BACK TO RESOURCES CITIZENS OF UKRAINE ON SECURITY SURVEY 2016 Abstract This publication presents the results of a nationwide sociological survey conducted by the Razumkov Centre's Sociological Service in the framework of Ukraine's security governance challenges monitoring project, implemented by the Geneva Centre for the Democratic Control of Armed Forces (DCAF), jointly with Razumkov Centre, with support from the Kingdom of the Netherlands. The survey and the publication were made possible through financial support from the Ministry of Foreign Affairs of the Kingdom of the Netherlands. The assessments and conclusions made by the authors do not necessarily coincide with official position of the Ministry of Foreign Affairs of the Kingdom of the Netherlands. The survey was conducted by the Razumkov Centre's Sociological Service on 27-31 May 2016, in all regions of Ukraine, except Crimea and the occupied territories of Donetsk and Luhansk regions. 2,019 respondents aged above 18 years were polled. The sampling error does not exceed 2.3%.

132. Change in Economic Policy Paradigm: Privatization and State Capture in Poland

Abstract:
Piotr Kozarzewski and Maciej Bałtowski analyse the causes and manifestations of Poland’s recent shift in economic policy towards a more active role of the state, and use privatization policy as an example. The authors examine the effects of the privatization policy and point to a large unfinished agenda in ownership transformation that has had an adverse impact on the institutional setup of the Polish state, creating grounds for rent seeking and cronyism, which, in turn, impede the pace of privatization. They find out that it is the increasing capture of the state by rent-seeking groups, and not, contrary to popular opinion, the global financial crisis, that most contributes to the growing statist trends of Poland’s economic policy. 133. Empowered or Disempowered? The Role of National Parliaments during the Reform of European Economic Governance.

This paper investigates how the intergovernmental reform process of European economic governance affected national parliaments’ oversight of this policy area. Which parliaments became disempowered and which managed to secure their formal powers – and why? The dependent variable of the study is operationalized as the presence or absence of “emergency legislation” allowing governments to accelerate the legislative process and minimize the risk of a default by constraining national parliaments’ powers. The paper examines how national parliaments in all eurozone states were involved in approving the following measures: the EFSF (establishment and increase of budgetary capacity), the ESM, and the Fiscal Compact. The findings demonstrate that whereas northern European parliaments’ powers were secured (or in some cases even fostered), southern European parliaments were disempowered due to the following factors: (i) domestic constitutional set-up permitting emergency legislation, (ii) national supreme or constitutional courts’ consent to extensive application of emergency legislation, and (iii) international economic and political pressure on governments to prevent default of the legislative process. Due to significant power asymmetries, national parliaments remained de jure but not de facto equal in the exercise of their control powers at the EU level. As a consequence, both the disempowerment of particular parliaments and the asymmetry of powers among them has had a negative effect on the legitimacy of European economic governance.

134. Constitutional Process: Current Results, Risks and Prospects

The current stage of the constitutional process was initiated by the President of Ukraine Petro Poroshenko in March 2015 with the establishment of the Constitutional Commission.1 Already on 1 July 2015, the Parliament registered the Draft Law of Ukraine “On Amendments to the Constitution of Ukraine – on decentralisation” (Reg. No. 2217a), developed by the Constitutional Commission and submitted by the President of Ukraine. On 31 August 2015, the day this bill was approved, grenades exploded in front of the Parliament on the Constitution Square. The presence in this bill on decentralisation of the controversial Paragraph 18 “Transitional Provisions” did not allow entering the process of final adoption of amendments to the Constitution (on decentralisation) in compliance with requirements of Article 155. On 25 November 2015, the subsequent Bill “On Amendments to the Constitution – on justice” (Reg. No. 3524) was registered in Parliament. In February 2016, the bill was approved, and on 2 June 2016, finally adopted by the Verkhovna Rada of Ukraine. For the first time since the “political reforms” of December 2004, significant amendments to the Constitution of Ukraine were legally introduced. The adoption of a decision by Parliament to amend the Constitution of Ukraine in the part of justice, did not complete the reform of the judiciary. The fact that a number of amendments to the Constitution raised deep concerns among representatives of the expert community, and even more the judicial community, cannot be ignored. However, a number of updated provisions of the Constitution, implemented in effective mechanisms of special laws, are capable of positively influencing the judiciary. In this regard, firstly, the adoption by Parliament of the Law of Ukraine “On Judicial System and Status of Judges” in an unconstitutional way, with a gross violation of the Verkhovna Rada requirements cannot but cause concern. Second, the main content of the implemented law, introduced to the Parliament without obtaining opinions of the Scientific Experts Office or the Venice Commission, or discussing it in the expert community, can cause a real chaos in the process of implementing constitutional changes. The question remains uncertain about the prospects of the Draft Law of Ukraine “On Amendments to the Constitution of Ukraine – on human rights and freedoms” prepared by the Working Group of the Constitutional Commission. The analytical report has summarized theoretical grounds of regulations contained in the draft law. Since the work on the draft amendments to the Constitution was completed by the Working Group, the Constitutional Commission must make a final conclusion as to its readiness for submission to the President, who will decide on the introduction of a relevant bill to the Verkhovna Rada of Ukraine. Both aspects of constitutional amendments were analysed in the study by the Razumkov Centre, which is reflected in the content of the Analytical Report.

