21. The European Court of Human Rights Through the Looking Glass of Gender: An Evaluation

Abstract:
Gender equality is of paramount importance for a functioning democracy and for economic growth. It is a central tenet of human rights law and has seen significant developments on the legislative, judicial, and policy levels of the Council of Europe. Through a mélange of theory, legislation, and jurisprudential analysis, this paper will assess developments in the European Court of Human Rights’ approach to the issue of gender equality. This will be achieved through a survey of case law involving domestic violence, child-bearing, and the wearing of religious dress by women. The paper will demonstrate that, despite the existence of significant milestones in the ambit of promoting gender equality, and, notwithstanding effective advancements made by this body, particularly vis-à- vis domestic violence case law, improvements to its approach remain necessary. More specifically, on one level, the Court denounces and works against gender inequality and discrimination but, on another, consciously or unconsciously, its approach and findings are marred by its own stereotypes, patriarchal influences, misconceptions, and preconceptions about what gender equality actually is and how it should be pursued.

Abstract:
Six months have now elapsed since the events of January 6. This issue of CTC Sentinel focuses in large part on the evolving threat of extreme far-right violence around the world. In the feature article, Graham Macklin examines in detail the thwarted October 2020 conspiracy to kidnap Michigan Governor Gretchen Whitmer. He writes that the plot “highlights how anti-government ‘militias’ have continued to adapt and evolve, exploiting conspiracy theories and deliberate disinformation surrounding the pandemic, to remold traditional grievances about the ‘tyranny’ of the U.S. government.” In a wide-ranging interview, Deputy to the Under-Secretary-General Raffi Gregorian, the director of the United Nations Office of Counter-Terrorism (UNOCT), says the United Nations needs to counter extreme far-right violence around the world. “It’s worth reflecting about the origins of the United Nations as a group of allies fighting Nazis,” he states. “We ought to be doing this. We have a legal basis to do it. It would be nice to have a clear political signal to do it. I think we’ll get it. And I think we’ll get it because the countries that are most afflicted with it right now are ones that are also very interested in doing something about it.” The reporting of Yassin Musharbash and a team of his colleagues at Die Zeit has shed significant light on the globalization of the violent far-right. In an article that outlines and elaborates on this reporting, Musharbash writes that “right-wing extremists today, in many cases, no longer subscribe to the narrow concept of nationalism but instead imagine themselves as participants in a global struggle against a global enemy.” Matthew Kriner and Jon Lewis examine the Proud Boys, a violent far-right group alleged to have played a significant role in the U.S. Capitol siege. They write that the group has “continued to mobilize, sometimes armed and violently, in response to the continued disinformation narratives related to the ‘Stop the Steal’ movement, vaccines, and more, appearing at more than 20 events in 13 cities since January 6.” Milo Comerford, Jakob Guhl, and Elise Thomas profile Action Zealandia, outlining how the extreme far-right group fits into a “small but persistent far-right extremist ecosystem” in New Zealand and its “growing links with violent extreme far-right movements internationally.” This September, to mark the 20th anniversary of 9/11, the Combating Terrorism Center will be publishing a special issue of CTC Sentinel on the evolution of the global jihadi threat.

Abstract:
Latin America is the most violent region in the world. Yet, decades of political and financial investment by the international community have not had the desired results. Using the work of the European Union in the Northern Triangle of Central America as a case study, this article asks what explains this failure. Utilizing the conceptual framework of Complexity and Human System Dynamics, it argues that current policies actually entrench the pattern of conditions which lead to, and sustain, violence. It shows how, by reconceptualizing this problem using the concepts of Complexity, policies could be made more effective and sustainable.

The talk will be chaired by David L. Phillips (ISHR) with Alexander Cooley (Harriman Institute) as discussant and interviewer. In There Is Nothing for You Here, a celebrated foreign policy expert and key impeachment witness reveals how declining opportunity has set America on the grim path of modern Russia—and draws on her personal journey out of poverty, as well as her unique perspectives as an historian and policy maker, to show how we can return hope to our forgotten places. Fiona Hill grew up in a world of terminal decay. The last of the local mines had closed, businesses were shuttering, and despair was etched in the faces around her. Her father urged her to get out of their blighted corner of northern England: “There is nothing for you here, pet,” he said. The coal-miner’s daughter managed to go further than he ever could have dreamed. She studied in Moscow and at Harvard, became an American citizen, and served three U.S. Presidents. But in the heartlands of both Russia and the United States, she saw troubling reflections of her hometown and similar populist impulses. By the time she offered her brave testimony in the first impeachment inquiry of President Trump, Hill knew that the desperation of forgotten people was driving American politics over the brink—and that we were running out of time to save ourselves from Russia’s fate. In this powerful, deeply personal account, she shares what she has learned, and shows why expanding opportunity is the only long-term hope for our democracy. Fiona Hill is the Robert Bosch Senior Fellow at the Center on the United States and Europe in the Foreign Policy program at the Brookings Institution. From 2017 to 2019, she served as deputy assistant to the president and senior director for European and Russian affairs on the National Security Council. From 2006 to 2009, she served as national intelligence officer for Russia and Eurasia at the National Intelligence Council. She has researched and published extensively on issues related to Russia, the Caucasus, Central Asia, regional conflicts, energy, and strategic issues. Coauthor of Mr. Putin: Operative in the Kremlin and The Siberian Curse: How Communist Planners Left Russia Out in the Cold, she holds a master's degree in Soviet studies and a doctorate in history from Harvard University and a master's in Russian and modern history from St. Andrews University in Scotland. She also has pursued studies at Moscow's Maurice Thorez Institute of Foreign Languages. Hill is a member of the Council on Foreign Relations and lives in the Washington, DC, area.

