Abstract:
El cibercrimen presenta diversos desafíos para la policía, incluyendo la complejidad y globalidad de las acciones criminales, la dificultad de rastrear el ciberespacio y la constante evolución de estas actividades delictivas. A través del marco conceptual de institucionalismo histórico y discursivo, este artículo explora los retos de la policía en la gobernanza del cibercrimen en España. El artículo destaca la importancia de situar la policía en el contexto del sistema de gobernanza de la ciberseguridad para comprender sus desafíos y adaptaciones. A través del análisis de 36 documentos clave, se argumenta que los orígenes y la evolución de las políticas de ciberseguridad se fundamentaron en narrativas centradas en la protección de la información y el incremento de la confianza de la sociedad en las tecnologías digitales, ambas narrativas alejadas del discurso centrado en la ciberdelincuencia. El estudio de caso en España enriquece la literatura sobre gobernanza de la ciberseguridad al explorar cómo la evolución histórica y las narrativas impactan en la posición de los actores involucrados en el sistema de gobernanza.

The review of the constitution emanates from the constitution, from the institute of constitutional review of which the latter is closely related to the dynamic processes in society as well as with the demand for sustainable stability, stability which very well it may be economic, political or social, national or international, the stability that affects even the constitutional order itself in a state. In this article, we will address the constitutional changes, the amendments over the years In Turkey and Russia which are 'proof' of the violation of the constitutional order, 'proof' of the impinging of democracy and stability in the country. Through this article, we will see that the constitutional system, rule of law, democracy or its consolidation, the stability in the country to a large extent are influenced by the way it is conducted the constitutional review process. The application or non-application of this instrument has multi-dimensional effects, negative, destabilizing ones.

Abstract:
For at least three decades now religion has been re-entering the public sphere and politics in Europe and globally. Its re-emergence, however, bears little resemblance to the past when the religion-state coupling was unequivocal. Today, in Europe, the values of freedom of religion and belief, free expression and non-discrimination take precedence over any single religion’s domination – at least that is the prevalent aspiration. In the European neighbourhood, major social and political phenomena have acquired an increasingly religious angle: radicalisation – in the words of Olivier Roy – is becoming Islamised, intra and interstate conflicts have a sectarian character, and governments either want to increase their control over religion or the breakdown of local governance is making religious actors more legitimate representatives than the central government. Within EU member states, religion is resurfacing alongside two simultaneous trends: on the one hand, individualised, atomised urban life that requires more spirituality and a reference point to the realities of modernity and diversity; and, on the other, social polarisation around perceptions of secularisation and religions, particularly Islam. This Joint Policy Study takes an institutionalist view of state-religion relations, although religious institutions are defined in a broad sense and encompass both official and unofficial religion. This leaves the field outside of the institutionalised religion-state relations either relatively small or down to individual expressions of religiosity. Institutionalism, so understood, is a view that policy is carried out through and with institutions. This can vary in different aspects: dependence (state-dependent, statecontrolled, independent of states), size, homogeneity, thematic focus, accountability, credibility, and so on. The chapters in the study aim to provide both more generalised overviews and case studies to cover all levels of state-religion relations in Europe and MENA: relations between state and religious institutions in Europe (chapter 1); relations between state and religious institutions in the Maghreb (Tunisia and Morocco in chapter 3); relations between institutions of different religions (the Vatican and al-Azhar in chapter 4); and the role of Muslim religious institutions in advancing a state policy in an EU member state (Germany in chapter 2).

5. Strong Firms, Weak Banks The Financial Consequences of Germany’s Export-Led Growth Model

Abstract:
The financial foundation of Germany’s manufacturing success, according to the compara- tive capitalism literature, is an ample supply of long-term capital, provided to firms by a three-pillar banking system and “patient” domestic shareholders. This premise also informs the recent literature on growth models, which documents a shift towards a purely export- led growth model in Germany since the 1990s. We challenge this common assumption of continuity in the German financial system. Export-led growth, characterized by aggregate wage suppression and high corporate profits, has allowed non-financial corporations to increasingly finance investment out of retained earnings, thus lowering their dependence on external finance. This paper documents this trend and shows that business lending by banks has increasingly been constrained on the demand side, reducing the power – and relevance – of banks vis-à-vis German industry. The case study suggests a need for students of growth models to pay greater attention to the dynamic interaction between institutional sectors in general, and between the financial and the non-financial sectors in particular.

