12. Recent Trends in Security and Stability in the South Caucasus

- After twenty years of independence, the three counties of the South Caucasus-Armenia, Azerbaijan, and Georgia-continue to struggle with a daunting set of challenges. In light of several unresolved conflicts and profound deficiencies in efforts directed at democratic and economic reform, the South Caucasus continues to be a "region at risk." As if this rather bleak landscape was not enough, three more recent trends have emerged to further threaten the region's security and stability. The first trend, and one that is likely to have the most profound effects over the long term, is evident in a subtle shift in the already delicate balance of power in the region, driven largely by a steady surge in Azerbaijani defense spending and exacerbated by a lack of progress in the mediation of the Nagorno-Karabakh conflict. Since the 1994 ceasefire that resulted in the suspension of hostilities over Nagorno-Karabakh (but that did not definitively end them), this unresolved or "frozen" conflict has been subject to an international mediation effort conducted by the Organization for Security and Cooperation in Europe's (OSCE) so-called Minsk Group. This tripartite body co-chaired by France, Russia, and the United States seeks to engage and prod the parties to the conflict toward a negotiated resolution of the conflict.

- Since the 2003 Rose Revolution, Georgia has undertaken serious reforms, moving the country towards becoming a democracy anda market economy. Instead of proceeding at a steady pace, Georgia haschosen to take an accelerated path to reform. Since coming to office,the Saakashvili administration has underlined its ambition to bring Georgia into Euro-Atlantic structures. After an energetic start, Georgia ran into difficulties in late 2007 and 2008. During this period, the democratic credentials of the Saakashvili government were put to the test for the first time.The government was faced with massive public demonstrations, to which it responded in a heavy-handed fashion. The security forces attacked protesters, and the government declared a state of emergency, blaming the unrest on Russia. Many domestic and foreign observers feared that Georgia was abandoning the road to democracy. However, the state of emergency was soon lifted, and the government called an early presidential election. International observers judged the election to be largely democratic, despite some irregularities, but opposition forces claimed that the president's results had been boosted by fraud. Mr Saakashvili won an absolute majority in the first round of polling. The subsequent parliamentary elections in the spring of 2008 gave the ruling United National Movement party a landslide victory. With 119 out of 150 seats, theparty currently holds a two-thirds majority in parliament. The two major opposition parties (winning 17 and six seats respectively) refused to take their seatsin parliament.

- Legislative oversight of the security sector is crucial to ensure that security policies and expenditures are undertaken with full transparency, accountability and concern for other national priorities and popular attitudes. This is important in conflict states, particularly during peace or stability operations. Establishing legislative oversight is difficult in conflict countries because of the absence of historical tradition, the complexity of security agencies, the technical nature of the issues, secrecy laws and the lack of expertise among parliamentarians and their staffs. The U.S. Congress provides a model for effective legislative oversight of the security sector for other countries to emulate. Congress has developed the legal authorities and the traditions required to form an effective partnership with the Defense and Justice departments, the U.S. military forces and civilian security services. Due to the importance of legislative oversight of the security sector to the democratic process, the U.S. Congress provides advice and training to foreign parliaments and parliamentarians in security sector reform. Congress has important partnership arrangements with parliaments in Afghanistan, Pakistan, Georgia, Kosovo and other conflict countries.

15. Georgia-Russia: Still Insecure and Dangerous

- Ten months after the “August war” between Georgia and Russia, violent incidents and the lack of an effective security regime in and around the conflict zones of South Ossetia and Abkhazia create a dangerous atmosphere in which extensive fighting could again erupt. Russia has not complied with key aspects of the cease-fire agreements that President Medvedev reached in August/September 2008 with French President Sarkozy in his then EU presidency role. Its 15 June Security Council veto of an extension of the sixteen-year-old UN observer mission mandate in Georgia and Abkhazia and its apparent intention to require the removal of the mission of the Organisation for Security and Co-operation in Europe (OSCE) by the end of the month are blows to regional security that will further fuel tensions. Most of the on-the-ground conflict resolution machinery is thus being dismantled. Moscow should review its counterproductive position and work for a reasonable compromise allowing the UN and OSCE monitors to continue their important work.

- On 7 August 2008, Georgia attacked Tskhinvali, the capital city of South Ossetia, with heavy artillery, rocket launchers, and ground troops in an attempt to take control of the breakaway republic, which contained bases of both Russian and OSCE peacekeepers. Russia, claiming to be acting under the mandate of peace enforcement, pushed Georgia out of both South Ossetia and another breakaway Georgian republic, Abkhazia, and deep into Georgian territory. This created the potential for regime change, as the Russian Army appeared to be moving on Tbilisi with the intent of overthrowing Georgia's democratically elected government. On 8 August 2008, Russian military forces crossed the Georgian border into South Ossetia and Abkhazia in a successful effort to repulse Georgian troops. The immediate casus belli for Russia was genocide, with claims that “over two thousand” South Ossetians had been killed by Georgian troops, along with the shooting of ten Russian peacekeepers in South Ossetia, which necessitated a humanitarian and peace enforcement operation. The Russian advance included ground troops, tanks and armored personnel carriers, and air and sea operations, combined with coordinated kinetic and cyber attacks. Russian forces also crossed into Abkhazia in defense of their compatriots – 70 percent of the Abkhaz population of 220,000 are Russian passport holders, and 90 percent of the South Ossetian population of 70,000 are also Russian citizens.

- Kavkazky Uzel reported on August 13 that members of the Chechen-manned Vostok battalion of the Russian Defense Ministry's Main Intelligence Directorate (GRU) were among the Russian forces that invaded Georgia. According to the website, the Vostok fighters were located in area of the Georgian town of Gori along with Sulim Yamadaev, the Vostok battalion commander. Yamadaev, who became a target of Chechen President Ramzan Kadyrov's wrath following a confrontation and apparent shootout last April involving Vostok members and security forces loyal to Kadyrov, was put on Russia's federal wanted list earlier this month.

- Washington and Moscow's failure to develop a working relationship could lead to a dangerous crisis—perhaps even a nuclear one. There is an immediate need to grab onto the superstructure of the relationship through the STA RT and CFE treaties, both of which require urgent action. A new architecture should follow that to broaden the relationship, including the creation of a new future for security in Europe. Both capitals need to devise a strategy as well as a mechanism to manage the relationship and prevent future crises. A commission of past presidents—U.S. and Russian—would have the authority to confront these monumental tasks.

- The post-cold war vision proffered by the U.S. and its allies in NATO was an inclusive model of security for all the countries in Europe and for Russia and its neighbors to the south. Russia's leadership has turned away from it, but the vision remains sound and open to Moscow – if the Kremlin thinks wisely about the future.
