Abstract:
In this study the author analyzes the experience of the European Union in cooperation with non-member neighboring countries, to which the EU’s integration process and institutions are both available. On the one hand, several non-member countries are interested in close cooperation or integration with the organization because of their future membership aspirations or simply because they consider the EU an important economic and political partner. On the other hand, the EU itself is also interested in building such close relations, for economic but often also for geopolitical and security reasons.

2132. Demand-driven innovation policies in the European Union

Abstract:
The objective of the PICK-ME (Policy Incentives for Creation of Knowledge – Methods and Evidence) research project is to provide theoretical and empirical perspectives on innovation which give a greater role to the demand-side aspect of innovation. The main question is how can policy make enterprises more willing to innovate? This task is fulfilled by identifying what we consider the central or most salient aspect of a demand-side innovation- driven economy, which is the small and entrepreneurial yet fast growing and innovative firm. We use the term “Gazelle” to signify this type of firm throughout the paper. The main concern of policy-makers should therefore be how to support Gazelle type of firms through various policies. The effectiveness of different policy instruments are considered. For example, venture capitalism is in the paper identified as an important modern institution that renders exactly the type of coordination necessary to bring about an innovation system more orientated towards the demand side. This is because experienced entrepreneurs with superior skills in terms of judging the marketability of new innovations step in as financiers. Other factor market bottlenecks on the skills side must be targeted through education policies that fosters centers of excellence. R&D incentives are also considered as a separate instrument but more a question for future research since there is no evidence available on R&D incentives as a Gazelle type of policy. Spatial policies to foster more innovation have been popular in the past. But we conclude that whereas the literature often finds that new knowledge is developed in communities of physically proximate firms, there is no overshadowing evidence showing that spatial policies in particular had any impact on generating more of the Gazelle type of firms.

2133. EU – NATO Relations in The Western Balkans

Abstract:
This paper will outline past examples of successful cooperation in relevant operations (that is, in meeting security issues on the continent) in the western Balkans, and show the implications this has in moving forward. In doing so, the initial international response to the breakup of Yugoslavia will briefly be reviewed, and the subsequent involvement of NATO and Europe to these conflicts in the 1990s. This leads to US/NATO efforts that finally brought the warring parties to the table, and Europe’s increasing involvement as NATO phased out its operations. The evolution of institutional and operational dynamics of cooperation between the EU and NATO will then be examined before focusing on this relationship in regards to the western Balkans, and the impact it has had on the region —both positive and negative —to date. The paper will conclude with the lessons drawn and the implications for EU and NATO relations’ moving forward, as conflict once again has emerged on the European continent.

2134. Pioneers of a European Diplomatic System: EU Delegations in Moscow and Washington

Abstract:
Since December 2009, the European Union has been represented abroad by more than 130 delegations, which are an integral part of the new European External Action Service (EEAS). This paper explores the performance and potential of the delegations in contributing to a common EU foreign policy. The delegations have to strike the right balance between performing the functions of traditional diplomatic missions, while also representing the EU as a political entity that is more than an international organization, but less than a state. The delegations act as a bridge between nascent EU diplomacy and the national diplomacies of the member states. They are also microcosms that gather together under one roof different elements of the EU’s external relations, ranging from the Common Foreign and Security Policy to trade and aid, energy and migration. The delegations have been rather successful in their three main tasks: representing the Union towards third countries, coordinating and providing services to the member states, and contributing to EU policy-making. This paper focuses on two key locations, Moscow and Washington, where the delegations are becoming visible diplomatic actors providing added value to member states as well as EU institutions. The authors argue that, following on from an early albeit cautious success, the delegations should take a stronger role in providing input into EU policy-making, promoting European interests abroad, and advancing consensus among member states’ representatives in the field. The EEAS headquarters should build a stronger link to the delegations, through more active political steering and by endeavouring to make more systematic use of the work on the ground.

2135. Not Another Transnistria: How sustainable is separatism in Eastern Ukraine?

Abstract:
The situation in Eastern Ukraine is often compared with that of Transnistria, the separatist region of Moldova. However, the two cases differ for a number of reasons, all of which will make the “Novorossiya” project much harder for Russia to sustain than Transnistria. First and foremost, unlike Transnistria, the Donetsk and Luhansk People’s Republics in their current shape will be unable to influence the everyday political and economic functioning of Ukraine. Vis-à-vis the rest of Ukraine, they are much smaller than Transnistria is in relation to Moldova. The main energy pipelines leading to Ukraine do not cross the separatist territories, and with the economic ties getting severed, the main instrumental function of a frozen conflict – namely to constantly influence and destabilize the target country – is likely to be lost. There are also several other factors, including: the lack of ethnic, national, linguistic or cultural background that would provide identity foundations for the Novorossiya project; the reliance of the separatists on the continuous, massive presence of the Russian military; the damage already inflicted on Russia’s international reputation; the effect on Russian domestic politics; the need for considerable financial assistance from Russia to the separatist territories; and the risk of increasing soft security challenges directly affecting Russia. In addition to all this, it cannot be guaranteed that the separatist elites will always be fully obedient to the will of Moscow. The a priori readiness to defend and support the action of the local authorities will limit Moscow’s room for maneouvre. Costly both politically and economically, the Novorossiya project is able to serve the Russian strategic objectives vis-à-vis the rest of Ukraine much less than Transnistria was able to do so vis-à-vis Moldova. Hence, one probable scenario is a further escalation of hostilities to expand the separatist-controlled territory, which may unfold relatively soon. However, in the medium term, the gradual restoration of Ukraine’s constitutional order in the territory should also be considered possible, within the framework of a larger international compromise and provided that reforms progress in Ukraine.

Abstract:
This paper asks under which conditions the state-building efforts of external actors in areas of limited statehood are likely to be effective. We argue that the legitimacy of the specific norms promoted by external actors among local actors is crucial for their success in strengthening state capacities. International norms need to resonate with the dominant domestic discourse on political reforms. To substantiate our argument, we focus on the European Union’s (EU) anti-corruption programs and their implementation in one of the most corrupt regions in the world, the Southern Caucasus. We show that legitimacy can explain why the EU’s fight against corruption helped reduce corruption in Georgia but not in Armenia. In both countries, political elites could selectively use anti-corruption programs as an instrument against political opponents using enhanced state capacities to stabilize the incumbent regime. Only in Georgia, however, the fight against corruption was facilitated by sustained domestic mobilization for anti-corruption policies that added pressure on political elites ‘from below.’

There is a risk that no concrete steps will emerge from consultations and discussions in the European Commission and Council on how to protect the EU’s fundamental values within its member states. The European Commission could take two initiatives to improve compliance with fundamental rights, democracy, and the rule of law by its member states. Namely, to reintroduce country-monitoring and develop a fundamental rights litigation strategy. These measures would not require the introduction of new legislation or amendment of the EU treaties. Rather, they could be put into effect within a short timeframe through informal changes in internal policy by the institutions and inter-institutional agreements. This policy brief explores the legal and practical feasibility of these two initiatives with the goal of informing EU member state diplomats and Commission officials during their ongoing discussions on how best to protect fundamental rights in Europe.

The Charter of Fundamental Rights of the European Union is a legally binding document that contains a list of human rights recognised by the European Union (EU). It could become a powerful tool available to influence policy makers or serve as a basis for litigation. Individuals can use judicial and political mechanisms to hold EU institutions, and in certain circumstances member countries, to account when they fail to comply with the Charter. The Charter can also be used to pressure decision makers to bring policies and legislation under development in line with human rights standards. This background paper explains when and how the Charter can be used by advocates at national and EU level.
