831. Evaluating the Zero Draft on a UN Treaty on Business and Human Rights: What Does it Regulate and how Likely is its Adoption by States/

Abstract:
Infringements of human rights through the actions of transnational corporations are common in our globalizing world. While the international community has undertaken numerous attempts to hold private corporations responsible for their actions, only soft law instruments govern this area of public international law. Only recently, a first draft was released for a Legally Binding Instrument to Regulate, in International Human Rights Law, the Activities of Transnational Corporations and Other Business Enterprises, also known as the Zero Draft. This article argues that the Zero Draft, while based on contemporary international law, represents a positive first step in the treaty-making process, but it still needs specification and clarification in order to close the gap in human rights protection effectively. First outlining the need for a closure of the gap in human rights protection, this article then closely examines the content of the Zero Draft. To that end, an in-depth analysis of the core provisions of the Draft is offered, especially focusing on the rights of victims, the prevention of human rights infringements, and corporate liability. Furthermore, this article analyzes current State practice and the expectations of the international community towards a legally binding instrument on the topic of business and human rights. Significantly, this article also compares the Zero Draft to existing soft law and previous recommendations on how to close the gap in a binding manner. Finally, the article concludes that, by indirectly holding companies accountable without depriving States of their sovereign power over their companies, the Zero Draft has the potential to be implemented as a future Treaty on Business and Human Rights.

Abstract:
The recent proliferation of cases of radicalization around the world has placed this issue on the agenda of the nations. Nowadays, the radicalization, understood as a process by which a growing commitment to an extremist political or religious ideology is reached, represents a challenge that we must deal with in order to improve our societies in terms of security. However, much of the academic procedures used to understand this phenomenon lack the empirical validity that allows us to rely on the knowledge they provide. This practice has led to the existence of a large amount of material related to radicalization, especially after 9/11, but not to the consolidation and validation of the knowledge we possess. Because of this, in this review we propose to explain three of the theoretical models that focus on violent radicalization. These three models mostly come from social psychology and have empirical baggage that supports its validity. These are: the 3N model (also known as the significant quest theory), the devoted actors model and the approach of the two pyramids. These three models focus, respectively, on the theories of motivation, on identity and values, and on the difference between cognitions and actions. Likewise, each one proposes different explanatory and triggering factors, as well as different dependent variables that explain these factors from violent behavior to sacrifice. In them we find differences and similarities that validate and complement some of the processes they propose. Therefore, knowing and understanding them will provide us with a deeper knowledge when it comes to understanding radicalization, studying it and making decisions for its prevention and/or reduction.

Abstract:
The adoption of the Treaty on the Prohibition of Nuclear Weapons (TPNW) which proposes a complete prohibition of this kind of weapons, gives an opportunity to think about the unlawfulness of its use and, where appropriate, the precise identification of the cases in which the use of nuclear weapons would be accepted by the international community. The goal of the TPNW is to eliminate the nuclear weapons in international relations thus this Treaty proclaims the unlawfulness of the use of such weapons. TPNW is a further step, although still insufficient, in prohibiting the use of nuclear weapons in an absolute and complete way in international relations. However, the simple adoption of this Treaty shows the necessity of agreement regarding such prohibition as well as keeping negotiations in order to achieve unanimous agreement on this matter by the international community. Most likely, the use of nuclear weapons should be considered as a specially prohibited case by the international legal order.

Abstract:
Following the adoption of UN resolution 1325 in 2000, the past two decades have seen increased attention to women’s roles in peace and conflict matters. Despite this, women continue to be marginalised in peacekeeping missions, peace negotiations and peace-building processes. This marginalisation clearly undermines the chances of building a sustainable and equitable peace. The following brief argues that it is time to include women and build gender-just peace by: 1) tackling security concerns both in the public and the private sphere; 2) empowering women socioeconomically; 3) improving the participation and representation of women in higher positions. The brief identifies concrete examples for each of these aspects and concludes that in spite of many dilemmas, there are still many practical steps for moving towards a more gender-just and sustainable peace.

