3471. The Italian Government and NATO's New Strategic Concept

Abstract:
The conservative report on NATO's new Strategic Concept, written by a group of experts chaired by Madeleine Albright, suits Italy's status-quo oriented agenda. As long as NATO does not shift its focus away from Europe, the renewed emphasis on expeditionary capabilities is acceptable to the Italian government. The Italians could also find comfort in the report's insistence on calibrating NATO ambitions to its actual resources and capacities. Italy could insist on making the advantages of NATO-EU cooperation more explicit, as this would favour EU defence integration, which in turn may help save money and maintain acceptable military standards. The section on NATO's relationship with Russia is the part of the Albright report with which Italy is perhaps most uncomfortable, as it seems to perpetuate NATO's ambiguity towards Russia. In the final analysis, assuming that the Albright report is a credible preview of the next Strategic Concept, the Italian government seems to have little reason to loose sleep over it.

In the framework of the IAI-University of Kiel project on “The European Union and the Reform of the United Nations” (Effective Multilateralism), the present report offers an account of the positions and ideas that emerged during the second meeting of Working Group I on “The Reform of the UN Security Council: What Role for the EU?”, held in Rome on 14 May 2010. With its concise overview of all the papers presented at the conference and the relative debates, this report is meant to provide a basis for fruitful further reflection in view of the project's final conference, to be held in Berlin at the beginning of 2011.

3473. Italian Armed Forces under Pressure

Abstract:
The Italian defence budget is decreasing again. According to an analysis produced by the Istituto Affari Internazionali (IAI), in 2010 Italy will spend around €17,6 billion, or 1.13 percent of GDP, for defence. More worryingly, the budget is seriously unbalanced; personnel costs still gobbles up over 65% of the funds available for the Defence Function, while lack of resources will prevent troops recruiting (thus deepening the unbalance between troops and officers). Funding for the education and training of personnel, and equipment maintenance and support, is also decreasing. If the political and military leadership will not deal with this situation, the country runs the risk of having a military instrument that is unable to perform its duties fully.

3475. Victim and rebel: Al-Qaida's salafist rhetoric and the pitfalls of anti-terrorism

Abstract:
Following the July 2005 London terrorist attacks the focus of anti-terrorism efforts has moved towards radicalisation within European societies and away from the conflicts in the Middle East and South Asia. This report argues that this shift in focus is based on a misconstrual of al-Qaida as it mistakes effect for cause. Based on an examination of the communication strategy of al-Qaida and the political rhetoric of Salafism the need for an analysis of militant Salafism in its political and societal context is demonstrated. The radicalisation theory is criticised and it is argued that the wars in Iraq and Afghanistan, as well as the increased focus on efforts to counter radicalisation within European societies more or less have failed because al-Qaida has been able to exploit this strategy and reorganise itself around an operational centre in Pakistan. The report concludes that only politically viable solutions in South Asia and the Middle East can effectively suppress al-Qaida and militant Salafism.

Abstract:
During the 2 decades preceding the Persian Gulf War in 1991, the U.S. Army went through tremendous reform and rejuvenation. It recovered from the Vietnam War, transitioned to an all-volunteer personnel model, and refocused on a potential future war against a very capable adversary in Europe. The Army's transformation was evident to external observers: from being seen as an organization in distress in the early 1970s, by 1991 the Army became an organization whose professionalism was the source of admiration. Drawing on the relevant literature, the author seeks to explain this important case of military change.

3478. Strasbourg's Interpretive Ethic: Lessons for the International Lawyer

Abstract:
The article offers an account of the judicial philosophy which underpins the European Court of Human Rights' approach to treaty interpretation. The first part argues that Strasbourg's interpretive ethic has been dismissive of originalism and textualism and has favoured instead the moral reading of the Convention rights. The second part of the article explains why Strasbourg's interpretive ethic is fully justified, by offering an account of the nature of treaty interpretation in general. It argues that treaty interpretation is intrinsically an evaluative task in identifying the moral values which normatively constrain the projects that states pursue on the international plane. Treaty interpretation is only derivatively an exercise in discovering drafters' intentions and in determining the meaning of treaty provisions. Which interpretive methods an adjudicative body should use depends on the nature of the treaty in question and the moral value in play.

Articles 1 and 2 of the European Convention on Human Rights, when read together, require a proper and adequate official investigation into deaths resulting from the actions of state agents, both from the use of lethal force, and also in situations arising from the negligence of agents that leads to a death. The article considers the extent of the obligation to carry out an effective investigation since its explicit recognition by the European Court of Human Rights in the case of McCann and Others v. United Kingdom. The article assesses the jurisprudence of the duty to investigate in order to determine whether the obligation is now placing too onerous a burden on member states in order to comply with their duties under the Convention, or whether the duty does indeed secure the right to life, as is intended. To assess the original proposition, the article considers the jurisprudence of the duty to investigate in relation to the following applications: early forays into the application of the duty; fatalities arising from non-lethal force; the influential quartet of cases arising out of the Northern Ireland troubles; recent judgments concerning cases arising out of the conflict in Chechnya; and finally through to a critical review of the effectiveness of the European Court.

3480. Non-compliance Mechanisms: Interaction between the Kyoto Protocol System and the European Union

The universality of climate change challenges and interdependence in the reduction of greenhouse gas (GHG) emissions called for a collective response in a multilateral framework. However, because of discrepancies on the appropriate design for an international regime the European Community (EC) took the lead on the international stage in the negotiation and the application of the Kyoto Protocol. Thus, an international regime – a mixed agreement to which both the EC and its Member States are parties – and a regional regime in the framework of the European Union coexist. In both regimes, one of the core challenges remains to ensure the effective application of the law, which requires the setting up of compliance control mechanisms. At the international level, an innovative non-compliance procedure organizes a continuous monitoring which combines traditional techniques with more intrusive procedures. The system is also remarkable as regards the legal qualification of and reaction to non-compliance situations. For its part, the EC created a specific non-contentious mechanism and can make use of a reinforced jurisdictional armory and a reinforced sanctioning power. The EC's control mechanism should be able to take over from the Kyoto Protocol non-compliance mechanism in order to reinforce the effectiveness of adopted rules. Through the study of these mechanisms' interactions, this article aims to assess the capacity of the control system as a whole to ensure the very credibility of the Protocol and the reliability of the international and European economic tools to reduce GHG emissions at least cost. Finally, it allows the envisaging of the possible evolutions of the legal regime of the fight against climate change.
