Abstract:
In the aftermath of World War II, the greatest concern facing the United States and its European allies was restraining the Soviet Union and preventing the spread of communism. Cooperation on military security was paramount, and the United States and Europe rose to the challenge by creating NATO, a new type of multilateral defense agreement. Once again, the transatlantic relationship is at a new and perilous crossroads. But now it is economic, rather than military security that is at risk. Crisis grips the economies of Europe, just as the United States, mired in historic levels of unemployment in the wake of the 2008 recession, is rethinking its strategic priorities and place in the world. As before, fears mount concerning the future of liberal democracy and Western capitalism. The question is whether transatlantic cooperation will again rise to the challenge.

As leaders in the United States and Europe prepare for the formal launch of Transatlantic Trade and Investment Partnership (TTIP) talks, the Bertelsmann Foundation and the Atlantic Council have conducted a survey of trade policy experts from the public and private sectors on both sides of the Atlantic to gauge their expectations for the results of negotiations. This policy brief examines the results of this survey and analyzes its policy implications in three possible scenarios. The United States and Europe have discussed a transatlantic free trade area in various guises for decades. But as negotiations for a new Transatlantic Trade and Investment Partnership (TTIP) begin, this time seems different. Both sides recognize the need to stimulate their stagnant economies in the aftermath of the financial and Eurozone crises. In an age of austerity, as debt and deficit problems have led to a major loss of market confidence in the United States and Europe's ability to recover in a sustainable manner, a deepened trade relationship marks a path forward without adding to national debt levels. Furthermore, the rise of the emerging markets—particularly China—which often subscribe to a different economic model focused on state-owned enterprises and government directed investment decisions, marks a historic decision-point for the transatlantic community.

Abstract:
Europe urgently needs to move forward on a number of crucial reforms simultaneously. To face the challenges of the recession, we need better economic integration. The crisis of the Euro zone is not only a debt crisis. What Europe is facing is a multitude of different crises, of which the debt crises in Greece, Cyprus, Spain, and Italy are only a small part. All European countries have accumulated huge debts, their social security models are facing an inevitable demographic challenge of enormous proportions. The conventional crisis management response—austerity—has failed to create a foundation for future economic stability. To survive, Europe needs to rethink the very foundations of its economic policies for a population that is older and a Europe more fractured. Europe needs to open itself up to immigration, foster regulation and integration of financial markets, overhaul social security structures set up decades ago, galvanize productive investment in new post-carbon industries that will create jobs and spur technological innovation, and invest in a security sector that is capable of projecting stability.

