Abstract:
On November 25, the International Atomic Energy Agency (IAEA) Board of Governors will meet to consider Iran's nuclear program, in light of the November 14 Paris Accords between Iran and Britain, France, and Germany (the E3). If the Paris Accords are going to work as a stepping-stone toward ending Iran's nuclear weapons ambitions -- rather than as a stalling tactic while Iran makes progress on that program -- several steps will be necessary to clarify and build on the Paris Accords.

642. Radical Islamist Groups in Germany: A Lesson in Prosecuting Terror in Court

Abstract:
On February 5, 2004, a German court acquitted Abdelghani Mzoudi, a thirty-one-year-old native Moroccan, of 3,066 counts of accessory to murder and membership in a terrorist organization (al-Qaeda). Mzoudi is suspected of having provided material and financial support to the Hamburg cell that helped organize and perpetrate the terrorist attacks of September 11, 2001. According to the presiding judge, Mzoudi was acquitted for lack of evidence, not out of a belief in the defendant's innocence. The acquittal was the most recent example of a growing dilemma faced by the United States and other countries in their efforts to prosecute suspected terrorists: how to gain access to intelligence for criminal proceedings without compromising the sources of that information. Indeed, Mzoudi's acquittal comes at a time when, despite nearly three years of fighting the war on terror, German intelligence claims that the presence of militant Islamist groups on German soil has reached new heights. U.S. officials face similar circumstances.

Of the Department of Energy's $23 billion budget, the $1.3 billion allocated to the Office of Energy Efficiency and Renewable Energy (EERE) offers important opportunities to assist in resolving one of the major issues facing the Nation today—the need for sources of clean, reliable, efficient, secure and affordable energy. EERE's programs—which include advanced hydrogen fuel concepts, renewable power technologies, transportation and building technologies—are aimed at improving this country's efficient use of energy, increasing the diversity of energy sources on which we rely, and making us less dependent on foreign energy sources. The management of this small office should be of major interest to leaders of both government and industry as EERE leadership tries to ensure that every dollar is used most effectively in the pursuit of its mission to strengthen America's energy security. This was the goal of Assistant Secretary David Garman as he launched a comprehensive reorganization of EERE on July 1, 2002.

Abstract:
Anglo-Saxon countries have been successful in the 1990s concerning labour market performance compared to the former role models of Germany and Japan. This reversal in relative economic performance might be related to idiosyncracies in financial markets, with bank-based financial markets as in Germany and Japan being possibly inferior to stock-market based financial markets in turbulent times and when approaching the economic frontier. A cleavage is related to venture capital markets which are flourishing in Anglo-Saxon but not in German-type financial markets. Venture capital is crucial for financing structural change, new firms and innovations and therefore possibly also nowadays for employment growth.

645. Remembering the Battle of Paris: 17th October 1961 in French and Algerian Memory

Abstract:
In October 1961, an as yet undetermined number of Algerian protesters were killed by the police in Paris while demonstrating for Algerian independence. In the last two decades, these killings have become the focal point of a public controversy in France, as questions about the memory of the Algerian war converged with debates about immigration and citizenship in the 1980s and 1990s and with the willingness of the French state to confront the crimes committed during the last phase of decolonization between 1945 and 1962. Most commentaries have emphasized the connections of this debate with an earlier bout of French soul-searching over the question of the Vichy government's collaboration with Germany during World War II. This connection seemed all the more relevant when the man who was the prefect of police in Paris in 1961, Maurice Papon, was accused and eventually convicted of assisting in the deportation of Jews from Bordeaux in 1942-1944. This article argues that the public attention to the connections between Maurice Papon and the Holocaust have obscured the extent to which the debate in France about October 1961 has been driven by developments in Algerian politics in the last four decades. The extent to which historical accounts of the events of October 1961 are shaped by very contemporary political concerns presents particular challenges to the historian, who must find a way of retelling the story without merely reproducing the ideological conflict that produced the violence in the first place.

647. Contagion: An Empirical Test

Abstract:
Using the conditional Capital Asset Pricing Model (CAPM), this paper tests for the existence and pattern of contagion and capital market integration in global equity markets. Contagion is defined as significant excess conditional correlation among different countries' asset returns above what could be explained by economic fundamentals (systematic risks). Capital market integration is defined as the situation in which only systematic risks are priced. The paper uses a panel of sixteen countries, divided into three blocs: Asia, Latin America, and Germany-U.K.-U.S., for the period from 1990 through 1999. The results show evidence of contagion and capital market integration. In addition, contagion is found to be a regional phenomenon.

Abstract:
In recent comparative works on the constitutional structures of contemporary liberal democracies, the United States and Germany have been grouped together as examples of democratic systems with an exceptionally high degree of “institutional pluralism”. In other typologies both countries have even been classified as “semisovereign democracies”. Whereas such classifications are of some use, especially in the field of public policy research, they fail to pay reasonable attention to the fundamental difference between parliamentary and presidential government that dominated the older literature on comparative political systems. As the comparative assessments offered in this paper suggest, the difference between parliamentary government and presidential government does not only constitute very different conditions of executive leadership in the core executive territory and at the level of executive-legislative relations, but has also a strong impact on the role and performance of the various “veto players” that characterize the political systems of the United States and Germany, and which are at the center of this paper.

650. European Corporate Governance Reform and the German Party Paradox

Abstract:
This paper addresses the current discussion on links between party politics and production regimes. Why do German Social Democrats opt for more corporate governance liberalization than the CDU although, in terms of the distributional outcomes of such reforms, one would expect the situation to be reversed? I divide my analysis into three stages. First, I use the European Parliament's crucial vote on the European takeover directive in July 2001 as a test case to show that the left-right dimension does indeed matter in corporate governance reform, beside cross-class and cross-party nation-based interests. In a second step, by analyzing the party positions in the main German corporate governance reforms in the 1990s, I show that the SPD and the CDU behave “paradoxically” in the sense that the SPD favored more corporate governance liberalization than the CDU, which protected the institutions of “Rhenish,” “organized” capitalism. This constellation occurred in the discussions on company disclosure, management accountability, the power of banks, network dissolution, and takeover regulation. Third, I offer two explanations for this paradoxical party behavior. The first explanation concerns the historical conversion of ideas. I show that trade unions and Social Democrats favored a high degree of capital organization in the Weimar Republic, but this ideological position was driven in new directions at two watersheds: one in the late 1940s, the other in the late 1950s. My second explanation lies in the importance of conflicts over managerial control, in which both employees and minority shareholders oppose managers, and in which increased shareholder power strengthens the position of works councils.