25. Managing Trafficking in Northern Niger

Trafficking – a catch-all term for illicit movement of goods and people – has long sustained livelihoods in northern Niger. But conflicts are emerging due to heightened competition and European pressure to curb migration. Authorities should persevere in managing the extralegal exchange to contain violence. What’s new? Niger’s informal systems for managing violence related to drug, gold and people trafficking in the country’s north are under strain – due in part to European pressure to curb migration and in part to increased competition over drug transport routes. The discovery of gold could bring new challenges. Why does it matter? Tacit understandings between the authorities and traffickers pose dangers, namely the state’s criminalisation as illicit trade and politics become more intertwined. But the collapse of those understandings would be still more perilous: if trafficking disputes descend into strife, they could destabilise Niger as they have neighbouring Mali. What should be done? Niger should reinforce its conflict management systems. Action against traffickers should focus on those who are heavily armed or engage in violence. Niamey and external actors should reinvigorate the north’s formal economy. European leaders should ensure that their policies avoid upsetting practices that have allowed Niger to escape major bloodshed.

26. Pope Francis: Extending his “Culture of Encounter” into the Arab and Muslim Worlds

In February 2019, Pope Francis became the first pope to visit the United Arab Emirates (UAE). Like John-Paul II before him, he has also visited Egypt, and he went to Morocco in March 2019. The pope participated in a colloquium on “human fraternity” and interreligious dialogue sponsored by the UAE-based Muslim Council of Elders—the brain-child of Sheikh Ahmed el-Tayeb, the grand imam of Egypt’s Al-Azhar, the most important Sunni Muslim university in the world. The Council of Elders sponsors initiatives to engage young Muslims on Islamist ideology by promoting a more “authentic” interpretation of Islam. Islamist violence—with its beheadings and mass executions—has provoked disgust across the Muslim world and is causing young Muslims to become more distant from their imams and mosques. It is becoming clear to many Muslim intellectuals in Egypt, Iraq, and Lebanon that, in order to defeat Islamism, there needs to be greater dialogue and coexistence with Christians. Pope Francis is attempting to lead the way, extending his “culture of encounter.”

Human history is a mixture of positive developments and setbacks, many of them of tragic proportions. Some historical events may have a dramatic and long-lasting im- pact on large groups of people. Sometimes entire nations have suffered the effects of what is referred to as societal, historical, collective or cultural trauma. While such historical traumas have been acknowledged in literature, little is usually done to assist societies or groups that have been affected in dealing, in practical terms, with various symptoms of post-traumatic psychological issues that affect individual members of the group, who, in turn, determine the behaviour of the group as a whole. This paper suggests that survivors of societal traumas, just like people who go through personal tragedies, need help in order to overcome the effects of their experience or face the risk of repeating the cycle of violence, often becoming the perpe- trators themselves. While the focus of this paper is on Polish historical traumas and how they influence the choices made by Polish society today, some observations may be applicable to post-traumatic societal behaviours in general.

Avoiding violent radicalization is one of the great debates and challenges that we find today in Western societies. Although not all radicalization must be linked directly to violence or terrorism, we must prevent a priori radicalization so that it does not lead to the aforementioned processes. In the same way, the implementation of adequate and effective measures to deal with de-radicalization processes is something very necessary. The knowledge of the terminology is of vital importance to understand the meaning, development and reality of the terms presented in this publication, in order to prevent its political manipulation by state and non-state actors.

The Danish Peace and Stabilisation Fund is a prime example of how to combine civilian and military instruments to address conflicts in fragile states. However, there is still room for stepping up synergies of the military-civilian balance in Denmark’s comprehensive conflict management. Recommendations ■ Increase the frequency of formal feedback between the field and the strategic level of the PSF to avoid loss of knowledge. ■ Synergies between civilian and military instruments should take place through complimentary-but-separate interventions. ■ Take PSF instruments into account when planning Denmark’s broader engagement in conflicts to ensure a more comprehensive security policy effort.