Abstract:
Gender mainstreaming [1] of the security sector in Bosnia and Herzegovina (BiH) twenty years ago was perceived as a “foreign” syntagma and proved very difficult to translate into the three official languages (Bosnian, Croatian and Serbian). The challenge was not only translation but also the transposition of that concept into reality. The link between the concept of gender mainstreaming and security sector tasks and responsibilities was a new topic for BiH society as well as globally. As a post-conflict country, in the last twenty years Bosnia and Herzegovina has gone through reforms in different areas such as police, intelligence, justice, etc. Those reforms were intensified in the period from 2003 until 2008 in the framework of the BiH integration process into the European Union and NATO. At that time, neither the BiH political elite nor representatives of the international community were aware of the benefits of the integration of the gender concept in those nor in other reforms in the country. It was women’s organizations that started familiarizing the BiH public with the importance of including and applying the concept of gender in security sector reforms, namely to implement United Nations Security Council Resolution 1325 on Women, Peace and Security (UNSCR 1325).[2] They first gained financial support from the United Nations Development Fund for Women (UNIFEM) and other UN organizations in order to implement different programs and projects. Those efforts, commitments, and the influence of these women’s organizations led to the government at all levels in Bosnia and Herzegovina establishing in 2003 official gender mechanisms such as the Gender Center of Government of Federation, the Gender Center of Government of Republic Srpska and, in 2004, the Gender Equality Agency at the national level. Their establishment came at a crucial moment for the institutionalization of gender mainstreaming in all areas of public and private life in Bosnia and Herzegovina. Only a few years after those gender mechanisms were established they were applied in the drafting of two strategic documents, the Gender Action Plan (GAP) [3] for the period 2006-2013 and an Action Plan for the implementation of UNSCR 1325 in Bosnia and Herzegovina (AP 1325) [4] for a period of three years (2010-2013). Those two documents were not imposed or drafted externally, which was the case with many other documents in Bosnia and Herzegovina from that period. They were produced by the representatives of BiH institutions together with the representatives of NGOs according to local priorities and needs, an important precondition for local ownership and sustainability of the whole process. Because of this, many were hopeful that enacting these documents would have a real and positive effect on the lives of men, women, and children throughout the country. In this article I first give a brief overview of the situation in Bosnia and Herzegovina before those national policy documents were adopted and of the post-adoption period. Second, my intention is to analyze the reasons why the adoption of AP 1325 was perceived as a big success in the country as well as the region and at a global level. Third, because I was personally involved in the implementation of the first AP 1325 on behalf of the Ministry of Security and in the drafting of the second AP 1325, my focus will be on the achievements of the Ministry of Security in the implementation process of AP 1325 as well as my personal experience with gender mainstreaming of the security sector in BiH. Finally, in my conclusion I examine the main lessons learned, current challenges, and present my personal view of how the envisaged goals from the documents can bring meaningful and real change to the daily lives of all people in Bosnia and Herzegovina. The European Union has a unique opportunity to develop a positive strategy towards Ukraine. A pro-EU government is now in power in Kyiv, there is a revived civil society pressing for democratic reforms and the actions by Russia have both reinforced Ukraine's pro-West line and led to the priority given Moscow being questioned by some member states. It is therefore essential to grant Ukraine a membership perspective to strengthen this trend and encourage Kyiv to confront and overcome the basic problems that face the country.