Abstract:
After a century of an American world order established by U.S. President Woodrow Wilson at the end of the First World War, we are facing a shift in Washington’s global attitude. President Trump’s approach to world affairs is different. Although Obama, and to some extent Bush before the September 11, 2001 terror attacks, was starting to withdraw from the U.S. historical position of key global superpower, President Trump’s approach to world affairs is a much more drastic acceleration of this move. Continuing in this direction means we may soon face a collapse of America’s century-long preeminence, and the creation of a new world order in which the U.S. is no longer leading the global power, but only first among sovereigns, if at all.

7. Words that Hurt (1): Normative and Institutional Considerations in the Regulation of Hate Speech in Europe

Abstract:
Europe is experiencing at present intense dilemmas in regulating hate speech and online harassment. Free speech exercise can be offensive and even contribute to a climate of prejudice and discrimination against minorities. Often, the media exacerbate the tendency by reporting negatively about minorities. The first working paper on this topic engages with the normative dimensions of the balance between the need to control and limit incitement to violence in reconciliation with the fundamental right to freedom of expression. Three distinct aspects of hate speech are covered: the first relates to the role of freedom of expression as a tool of inclusiveness. With the limits of liberal tolerance being unclear, just like the definition of hate speech itself, legal actors and systems are torn between criminalising the speaker’s motive alone or in conjunction with the effects of the speech. A survey of recent related European Court of Human Rights case-law demonstrates these ambiguities. The second aspect covered looks at the challenges of the regulation of the freedom of expression in the digital age, with emphasis of the online dimensions of the phenomenon from a legal perspective. The final aspect of the paper proposes an actor-based analysis of hate speech, as it emerges from the current regulatory frameworks applied. This section deals not only with the role of the State but also with that of equality bodies, political parties and private businesses in providing more efficient networks of protection of minorities from such violent expressions of hatred.

Abstract:
Faced with a piecemeal approach to hate speech in Europe, leading to the reduced visibility of the phenomenon with often serious consequences, a variety of regional and international organisations have contributed legal documents and interpretative recommendations that attempt to guide states in their practice of combating hate speech. The present paper, following up on a previous one, will engage first with the international legal and regulatory framework of hate speech, placing emphasis on the European elements of the system in place. At a second stage, the paper will briefly survey twenty European national systems exposing the variety of regulatory patterns on the issue. Finally, the study will conclude with a list of common observations pertaining to the regulation of hate speech in the European continent, as they have emerged from the comparative analysis of the case-studies.

Abstract:
Environmental issues have been on the international agenda for so long. However, International Relations (IR) theory acknowledged the environmental problem belatedly. When dealing with it, IR theory generally saw this problem as an annex to its central concerns. So, the environment as a research subject is considered either an issue of conflict or of cooperation from the perspectives of realism and liberal institutionalism respectively. By questioning this sort of consideration as a starting point, this article discusses the international environmental problem within the context of complexity and multiplicity of structural contradictions and overlapping and opposing interests of actors. The first section reveals the impasses of mainstream IR theory. The second section explores different aspects of the internationalization of the environment through a critical reassessment of state-centric understandings and problem-solving strategies. The interactions between national and international domains are also argued by employing normative environmental regulations. The last section examines the effects of corporations, states, international institutions and NGOs as main actors on the internationalization of the environment. This examination needs to take into consideration actor-structure relations. In other words, instead of separating politics from economics, and actors from capitalist structures at the domestic and international levels as does mainstream IR theory,

In his opening remarks, Grzegorz Ekiert, Professor of Government at Harvard University and Director of the Minda de Ginzburg Center for European Studies, recalled last year’s inaugural Summit on the Future of Europe. While the security challenge posed by Russia stood at the center of discussions then, Europe’s crisis has broadened in the intervening months: The euro crisis has not been solved. The loss of legitimacy of European institutions has accelerated. A migrant crisis of unforeseen dimensions has shaken the continent. These four challenges make up the crisis that would stand at the center of this year’s Summit.