The National Oil Company Database helps fill a significant gap in knowledge of the global economy. National oil companies (NOCs) produce approximately 55 percent of the world’s oil and gas, pumping out an estimated 85 million barrels of oil equivalent per day. The World Bank has estimated that they control up to 90 percent of global oil and gas reserves, thereby serving as gatekeepers for international oil companies’ access to hydrocarbons. Within their home countries, NOCs influence the degree to which billions of people benefit—or suffer—as a result of their countries’ hydrocarbon wealth. Many of these companies manage multi-billion-dollar portfolios of public assets, execute complex projects across their territories and at sea, employ citizens in the tens or hundreds of thousands, and perform a range of public services from providing energy to building infrastructure.

Oil, gas and mining projects can generate substantial revenues for host countries. At the same time, extractive activities generate a range of other positive and negative economic, environmental, social, political, institutional and cultural impacts. Host countries must weigh the economic benefits of extractive projects against their environmental and social impacts. However, environmental and social impacts are often assessed in separate processes and by separate institutions from those assessing financial revenues and the modeling, measuring and reporting of these impacts is rarely integrated with financial impacts.

Abstract:
Disguise and deception are permanent fixtures in history. Claiming another person’s identity is a practice that stretches all the way from ancient Rome to imperial Russia. Today’s technology, however, has introduced a bevy of tools that enhance and complicate duplicity online. One such tool has garnered significant interest from academia, industry, and the public, in recent years but especially in recent months: deepfakes. A portmanteau of “deep learning” and “fakes,” deepfakes are videos altered with the help of artificial intelligence (AI) algorithms, often to portray one individual performing words or behavior of the deepfake creator’s choice. This paper explores the social and political ramifications of deepfakes. It documents their recent uses, surveys regulatory responses from both the private and public sectors, and explores the landscape of recommendations that have been made for their further regulation. In straying from a purely technical understanding of deepfakes and their effectiveness, this paper seeks to emphasize the value of non-regulatory responses to potentially malicious technologies. Deepfakes sit at the confluence of several consequential issues, including privacy, free speech, online identity, and who is in charge of defending these values. Their intersection produces an invaluable, and perhaps unprecedented, space for constructing and understanding information online. Finding a solution that can mitigate deepfakes’ negative use cases without hampering their positive assets will grant digital citizens a degree of freedom online that might be difficult to secure so effectively in any other environment.

Abstract:
After the agreement reached in Katowice in December 2018, The Paris Agreement is finally operational. This is a major diplomatic achievement. Two large-scale political developments have cast a shadow over the implementation phase of the Paris Agreement: the rise of right-wing populism and emerging multipolar competition. The evidence so far seems to suggest that right-wing populism often frames climate change as an elite agenda – and international agreements are perceived as a pet issue of the corrupt elite, at odds with the interests of the people. Relatedly, tightening competition among great powers makes multilateral cooperation and consensus-based decision-making among 197 parties increasingly challenging. With the Paris Agreement in place, the UNFCCC can provide a long-awaited legal framework for national climate contributions, but it will not be able to increase the ambition of national climate policies via multilateral negotiations.

Climate-related events left no region unaffected in 2018. These events demonstrate how climate change impacts are worsening. Despite increased geopolitical tensions that seem to undermine the Agenda 2030 or the Paris Agreement, global and regional organisations have been able to achieve some progress in addressing and mitigating climate-related security risks. This report, prepared for the Planetary Security Conference taking place in The Hague on 19–20 February 2019, feeds into the conversation by sketching the past year’s trends in relation to climate and security.

Technological advances in the biological sciences have long presented a challenge to efforts to maintain biosecurity and prevent the proliferation of biological weapons. The convergence of developments in biotechnology with other, emerging technologies such as additive manufacturing, artificial intelligence and robotics has increased the possibilities for the development and use of biological weapons. This report, written by SIPRI experts on technology and arms control, provides a nuanced picture of the risks and challenges posed by this convergence. It analyses the extent to which concerns arising from new technological developments can be dealt with through existing governance mechanisms. Based on the limitations identified, the authors recommend the action that needs to be taken by national governments, international organizations, academia, the private sector and the DIY community.
