These papers will be discussed at a public forum at the United States Institute of Peace on June 25, 2009.

23. Evaluating and Comparing Strategies of Peacebuilding and Transitional Justice

- Following the end of violent conflicts, whether by military victory or negotiated settlement, international actors such as the European Union and the United Nations play an increasing role in peace building, through a range of security, governance, and development activities. These may or may not be mandated by a peace agreement or other formal settlement, and may or may not follow or work in tandem with a peacekeeping mission. International, regional, national, and local actors may work in a more or less collaborative, or coherent fashion. Nonetheless, many of the key challenges of peace building remain the same, and a familiar set of policies and strategies have emerged in contemporary practice to address these. Chief among the challenges of contemporary peace building is that of addressing demands for some form of accountability, often termed transitional justice (discussed in section 3). However, as this guidance paper explains, the demands of transitional justice and its relation to broader peace building activities, involve not just decisions about accountability, but a complex set of policy and institutional choices about security and governance as well. Thus, this guidance paper examines peace building and transitional justice as a set of linked policies and strategies regarding not just accountability, but security sector reform (SSR), disarmament, demobilization and reintegration (DDR) of ex-combatants, and development of the rule of law.

24. Bosnia's Incomplete Transition: Between Dayton and Europe

- While Bosnia and Herzegovina's time as an international protectorate is ending, which is in itself most welcome, now is the wrong time to rush the transition. The state put together by the 1995 Dayton Peace Agreement after a long war will never be secure and able to take its place in the European Union (EU) until it is responsible for the consequences of its own decisions. But tensions are currently high and stability is deteriorating, as Bosniaks and Serbs play a zero-sum game to upset the Dayton settlement. Progress toward EU membership is stalled, and requirements set in 2008 for ending the protectorate have not been not met.

25. Palestine and Israel: Time for Plan B

- The international effort to achieve a two-state solution to the Israeli–Palestinian conflict has come to a dead end, at least for the present. Things can—and might well—get worse unless the United States and other outside actors couple a realistic view of the present with a serious effort to push for a more promising future. The first step in a new diplomatic approach must be to establish a cease-fire that builds on the common interest of both Israel and Hamas to avoid fighting in the short term. A new cease-fire should be clear and perhaps even written; mediators (whether Arab or European) must be willing to make an agreement more attractive to both sides to sustain (Hamas can be enticed by some opening of the border with Egypt; Israel will demand serious efforts against the supply of arms to Hamas). The second step must be an armistice that would offer each side what they crave for the present—Israel would get quiet and a limit on arms to Hamas; Palestinians would get open borders, a freeze on settlements, and an opportunity to rebuild their shattered institutions. Such an armistice must go beyond a one-year cease-fire to become something sustainable for at least five to ten years. Finally, the calm provided by the armistice must be used to rebuild Palestinian institutions and force Palestinians and Israelis to confront rather than avoid the choices before them.

27. The Russo-Georgian War and Beyond: towards a European Great Power Concert

- The brief war between Georgia and Russia in August 2008 provoked vigorous international reactions among the European states as consequence of the sudden shift in the strategic balance. This paper argues for a focus on the great powers France, Germany and Britain as crucial actors for understanding the behavioural reactions towards Russia. It argues furthermore that reactions must be explained mainly from the perspective of experience based on past geopolitics, translating the external pressures into concrete foreign policy: France as promoter of a strong EU as global actor, Germany as bridge builder towards Russia and Britain influenced by Atlanticist commitments. As witnessed by the Russo-Georgian war, the Franco-German axis remains the stable element but backing from Britain is crucial to ensure band-wagoning of the Atlanticist-oriented states in Eastern Europe also in future international crises.

28. Whither the Euro-Atlantic Partnership? Partnership and NATO's New Strategic Concept

- In July 2009, NATO launched a process which should lead to the adoption of a new Strategic Concept. In defining its future referential framework, the Alliance will no doubt dwell on contemporary trends, such as the ever fastening globalisation of international relations and the widening spectrum of threats. In taking such evolutions into account, it would do well in vying for additional flexibility and pragmatism, instead of trying to define a rigid framework of action that would rapidly become obsolete as unforeseen events will constantly call for redirections. The Alliance should fully develop its comprehensive approach so as to interact coherently with international organisations, partner states and civil society. Only thus will it muster wide support for its operations and set up the preconditions for viable exit strategies. In doing so, NATO could build on the assets developed through the Partnership for Peace and its institutional and political framework, the Euro Atlantic Partnership Council. Indeed, EAPC partner nations can contribute a variety of means to secure peace, security and post conflict reconstruction, whose usefulness, not to be measured in terms of military assets alone, should grow as international security challenges take on ever more varied forms. Hence NATO should not dilute a tried and successful PfP/EAPC construct in bundling up all other countries associated in one way or the other with NATO's workings and operations into a one tutti-frutti new Partnership Forum. Instead, NATO should differentiate between different types of partners, all the while focusing more closely on the added value and underestimated opportunities of partnership. Indeed, partnerships should be at the core of NATO's ambitions, and not only be seen as a somewhat burdensome and ambiguous sideshow.

- The future of the Treaty on Conventional Armed Forces in Europe, widely considered to be the cornerstone of European security, was thrown into stark question when the Russian Federation announced in December 2007 that it would suspend its participation in the treaty. The 1990 treaty, considered the most ambitious and far ranging conventional arms control treaty in history, established limits on the numbers of conventional military hardware deployed in Europe, required substantial reductions in conventional arsenals, and created an intrusive regime of inspections and verification. In many ways, the treaty changed the face of European security by establishing new, cooperative political-military relationships.