137. Has Sweden injected realism into public financial management reforms in partner countries?

Abstract:
Public financial management (PFM) reform is a common part of many development initiatives. It generally involves promoting "good practices" in developing countries, embedded in frameworks like the Public Expenditure and Financial Accountability (PEFA) assessment (PEFA 2006). These include multi-year budgeting, competitive procurement, modern internal audit, and more. Such practices have proved effective in selected contexts and promise solutions to common problems in governments. Unfortunately, a growing literature shows that many governments do not solve their problems after years of adopting such solutions. Data reveal that governments commonly produce new laws that are not enforced and budgets that are not effectively executed, and suffer from weak capacities in distributed units (like line ministries and local governments) after many finished projects (Andrews 2006, 2011, 2013; Porter et al. 2011; Wescott 2009). Studies tie these limits to a lack of realism in reform design and implementation (Andrews 2013; Andrews, Pritchett and Woolcock 2012; Booth 2011; Levy 2013; World Bank 2012). They argue, essentially, that reforms commonly fail to allow for necessary adaptation of external ideas to the realities in targeted contexts, often because the reform processes focus too narrowly on introducing the external good practice in principle and pay little attention to the practical difficulties of doing so in practice. Studies suggest, for instance, that such reforms pay insufficient attention to the political and administrative difficulties of effecting change, and that these difficulties commonly undermine reform results. Where studies see more effective and far reaching reform they often find that the externally nominated "good practices" are fitted to the targeted context through more adaptive processes that emphasize the real and practical issues of doing reform (like building reform support, testing and adjusting reform designs, and continually matching solutions and capacity realities and needs) (Andrews 2015; Andrews et al. 2014; Cabri 2014; Levy 2013). These studies call for approaches that allow more realism in reform processes in developing countries, especially those supported by multilateral and bilateral donors. They do so knowing that similar calls have been made before; and that there are already many examples of such realism in the development community. There is, however, a challenge to identify these examples and describe what such processes look like in practice. This search leads quickly to a focus on bilateral donors. A small and interesting set of work suggests that such donors might have a comparative advantage in introducing more realism to PFM-type reforms in developing countries, given their own country’s recent experiences with doing such reforms. The argument is simply that development agencies from these countries can leverage the real experiences with doing reform in their own contexts when engaging with reformers in developing countries. They can, for instance, access experienced reformers to share lessons on issues like building demand for change, establishing political support for reform, and adapting reform ideas to context. Such lessons are often learned best through experience and remain tacit in those who have been through the experience. Bilateral agencies arguably have an advantage in accessing such people and their lessons, and can more effectively incorporate this valuable knowledge into their reform support than multilateral agencies. This paper offers a novel analysis of this theory, asking whether Swedish development agencies working in the PFM field have leveraged the potential comparative advantage of the country’s own experience in supporting reform. The country’s own reforms have resulted in effective Sweden-specific adaptations of many of the good practices being promoted in developing countries today (including multi-year budgeting and modern accounting and audit). Academic descriptions of these reforms emphasize the processes by which they were adopted and the realism involved in such, and suggest the presence of many applied and tacit lessons one could see as valuable in developing countries (about testing reform ideas, for example, progressing gradually in reform processes, creating an urgent pressure for change, and building support for reform). The question asked here is whether Swedish development agencies bring these lessons into their support for PFM work, building on a potential advantage to promote realism in reform.

Abstract:
This paper reports the key elements of a closed-door seminar hosted by IAI on 13 October 2015 within the framework of the project Defence Matters 2015. The initiative is aimed at stimulating the Italian debate on defence issues by engaging policy-makers, stakeholders and the public opinion. The seminar, in particular, was devoted to discussing the current threats faced by NATO with regard to both the Alliance’s Eastern and Southern “flanks”. The debate addressed the complexity of the ongoing international dynamics not only in terms of threats, but also of potential opportunities for reforming and modernising NATO. The present report aims at outlining the key points that emerged from the discussion, as well as further stimulating the debate concerning the NATO agenda in view of the 2016 Warsaw Summit.

