31. Armed Non-State Actors: Current Trends Future Challenges

Abstract:
Most of today's armed conflicts take place within states and are waged by at least one NSA fighting state forces and/or other NSAs. In these conflicts, frequent violations of humanitarian norms are committed by both state and non-state parties. NSAs also frequently control or heavily influence areas where civilians live. Consequently, efforts to protect civilian populations should address not only the behaviour of states, but also that of NSA.

Abstract:
Private military and security forces, in various forms, have been around for as long as there has been war and insecurity. In the fi rst and second centuries BC, Carthaginians used Numidian mercenaries, in the fifth century the Romans used Germanic mercenaries on their northern borders, the Byzantines hired the Spanish in the fourteenth century, the English used Prussian “Hessians” in the American War of Independence, and the Swiss Guard have been providing protective services to the Vatican since 1506. These forces were used by strong regional and local powers to safeguard or expand territory or other spheres of influence under their control.

Abstract:
Cyber security encompasses borderless challenges, while responses remain overwhelmingly national in scope and even these are insufficient. There are enormous gaps in both our understanding of the issue, as well as in the technical and governance capabilities required to confront it. Furthermore, democratic governance concerns – particularly regarding control, oversight and transparency – have been almost entirely absent from the debate. These concerns are exacerbated by the enormous role played by private actors (both alone and in cooperation with governments) in online security of all types. Given the pace at which states and private companies are reinforcing online security and preparing for cyber war, addressing democratic governance concerns has never been more pressing. They are the primary subject of this paper.

Abstract:
Gender equality is an international norm that stipulates the equal right of women, men and gender minorities to access opportunities and resources, regardless of the sex with which they were born and the gender with which they identify. In the context of the security sector, this means that women and men should have equal opportunities to participate in the provision, management and oversight of security services, and that the security needs of women, men, boys and girls should be equally considered and effectively responded to. While ECOWAS recommends that the specific security and justice needs of men and women, boys and girls are fully integrated into all reform processes and governance mechanisms applicable to the security sector, the transition from theory to practice often proves challenging. Tool 8 of the Toolkit for Security Sector Reform and Governance in West Africa is designed to provide practitioners with action-oriented guidance for tackling this challenge. It may be most useful to national actors involved in the governance of security institutions and to those who partake in democratic oversight. This Tool aims to facilitate the identification of effective entry points for integrating the aims of gender equality in national legislation, strategies and budgets for security; in the management of security institutions; in the delivery of justice and security services and in national defence; as well as at all stages of internal and external oversight of the security sector.

37. Two Cheers for Humanitarianism

Over the last two decades a spate of books, led by the ones cited in this essay, have illuminated and debated the bristly questions confronting contemporary “humanitarianism.” The definitional or, one might say, foundational question is whether the adjective “humanitarian” should be limited to only those independent agencies that are engaged (without reference to a political context) in the impartial delivery of emergency relief to all those in existential need—or, in the unique case of the International Committee of the Red Cross (ICRC), engaged in monitoring the application of the Geneva Conventions to armed conflict. An answer in the affirmative could be considered the “classic” position of the humanitarian, and one still championed by the ICRC. Today, however, many NGOs, such as CARE, OXFAM, and Catholic Relief Services, which certainly regard themselves as humanitarian agencies, engage in a broad range of rehabilitative and developmental activities and continue to deliver emergency relief, and they are prepared to do so under circumstances where their work has conspicuous political implications. The same is true of such UN agencies as UNICEF, UNHCR, and the World Food Programme, which are not infrequently involved in complex peace operations that have clear political goals as specified by the Security Council. Further, well-known humanitarian activists and writers, notably Bernard Kouchner and Samantha Power, also reject the ICRC's definitional canon. The unsettled boundaries of what properly constitutes humanitarianism brings a number of difficult questions to the surface, including: Should relief be provided even if it could prolong a conflict, or could indirectly assist a belligerent, or possibly identify the relief giver with a government's political ends? And should the nature of those ends influence relief efforts? Should relief agencies also assist in addressing the causes of humanitarian emergencies by joining in efforts to resolve a conflict, foster economic development, rebuild state institutions, and strengthen the protection of human rights? Should such agencies accept funds from governments where governments specify how the funds are to be used? Where necessary, should they advocate armed intervention to protect their personnel as well as the recipients of their aid? In terms of the way they organize and structure themselves, should nonprofit agencies dedicated to humanitarian relief follow private-sector models? Can organizations dedicated to the effective provision of emergency relief pursue that end without creating a culture of dependence, without discouraging local initiative, and without violating the liberal “right” to participate in life-shaping decisions? Finally, how does humanitarianism relate to human rights, the other leading expression of what I would call “the humanitarian impulse”?

On 15 September 2009, the private Israeli-Palestinian peace initiative known as the Geneva Initiative published 13 detailed annexes to the Geneva Accord, the draft framework for a final status agreement between Israelis and Palestinians unveiled in 2003. The Geneva Initiative was launched by former Israeli justice minister Yossi Beilin and then Palestinian Authority (PA) minister Yasir Abid Rabbuh in their private capacities in 2001. The original accord, while immediately rejected by then Israeli prime minister Ariel Sharon, was met with considerable international backing, but never formed the basis of any official negotiations.

Kofi Annan did more than any UN Secretary-General before him to stress the close link between human rights and peace and security. In his inaugural address to the newly created Human Rights Council in Geneva on June 19, 2006, he said: ''. . . lack of respect for human rights and dignity is the fundamental reason why the peace of the world today is so precarious, and why prosperity is so unequally shared.'' With the creation of the Human Rights Council, ''a new era in the human rights work of the United Nations has been proclaimed.''
