating the task of making appropriate monetary policy decisions. Moreover, the financial crisis has highlighted the importance of cross-border channels for the transmission of liquidity and credit shocks. With financial transactions increasingly being undertaken in vehicle currencies such as dollars and euros, the liquidity provision and the lender-of-last resort functions of many central banks are being challenged. Accordingly, international arrangements for liquidity provision may become increasingly important in the future.

As American journalist Laurie Garrett says in her famous book The Coming Plague: Newly Emerging Diseases in a World out of Balance, none of us can escape from a pandemic in our increasingly globalized world. Most of us are active members in prosperous communities, whose daily lives involve interactions with dozens of people of varied backgrounds; even if we were Robinson Crusoes safely living a life of autarky on an isolated island, a fly or bird could bring an avian or swine flu virus to puncture our well-protected balance.

Abstract:
We review the large literature on various economic policies that could help developing economies effectively manage the process of financial globalization. Our central findings indicate that policies promoting financial sector development, institutional quality and trade openness appear to help developing countries derive the benefits of globalization. Similarly, sound macroeconomic policies are an important prerequisite for ensuring that financial integration is beneficial. However, our analysis also suggests that the relationship between financial integration and economic policies is a complex one and that there are unavoidable tensions inherent in evaluating the risks and benefits associated with financial globalization. In light of these tensions, structural and macroeconomic policies often need to be tailored to take into account country specific circumstances to improve the risk-benefit tradeoffs of financial integration. Ultimately, it is essential to see financial integration not just as an isolated policy goal but as part of a broader package of reforms and supportive macroeconomic policies.

Contrary to an optimistic vision of a world "flattened" by the virtues of globalization, the sustainability and positive outcomes of economic and political homogenization are far from guaranteed. For better and for worse, globalization has become the most powerful force shaping the world's geopolitical landscape, whether it has meant integration or fragmentation, peace or war. The future partly depends on how new economic giants such as China, India, and others make use of their power. It also depends on how well Western democracies can preserve their tenuous hold on leadership, cohesion, and the pursuit of the common good. Offering the most comprehensive analysis of world politics to date, Laurent Cohen-Tanugi takes on globalization's cheerleaders and detractors, who, in their narrow focus, have failed to recognize the full extent to which globalization has become a geopolitical phenomenon. Offering an interpretative framework for thought and action, Cohen-Tanugi suggests how we should approach our new "multipolar" world—a world that is anything but the balanced and harmonious system many welcomed as a desirable alternative to the "American Empire."
