Abstract:
After three years of limited discussion, the leaders of France, Germany, Russia and Ukraine renewed their peace talks to resolve the separatist conflict in Eastern Ukraine (Donbas). Efforts to facilitate a peaceful resolution to the conflict in the Donbas began five years ago with the meeting of the Trilateral Contact Group on Ukraine. This framework, developed by the Organization for Security and Co-operation in Europe (OSCE), attempted to facilitate a dialogue between Russia and Ukraine through the mediation of an impartial actor, and it culminated in the Minsk I (September 2014) and then Minsk II (February 2015) agreements. The Minsk II agreements comprised a 13-point peace plan, chief among which is an arrangement specifying support for the restoration of the Ukrainian-Russian border. While the implementation of the military portions of the Minsk II agreements were finalized within three months of signing, the political and security portions remained unresolved. Though President Vladimir Putin has declared his intent to protect the Russian-speaking peoples of the region, he has also stated he has no interest in reclaiming Eastern Ukraine. Not surprisingly, since Russia’s ultimate goal is undeclared, the conflict has proved very difficult to resolve.

Abstract:
The existing literature on state-building has focused mainly on post-conflict cases and ‘conventional’ examples of statehood, without taking into consideration the particularities of states that remain internally and/or externally contested. The EU’s engagement in Palestinian state-building through the deployment of EUPOL COPPS and EUBAM Rafah has generated various types of unintended consequences: anticipated and unanticipated, positive and negative, desirable and undesirable, some of which fulfill and some of which frustrate the initial intention. These have important reverberations for the EU’s conflict resolution strategies in Israel and Palestine, the most important being the strengthening of power imbalances and the enforcement of the status quo.

Abstract:
Over the last 40 years, since the 1979 Israel-Egypt peace treaty (that alluded to but did not solve the Palestinian question) and the European Community’s 1980 Venice Declaration, Europe has been seeking ways to help advance Israeli-Palestinian peace. The task was not an easy one, mostly due to United States of America (US) dominance of peace negotiations and negative Israeli attitudes towards Europe as a mediator. Thus, while Europeans were key in shaping international language on the conflict, they have remained in the back seat when it comes to shaping dynamics on the ground. Since the collapse in 2014 of the John Kerry initiative to advance the peace process, the task has become even more difficult for the Europeans. Realities on the ground, such as a right-wing government in Israel lacking interest in advancing a peace process, expanded settlement construction, as well as the internal Palestinian split and governance deficiencies in the Palestinian Authority, make the two-state solution ever more difficult to achieve. In addition, Israel’s leadership has worked to weaken and divide the EU in order to limit its role on the issue. In this endeavor, it has profited from different interests and priorities among EU Member States as reflected in discussions and decision-making processes regarding the Israeli-Palestinian conflict. These trends have increasingly intensified in recent years, and it is the goal of this publication to analyze them, assess their impact on European capacities and policies, and devise recommendations to tackle and perhaps even reverse them. The publication includes three analytical chapters focusing on internal European dynamics, on Israel’s foreign policy towards the EU, and on EU policy-making regarding the Israeli-Palestinian conflict/peace process.

4. The Extraordinary Gamble: How the Yugoslav Tribunal’s Indictment of Slobodan Milošević During the Kosovo War Affected Peace Efforts

Abstract:
On 24 May 1994, the International Criminal Tribunal for the former Yugoslavia (ICTY or Yugoslav Tribunal) made history by becoming the first international court to indict a sitting head of state: Yugoslav President Slobodan Milošević. Since Milošević’s rise to power roughly a decade before, forces either directly or indirectly under his control had unleashed a reign of terror first in Croatia, then in Bosnia and Herzegovina, and finally in Kosovo. Indicting Milošević was no small feat: he did everything in his power to cover his tracks. Moreover, in order to secure crucial evidence (e.g., intelligence and satellite imagery linking Serb forces to crime sites) and the support necessary to actually put Milošević on trial, the ICTY required the backing of Western powers, which—until the Kosovo War in 1999—viewed Milošević as a vital, yet unsavory guarantor of peace in the region. Reactions to the indictment were mixed. While the Yugoslav Tribunal’s supporters heralded the indictment as a legal triumph that brought Milošević to his knees, its critics emphasized that, at best, the indictment was irrelevant and, at worst, an extraordinary gamble that had the potential to thwart an end to hostilities.

Abstract:
The countries of Southeast Europe contain numerous ethnic groups that are united by shared geography but divided by language, history, and culture. These nations are located at the crossroads of Asia and Europe, and, for centuries, were subjected to Turkish invasion, Austro-Hungarian resistance, Russian Pan-Slavism, Venetian culture along the Adriatic coast, and the respective weights of Islam, Roman Catholicism, and the Eastern Orthodox Church. Melding these groups into the state of Yugoslavia at the 1919 Versailles Peace Conference proved only a temporary solution: with the death of Yugloslav President Josip Tito in 1980, the fractionating forces became dominant, and by 1991, Slovenia, Croatia, Macedonia, and Bosnia were each struggling to secede or survive against a Serb-dominated Serbia-Montenegro.

Abstract:
The paper takes as starting point the call by President Vucic of Serbia for a dialogue on the future of Kosovo with a view to reaching a historic agreement between Serbs and Albanians that would help his country deal with the Kosovo issue and would make it possible for it to secure a future in the European Union. The author attempts an assessment of various efforts for settling the dispute between Serbia and Kosovo, including the Ahtisaari Plan of 2007 and the Brussels Dialogue between Belgrade and Pristina currently going on, and tries to clarify some ambiguities and misunderstandings still prevailing about basic parameters of the conflict and of the European integration of the two sides. An analysis of the principles set by Mr. Vucic to guide the debate between Serbs and Albanians, namely that (a) Serbia does not covet what doesn’t belong to her and will not relinquish what belongs to her, and (b) the protection of the Serbian religious and cultural heritage in Kosovo is of paramount importance to Serbia, leads to the conclusion that the envisaged agreement should have (a) Serbia recognize that it does not own Kosovo’s statehood, which rightfully belongs to Kosovo, and (b) Kosovo accord an exceptionalism status to the Serbian religious and cultural heritage in its territory. The author further argues that the ideal agreement between the two sides turns out to also be a possible one.

Abstract:
This article investigates whether international law prohibits the prosecution of children for war crimes and, if it does not, whether it should do so. In particular, the interplay between restorative and retributive post-conflict justice mechanisms, on the one hand, and juvenile rehabilitative justice mechanisms, on the other, is discussed in detail. The article suggests that in certain, narrow, circumstances children having committed war crimes should be prosecuted.

10. Europe’s Return to UN Peacekeeping in Africa? Lessons from Mali

Abstract:
In a break from recent tradition, European member states are currently contributing significant military capabilities to a United Nations (UN) peacekeeping operation in Africa. Europeans are providing more than 1,000 troops to the UN Multidimensional Integrated Stabilization Mission in Mali (MINUSMA) by staffing a wide range of operations including an intelligence fusion cell, transport and attack aircraft, and special forces. Yet for European troop-contributing countries (TCCs) that have spent several years working in North Atlantic Treaty Organization (NATO) operations in Afghanistan, participating in a UN mission has been a process of learning and adaptation. For the UN, the contributions of key capabilities by European countries have pushed the UN system to adjust to the higher expectations of the new European TCCs, which has proved difficult in Mali’s complicated operating environment and political situation.
