11. Covid-19 bends the rules on internal border controls: Yet another crisis undermining the Schengen acquis?

Abstract:
Free movement within the Schengen Area has been challenged in recent years by national measures: from internal border checks after the ‘migration crisis’ to the closure of borders in the Covid-19 crisis. This is the first time in the history of Schengen that member states have categorically refused entry to other EU citizens who are not registered residents or cross-border workers. Seventeen Schengen countries have submitted a notification on reintroducing internal border control due to Covid-19: Austria, Belgium, Czechia, Denmark, Estonia, Finland, France, Germany, Hungary, Iceland, Lithuania, Norway, Poland, Portugal, Slovakia, Spain and Switzerland. The use of Schengen provisions was creative: 12 states justified their internal border controls as a case requiring immediate action (Art. 28), France and Denmark expanded their already existing internal border controls (Art. 25), Finland appealed to the ‘foreseeable event’ clause (Art. 25), and Slovakia and Poland introduced ‘healthcare-police measures’ (Art. 23) before launching border controls (Art. 28). The crisis illustrates the need to reform Schengen in order to maintain the legitimacy of commonly agreed rules.

Abstract:
Dans le Tableau de bord d’Europe centrale et orientale et d’Eurasie de 2009, nous écrivions que les pays de l’Europe centrale et orientale étaient « touchés mais pas coulés » par la crise mondiale. Quatre ans après, ce diagnostic est toujours valable. Si l’Union européenne reste pour eux un idéal et si l’adhésion à cette union demeure un projet clairement balisé pour les Etats qui n’en sont pas encore membres, celle-ci, engluée dans ses contradictions, paraît trop souvent absente, silencieuse. Aux populations qui lui demandent un meilleur niveau de vie et plus de justice sociale, elle répond par des exigences de réformes et d’austérité et alimente ainsi dangereusement leurs désenchantements. Savoir leur répondre, c’est le défi majeur de l’Union européenne aujourd’hui. Les pays de l’Eurasie, s’ils sont moins directement touchés par la crise de la zone euro et conservent, en conséquence, une croissance nettement plus élevée, ont d’autres préoccupations. Fortement sollicités par la Russie qui entend consolider sa zone d’influence avec la concrétisation de l’Union économique eurasiatique, ils sont aussi l’objet de l’attraction qu’exerce sur eux l’Union européenne – comme en témoignent éloquemment les évènements survenus en Ukraine – et, de plus en plus, la Chine. Cet espace est donc actuellement dans une recomposition qui conditionne les possibilités de son développement.

Abstract:
ICDS researchers Kaarel Kaas and Merle Maigre have completed a Policy Brief with recommendations and suggestions for Estonia’s engagement with the EU’s Eastern Partnership. The European Union’s Eastern Partnership establishes a new political instrument for the promotion of democracy and economic reforms in the EU’s eastern neighbourhood. Since the war in Georgia in August 2008 and the gas crisis in the winter of 2008/2009, it has become clear that the developments in Ukraine, Moldova, Belarus and the South Caucasus have a direct impact on the security of the EU and Estonia, as well. It is, therefore, in the interests of Estonia to provide maximum support for our eastern partners in their reform efforts and convergence with the EU.

15. Monitoring the EU Accession Process: Judicial Independence

Abstract:
The EU Accession Monitoring Program of the Open Society Institute was initiated in 2000 to encourage independent monitoring of the process by which the European Union is considering applications for membership from the ten candidate States of Central and Eastern Europe. The Program aims to contribute to this historic process by producing monitoring reports to complement the evaluations already being conducted by the European Commission, as reflected in its annual “Regular Reports” on candidate States’ progress towards meeting accession criteria. The enlargement of the European Union is a positive development, and independent monitoring is one means of magnifying its beneficial effects, both within the candidate States and in the EU itself.