184. Judicial Reform in Ukraine: Current Results, Prospects and Risks of the Constitutional Stage

The process of establishing the judiciary in Ukraine since its independence has been quite inconsistent and contradictory – not only due to its heritage, but also because it has often been accompanied by acute political confrontation and attempts of opposing political forces and governmental teams to gain control over the judiciary. Reformation activity that was initiated and implemented in this period did not lead to establishment of an independent and fair court in Ukraine. After the 2010 Presidential Election, the new President Viktor Yanukovych announced that another judicial reform was going to take place, which led to dramatic changes in the national judiciary. Analysis of these changes and their consequences gives reasons to assume that, through this reform, the President managed to enhance his control over judicial authority, to restrict its independence, and to weaken self-government of judges. Significant rotation amongst judges also took place. In general, it has considerably deteriorated judicial situation in Ukraine. Today, the judicial reform has reached its final – constitutional – stage. On 10 October 2013, the Verkhovna Rada pre-approved the Presidential draft Law “On Amendments to the Constitution of Ukraine Strengthening the Independence of Judges”. The corresponding Decree of the Verkhovna Rada of Ukraine was supported by 244 deputies. All opposition factions of the Parliament (Batkivshchyna, UDAR, Svoboda) manifested against adoption of the law claiming that implementation of its provisions would compromise not only the judicial independence, but also the democracy in Ukraine. The course of preparation and adoption of this draft Law (obtaining, inter alia, positive resolution of the Venice Commission) revealed tendencies that have been characteristic of the 2010 judiciary reform since its initiation. Thus, national legislation in the recent years has been using European standards in quite a peculiar way by borrowing the form and filling it up with “appropriate” contents. In fact, what we have now is not an approximation of national laws to international judicial norms and standards, but adjusting these norms to situational needs by using controlled and dependent judiciary in Ukraine. Hence, this is a selective adoption of recommendations and guidelines of international institutions. As it is widely known, the Venice Commission gave a generally positive opinion on the draft Law mentioned above. It was this draft (as well as the resolution of the Constitutional Court of Ukraine and the declaration signed by 30 deputies of the Parliamentary Assembly of the Council of Europe) that the President’s representative and deputies of the Party of the Regions faction mostly relied on when encouraging their colleagues to support pre-approving the bill. Accepting the above-mentioned documents of European institutions we should obviously have some reservations. Firstly, the draft law contains genuine “European” provisions able to deceive European structures that evaluate new laws from their own European perspective. Secondly, current evaluations of the “Ukrainian progress” by European institutions have somewhat enforced nature stipulated by soon-to-happen Vilnius summit and possibly by the Association Agreement to be signed between the European Union and Ukraine at the summit. While mainly stressing its positive progress towards the association, Europe also seeks to maintain Ukraine’s European integration prospects. Thirdly, there are reasons to assume that current authorities have used peculiar means to push its legislative initiatives not only inside (in the Parliament and Constitutional Court), but also outside the country – on the international realm. Preliminary approval of the Presidential draft Law on amending the Constitution has had a dramatic impact on the judicial reform. On the one hand, it has enabled to legitimise the key legislative changes approved in 2010 and to enshrine provisions in the Constitutions, implementation of which may politicise the judiciary to an even bigger extent and increase the dependence of judges. On the other hand, it has generated a political and expert discussion aimed at searching for a compromise, which results might involve the following: excluding the most risky provisions for the independence of judges and courts, at least, and preparing a new bill approved by all key political forces of the country, at best. Current situation calls for ensuring fair and independent justice, as well as stimulates governmental representatives, opposition and the society to look for optimal ways out.

Abstract:
Structural reforms that increase competition in product and labor markets are often indicated as the main policy option available for peripheral Europe to regain competitiveness and boost output. We show that, in a crisis that pushes the nominal interest rate to its lower bound, these reforms do not support economic activity in the short run, and may well be contractionary. Absent the appropriate monetary stimulus, reforms fuel expectations of prolonged deflation, increase the real interest rate, and depress aggregate demand. Our findings carry important implications for the current debate on the timing and the design of structural reforms in Europe.

186. Walking on Water: Religion, Historical Memory and Human Rights in Spain and Australia

Abstract:
The parable of Jesus walking on water occurs in three of the gospels. This parable was used by Imanol Zubero, former Socialist Senator and Basque peace activist, now Professor at the Basque Country University, to describe to me the position of the Catholic Church in Spain today: where once the Church had known how to walk on water and call to the Spanish people to follow it, today the Church has lost its prophetic voice and is in danger of becoming a closed sect. Zubero was referring to the 1970s when the Church played a positive, and widely admired, role in the Spanish Transition to democracy. In this paper I try to account for this change by considering cases from two very different Catholic traditions, Spain and Australia, which have at least one thing in common: in both cases the Church has been accused of responsibility for historical wrong-doing and complicity in human rights abuses.

This short assessment by the Open Society Foundations sets out the main lessons learned from our experience in the region and give ideas on how to enhance the EU’s efforts to strengthen prosperity, stability and security in its neighbourhood.

Europe and the United States—the West—urgently need political leadership, economic fortitude and a clear vision of the future if they are to contend with the challenges posed by emerging regional powers and to resist the downward pressures of 'relative decline', the central focus of David Marquand's book, The end of the West: the once and future Europe. Central to this goal will be the West's ability to 'rebalance' between its institutions and democracy; its power and commitments; and its political and moral authority. Europe must 'rebalance' on issues related to ethnicity and identity, governance and authority, and civilization and territory. EU enlargement and its institutional reform processes have exacerbated this imbalance. American foreign policy objectives currently exceed its resources and are hampered by lack of strategic clarity and intellectual vision which keeps the United States from achieving an adaptive leadership model more capable of successfully operating in an increasingly complex and multipolar world. For Europe to become internally healthy and externally productive—both politically and economically—it needs to regain balance between its utopian, institutional objectives and democratic support for its future ambitions and policy course. Strong leadership and a powerful vision of prosperity from the West will be vital to return the transatlantic partnership to global economic and political advantage.