139. Law Enforcement System in Ukraine: Status, Problems, Prospects for Reform

Abstract:
The year 2013 saw the beginning of a unique period in the history of an independent Ukraine. The victory of the Euromaidan, which seemed to be a successful completion of the Revolution of Dignity, in reality was merely the first step on the path of revolutionary transformation of all aspects in the life of Ukrainian society and state. Security issues are of high priority in the ambitious plans of reforms initiated by the Ukrainian government: “The security vector is our certainty about our tomorrow, being peaceful and happy. It is our certainty of justice and inevitable punishment for each crime. Our certainty that no person is unfairly convicted. The certainty of guaranteed security of investments and property”.1 Guaranteeing the required level of domestic security, primarily the security of a person and a citizen, largely depends on the capability of the law enforcement agencies to perform the functions entrusted to them by national law, and their ability to serve the society and not the government or their own selfish interests. In the system of functions delegated by the state to law enforcement agencies, the policing function has a special role, since the police, in addition to being the most numerous structure, is on the “frontier”, where a citizen may receive protection from, or be persecuted by, the state. For this reason, police reform is receiving considerable attention from the Ukrainian government, society and Ukraine’s international partners. The overwhelming majority of police officers also acknowledge the need for radical change, being dissatisfied with working conditions, level of social security and the negative view of their work on the part of society. Analysis of the current reform efforts leads to the conclusion that, despite the presence of many extraordinary aspects and significant positive differences, they still have many features typical of the prior unsuccessful reform attempts. The most important reasons impeding the implementation of the generally positive declarations and concept documents include the lack of political will as well as the pursuit of political and private ends that have nothing in common with the national interests or international standards. Taking into account our own errors is as important for success as studying the diverse international experience. The lack of coordination of reforms from a single centre, despite the formal presence of the respective structure, inefficient use of the tightly limited resources and attempts to substitute minor changes (restructuring, personnel rotations, name changes, etc.) for a true transformation – all of this has been seen on multiple occasions before. The lack of political will is most often mentioned by experts and community activists looking for answers to the questions why the reforms are advancing so slowly or why the results claimed by the politicians remain hardly noticeable for civilians. Society and the entities being reformed may become more optimistic about the success of the reforms if the Government sincerely demonstrates its interest in developing a European model of the police service, and, most importantly, proves it by real actions. The active participation by community activists, non-governmental organisations, and international partners in the reform processes are important but merely auxiliary factors. The duration and resources of a powerful international support are limited and directly depend on the demonstration of practical results. The analytical report is intended to make an intellectual contribution to the joint effort of developing the Ukrainian law enforcement agencies, whose performance is evaluated not by statistics or the opinion of the government, but by the satisfaction of society with the quality of the respective services, the citizens’ feeling of safety and justice and their level of trust in and respect for those who protect them.

140. Party System of Ukraine Before and After Maidan: Changes, Trends, Public Demand

Mass protests of citizens against the сriminal, authoritarian regime of V. Yanukovych, known as the Revolution of Dignity, with its epicentre the Maidan was to be a turning point in the modern history of Ukraine, These events differed significantly in scale and consequences – from the final enforcement by Ukraine of its geopolitical choice, beginning of practical implementation of the course of European integration through reforms in all areas of public life to Russian military aggression, thousands of casualties and the loss of a part of the national economy and sovereign territory. The events of 2013-2014 had a significant impact on the political system in Ukraine. After the fall of V. Yanukovych’s regime and the former president’s fleeing to Russia, the 2004 Constitution of Ukraine was reenacted. All supreme state institutions underwent renewal. The new President and the Verkhovna Rada were legitimised by special elections and a new Cabinet of Ministers was formed. The process began of reforming the constitutional principles of government organisation in relation to its various branches and levels. Ukraine’s party system, which is an important element of the political system in general, also underwent significant changes. The political parties that belonged to the pro-presidential coalition before Maidan (Party of Regions and Communist Party of Ukraine) were removed from power and actually descended from the political arena. A significant reformatting of the political forces representing the new government took place. This part of the political spectrum is represented both by the “old” (“Batkivshchyna”, “Svoboda”) and the “new” parties that entered the political arena and were formed during Maidan or after it (“Samopomich”, Radical Party of Oleh Lyashko, “Right Sector”, “People’s Front”, Petro Poroshenko Bloc). The post-election period was marked by a heightened struggle not only between the new leading forces and the opposition, but also by competition and conflict between the political forces that in the period from November 2013 to February 2014 had acted as a “unified front”. The drastic changes in the party and political spectrum engendered confusion of the public electoral preferences, especially in the part that did not find any equivalent to their established sympathies among the new parties. There are still some free “political niches”, which can be claimed by new party structures. The data of public opinion surveys demonstrate that those political forces, which were enthusiastically received by society during the early parliamentary elections in October 2014, subsequently started losing their voter support. All this indicates that the party system of Ukraine is undergoing a transformation process, a process that apparently will continue at least until the next scheduled parliamentary elections. However, the development of Ukraine as a democratic European state requires an effective and representative political system, which is impossible without effective, institutionalised political parties.
