Abstract:
Convergence of the Portuguese economy toward the more advanced OECD economies seems to have halted in recent years, leaving a significant gap in per capita incomes. The proximate cause is low labour productivity, as employment rates across the board are substantially higher than the EU average. Nor is there a shortage of capital goods in aggregate. But capital equipment in the business sector is not always efficiently used or allocated, and new technologies are not readily adopted. Furthermore, the Portuguese labour force – even its younger members – have had less formal education than workers in other EU countries, including among the new entrants from Central and Eastern Europe, and workers in Portugal also have less access to training than in many other countries. Traditional Portuguese low value-added highly labourintensive products now face increasing competition from developing countries and from the new EU entrants.

372. European Integration in the Light of the International Relations Theories

Abstract:
This article contends that most of the intellectual work on European integration reflect major dichotomies between the theories of International Relations. During the first few decades of the integration process, the core European integration debate involved idealism-oriented neo-functionalists and realism-oriented intergovernmentalist approaches; whereas the current scholarship on European integration mirrors the main division that has emerged within the discipline of International Relations since 1980's between rationalists regarding the integration process as the products conscious member states' behaviour and constructivists focusing on policy-formation based on norms and common values. The main purpose of this article is to analyse the evolution of European integration within the context of the traditional and contemporary debates of International Relations. Since the sui generis nature of the integration process in the shape of the European Union constitutes a barrier to theorizing efforts in general terms, this article argues that each theory can only explain some pieces of the integration puzzle.

Abstract:
The modernization of the application of the competition law of the European Community (EC) was carried out by the Council Regulation 1/2003 of December 16, 2002. This Regulation has repealed the regulation 17/62 of 16 February 1962 in force for more than 40 years. The Regulation 1/2003 is characterized by the abrogation of the notification and the preliminary authorization and its decentralization attempt for the application of the competition law of the EC. The national authorities and jurisdictions will be qualified from now on in this field by legal exception. Besides various details, the most important aspect of the new regulation is its gradual decentralization of the EC competition law, which should be considered within a broader framework of the reforms on the EC competition law, undertaken in the second half of 1990's.

Pro-Moscow security agencies in Chechnya won a major victory on March 7 with the surrender of Magomed Khambiev, minister of defense in the underground separatist government of Aslan Maskhadov. Many, though not all, reports of this event in the Russian media have failed to mention the key tactical method by which this victory was apparently achieved: The systematic targeting, kidnapping and torture of the Khambiev family's relatives.

375. Financial Conglomerates: The Future of Finance?

In 1999, after nearly twenty years of debate, the U.S. Congress finally passed legislation permitting bank affiliations with all sorts of other financial enterprises, and vice versa. In this step, the United States joined many other countries — especially in Europe and, more recently, Japan — in allowing the operation of financial conglomerates. But are financial conglomerates the wave of the future in finance? And if so, how are they to be regulated? These were the two central questions addressed in the fifth annual conference of the Brookings-Wharton Papers on Financial Services, an annual volume published by the Brookings Institution Press. The conference, held in October 2002 in Washington, D.C., convened financial services experts from around the world. The papers presented at the conference suggest, generally, that while the future may see more financial conglomerate activity than it has in the past, there still will be a role for specialist, or "monoline" financial companies. As for regulation, there is no settled model: some nations will pursue consolidated supervision, with authority over entire conglomerates vested in a single authority (often the central bank), while others will still regulate the pieces of diversified financial enterprises along structural lines.

Global economic growth and personal freedom are under attack by governments and international organizations seeking to squelch financial privacy and tax competition. Privacy rights and international tax competition are beneficial constraints on the monopoly power of governments. But high-tax nations and organizations such as the European Union are pressing for international agreements to remove those limits on government power at the expense of prosperity and freedom.

Abstract:
With the creation of EMU, European Welfare States have entered a new phase of development. The margins for manoeuvring public budgets have substantially decreased, while the unfolding of the four freedoms of movement within the EU have seriously weakened the traditional coercive monopoly of the state on actors and resources that are crucial for the stability of redistributive institutions. The article explores these issues adopting a Rokkanian perspective, i.e. building on Rokkan's pioneering insights on the nexus between oundary building and internal structuring.

378. Georgia: What Now?

Georgia's political crisis, which climaxed in the forced resignation of President Eduard Shevardnadze on 23 November 2003, is not over yet and could still lead to violence and the country's disintegration. Georgia, in other words, is still pre-conflict, not post- conflict, and exceptional international action is required to contain the potential for chaos. Washington, which quietly supported what U.S. media called the “Rose Revolution”, has promised aid for organisation of the presidential election on 4 January 2004, as has the European Union; other donors should follow suit, and the international community should maintain this support through the equally important and potentially more contentious legislative elections in the spring.

379. Executive Leadership and the Role of “Veto Players” in the United States and Germany

Abstract:
In recent comparative works on the constitutional structures of contemporary liberal democracies, the United States and Germany have been grouped together as examples of democratic systems with an exceptionally high degree of “institutional pluralism”. In other typologies both countries have even been classified as “semisovereign democracies”. Whereas such classifications are of some use, especially in the field of public policy research, they fail to pay reasonable attention to the fundamental difference between parliamentary and presidential government that dominated the older literature on comparative political systems. As the comparative assessments offered in this paper suggest, the difference between parliamentary government and presidential government does not only constitute very different conditions of executive leadership in the core executive territory and at the level of executive-legislative relations, but has also a strong impact on the role and performance of the various “veto players” that characterize the political systems of the United States and Germany, and which are at the center of this paper.

380. European Corporate Governance Reform and the German Party Paradox

Abstract:
This paper addresses the current discussion on links between party politics and production regimes. Why do German Social Democrats opt for more corporate governance liberalization than the CDU although, in terms of the distributional outcomes of such reforms, one would expect the situation to be reversed? I divide my analysis into three stages. First, I use the European Parliament's crucial vote on the European takeover directive in July 2001 as a test case to show that the left-right dimension does indeed matter in corporate governance reform, beside cross-class and cross-party nation-based interests. In a second step, by analyzing the party positions in the main German corporate governance reforms in the 1990s, I show that the SPD and the CDU behave “paradoxically” in the sense that the SPD favored more corporate governance liberalization than the CDU, which protected the institutions of “Rhenish,” “organized” capitalism. This constellation occurred in the discussions on company disclosure, management accountability, the power of banks, network dissolution, and takeover regulation. Third, I offer two explanations for this paradoxical party behavior. The first explanation concerns the historical conversion of ideas. I show that trade unions and Social Democrats favored a high degree of capital organization in the Weimar Republic, but this ideological position was driven in new directions at two watersheds: one in the late 1940s, the other in the late 1950s. My second explanation lies in the importance of conflicts over managerial control, in which both employees and minority shareholders oppose managers, and in which increased shareholder power strengthens the position of works councils.
