Abstract:
The Advisory Committee on Northern Development (ACND), a high-level interdepartmental committee, was responsible for coordinating federal Arctic policies and programs from 1948-1971. The minutes of its main meetings provide unparalleled insight into how high-ranking civil servants in Ottawa grappled with what they perceived to be the most pressing issues of the era, including Canadian-American relations, sovereignty, security, Aboriginal affairs, socio-economic development, scientific research, and governance. As this volume reveals, the ACND represented an early example of the “Whole of Government” approach to policy deliberations, revealing the myriad activities that constituted the “Arctic revolution” during this pivotal quarter-century.

Since a 2012 outbreak of communal violence targeting Rohingyas in Burma, the trafficking business had been booming. Subsequent official persecution intended to make Burma as inhospitable to the Rohingya as possible was working as planned: more than 120,000 Rohingyas have fled Burma since December 2012. For years, migration and human rights NGOs have warned regional and donor governments of the deteriorating situation facing the growing flood of Rohingya refugees. This humanitarian and political disaster also again laid bare the pathologies currently impeding Burma and Thailand on their paths toward stability and democracy

Abstract:
HADR exercises have traditionally been aimed at responding to and preparing for natural disasters. But ultimately, the purpose of HADR is to provide assistance to those in dire need of help after a crisis, whether it is natural or manmade. More than 6,000 trafficked people floating in the ocean without access to food and water arguably constitutes just such a crisis. ASEAN, with support from the U.S. Navy, would have been well positioned to put their HADR exercises into practice to assist the victims, as they were required to under international law.

Abstract:
In June 2014, The Soufan Group (TSG) released its initial Foreign Fighters in Syria report, which identified approximately 12,000 foreign fighters from 81 countries. Nearly eighteen months later, despite sustained international effort to contain the Islamic State and stem the flow of militants traveling to Syria, the number of foreign fighters has more than doubled. Based on its own investigation, TSG has calculated that between 27,000 and 31,000 people have traveled to Syria and Iraq to join the Islamic State and other violent Salafist groups from at least 86 countries. This increase is evidence that efforts to contain the flow of foreign recruits to the Islamic State and other extremist groups in Syria have had limited impact

Taking a look at recent episodes of social unrest, public protest, and other forms of contentious politics around the globe will tell you a lot about 2014. The year opened with violence in Kiev as thousands took to Independence Square in the Ukrainian capital to remove the Yanukovych government from power. Gay rights activists in St. Petersburg, Russia—but also throughout the world in a display of solidarity—protested the 2014 Sochi Winter Olympics in light of Russia’s controversial laws on “non-traditional” sexuality. Beginning in February, a wave of anti-government demonstrations—the largest in Venezuela in over a decade—demanded justice, protection, and economic changes from President Maduro. In August, Governor Jay Nixon declared a curfew and deployed the National Guard in response to growing unrest in the town of Ferguson, Missouri, over the shooting of Michael Brown by a local police officer. In September, thousands took to the streets in Hong Kong to stand for election reform. And in December, the people of New York City shut down the Brooklyn Bridge chanting “I can’t breathe,” in remembrance of Eric Garner.

Abstract:
The International Foundation for Electoral Systems (IFES) and Democracy International (DI) have released a new joint white paper that identifies best practices for election audits in developing democracies. Election audits, which are increasingly used as a means of settling disputes about electoral results, are often conducted as ad hoc processes without clearly defined standards and procedures. In this collaborative effort, IFES and DI put forth recommendations to guide electoral management bodies in preparing for election audits. As the international community continues to support electoral processes in developing democracies around the world, it is critical to come to consensus on standards that should be applied both to assess the need for an election audit and to conduct such an audit. This white paper is the first effort at building that consensus. Elections in developing and post-conflict environments can offer countries a path to democracy and their citizens the prospect of a better life. The peaceful and credible resolution of electoral disputes is of special importance in these contexts, where legal frameworks for elections are sometimes ambiguous, the rule of law may be weak, and allegations of fraud are commonplace and frequently legitimate. Drawing on their extensive involvement in several recent election audits in developing democracies, IFES and DI seek to define the most important considerations for audits, based on the premise that they should be used only in limited circumstances and according to clearly defined and predetermined frameworks. Ad hoc audit processes, conducted absent a clear regulatory framework, can weaken the credibility of election outcomes and undermine the ability of new democracies to provide effective governance and to hold elected officials accountable to their citizens.

Gender parity in elected office has become a central goal of national gov- ernments and international organizations around the globe. The roots of this demand extend back to the Universal Declaration of Human Rights, adopted in 1948, which enshrined “the equal rights of men and women,” including the right to participate in government.1 Delegates to the United Nations World Conference on Women, held in Mexico City in 1975, called on governments to “establish goals, strategies, and timetables” to increase “the number of women in elective and appointive public offices and public functions at all levels.”2 The Convention on the Elimination of All Forms of Discrimination against Women (CEDAW), adopted in 1979 by the UN Gen- eral Assembly and ratified by nearly every member state, reiterated that women must be ensured the right “to hold public office and perform all public functions at all levels of government.”

Abstract:
Immunities here have, on the one hand, been calls for the limitation or even the abolition of immunities, in particular based on the argument of a lack of responsibility for grave violations of human rights. Contrarily, opposed tendencies can be observed which raise ideas such as the extension of the scope of persons to be protected by immunities, resting upon the pluralization of actors in the globalized world. This article examines these two contradictory aspects of development of immunities in public international law and how they might interrelate with each other. It analyses how the simultaneous evolution and stagnation of immunities can be explained. For that purpose the contribution evaluates at first the current state of the legal development. Further, it takes a look at a certain stagnation of legal development and clarifies the structural parameters within public international law which have led to such a stagnation. In this context, it is critically dealt with the question, whether immunities meet the demands of a globalized world. Lastly, this article addresses the development regarding a denial of immunity in cases of grave human rights violations and asks how it could be more cautiously brought forward.

Decisions taken in a national forum affect the interests of individuals who, as non-citizens, are excluded from the decision-making-process. In the contemporary world, individuals and social groups can be severely harmed as a result of decisions taken far away from the place where they live and often even without any direct intervention. The issue of the consideration of non- national interests within national decision-making-processes is thus becoming increasingly important. The contribution begins with a brief analysis of the concept of solidarity, as the legal obligation to take into account non-national interests has been labelled in the international law scholarship. In contemporary international law, solidarity is a principle to be interpreted and further developed, rather than a right articulated in firm rules. Yet, from the epistemological point of view the legal system is always based on extra-legal concepts and reasoning. Thus, the reference in legal principles to non-legal arguments should not be regarded as a disadvantage but as a precious contribution to the inescapable link between legal and extra-legal discourses. On the basis of this assumption, the article concentrates on the main extra-legal reasons that have been brought into the debate in order either to deny both the existence of a duty of solidarity within the lex lata as well as the necessity to introduce it de lege ferenda; or, on the contrary, to maintain the paramount importance of such a duty. The analysis will end with some considerations on how the political and juridical forum could be concretely opened up, through proper legal and institutional arrangements, to a deliberation that gives access to the arguments of the others.
