21. Denmark as a New Security Actor in the Gulf of Guinea: Reconciling international priorities with local needs

Abstract:
In December 2018, Denmark published a new priority paper guiding its future engagement in the Gulf of Guinea to combat piracy and other types of maritime crime. Against such background, this DIIS report presents the main challenges to maritime security in the region and maps the actors and activities addressing it in order to draw out the role that Denmark should play in this context. The report shed light on the regional and international strategies and interventions that are at play at a time when Denmark is a relatively new actor in the process of defining its role in the region’s maritime security infrastructure. As such, the report offers Denmark three sets of pointers for how to prioritise its activities in the Gulf of Guinea: ■ Regionalise engagement by promoting local ownership ■ Focus on the ‘in between’ by enhancing coordination and deconfliction ■ Look landward by strengthening legal structures

Abstract:
A common refrain in Denmark is that China is too far away to be a threat to Danish economic, foreign and security policy interests. This is no longer the case. Danish policy-makers acknowledge that China’s rise as a global superpower presents Denmark with new challenges. However, transforming this strategic thinking into practice is no simple task. Recommendations Intensify cooperation between the Ministries of Defense and Foreign Affairs to ensure Denmark’s initiatives in foreign policy, security and economic relations with China are more closely integrated. Beware of the bilateral. Beijing’s new assertive foreign policy and US-China strategic competition require that Denmark leverage its interests increasingly through the EU, NATO and other multilateral bodies. Assess the economic vulnerabilities of Danish industries in China and diversify trade and investment across Asia’s emerging markets and developed economies in the G7/EU.

23. Supporting Political Stability by Strengthening Local Government: Decentralization in Ukraine

Abstract:
The government that followed the 2014 Maidan revolution in Ukraine has pushed a decentralisation agenda. After decades of Soviet style top-down governance, the status and role of local governments – hromadas – has been pushed to the fore. If implemented successfully, it could increase local development and political engagement, ultimately contributing to increased political stability in Ukraine and Europe. Yet the significance of decentralization reforms is often lost in the noise surrounding Crimea, the secessionist conflict in the east, and the political power struggles in Kiev. For legal reasons, the current decentralisation process is ‘voluntary’, with local communities having to agree to the changes. This has introduced unintended challenges, but also a bottom-up political dynamic to the process. At the same time, uncertainty and opposition to decentralisation reforms remain, perhaps understandable given a rapidly shifting political and legal landscape, the diverse political and personal interests involved, and the fear of political fragmentation that could benefit Russia. Denmark is one of several EU countries supporting the reform process. This DIIS Report focuses in on the processes unfolding in local communities and political arenas, affecting peoples’ lives, their hopes, and their relationship to the state from local to national level.

24. Europe and the Sahel-Maghreb Crisis

Abstract:
In this new DIIS report senior researcher at DIIS, Rasmus Alenius Boserup and Research Director at Sciences Po, Luis Martinez, analyse how European policy-makers have recently come to perceive the Sahel as a threat to Europe’s own security and stability. Marking the end of the Sahel-Maghreb Research Platform – a research project funded by the Danish Ministry of Foreign Affairs and hosted by DIIS in collaboration with Voluntas Advisory – the report draws on input and analysis provided by an international team of experts and scholars associated to the project. Focusing on the most significant recent developments with trans-national jihadism and cross-border migration, the report argues that, although European powers spearheaded by France have succeeded in reducing a number of the most immediate threats to the survival of states and societies in some of the most vulnerable parts of the Sahel, the international community has failed to generate the conditions that would foster long-term peace and development. Hence, the report suggests that the European powers should look for ways to inject life into the strategic objective of bringing the North African powers into play when attempting to solve the crisis in the Sahel.

Abstract:
The Danish Peace and Stabilisation Fund is a prime example of how to combine civilian and military instruments to address conflicts in fragile states. However, there is still room for stepping up synergies of the military-civilian balance in Denmark’s comprehensive conflict management. Recommendations ■ Increase the frequency of formal feedback between the field and the strategic level of the PSF to avoid loss of knowledge. ■ Synergies between civilian and military instruments should take place through complimentary-but-separate interventions. ■ Take PSF instruments into account when planning Denmark’s broader engagement in conflicts to ensure a more comprehensive security policy effort.

26. The "Moving Geography": Why are Scandinavian countries increasingly interested in the Middle East?

Abstract:
The dynamics of the Middle East region have gained special attention from the three Scandinavian countries (Norway, Sweden and Denmark) over the past years. There are numerous indicators for this rising level of interest. The most prominent of which are the establishment of institutes for dialogue and cooperation, launching programs for the Danish-Arab partnership, opening Middle East studies center in a Swedish university, and hosting a new round of dialogue for the parties to the Yemeni conflict. Other indicators include providing funds to support future local elections in Libya, supporting non-governmental organizations aimed at assisting internal displaced persons and refugees through local integration or resettlement, and increasing financial incentives for refugees, who return to their home countries. There are various motives behind the Scandinavian interest in the region, including curbing refugee flows, preventing terrorist attacks, containing the threat of extremism, and confronting the Iranian threat.

Abstract:
This year's volume presents the official outline of Denmark's foreign policy in 2012 by Claus Grube, Permanent Secretary of State for Foreign Affairs. Besides that Ravinder Kaur contributes with the first academic inquiry into the causes of the Danish-Indian diplomatic deadlock in the extradition case concerning Niels Holck (the prime accused in the Purulia arms drop case). Mette Skak addresses the role of the emerging BRICS powers (Brazil, Russia, India, China, and South Africa) in Danish foreign policy and offers her policy recommendations. Hans Branner shifts to a diachronic perspective. In his article about Denmark 'between Venus and Mars' he stresses elements of continuity in Danish foreign policy history; activism is not solely a post-Cold War phenomenon. Derek Beach turns to the scene of the current European economic crisis, analysing and interpreting the Fiscal Compact agreed during the Danish EU Presidency.

Abstract:
The Permanent Secretary of State for Foreign Affairs analyses Danish foreign-policy priorities in 2011. The troublesome situation for the global econ-omy, including an uncertain outlook for the future, was the most impor-tant backdrop for Danish foreign policy in that year. Low growth prospects, combined with high levels of public debt, had wide foreign-policy implica-tions, amongst other things for the agenda of the EU and as a result also for the preparations for the Danish EU Presidency in the first half of 2012. This article therefore takes its point of departure in the state of the global economy, the state of the European economies and the challenges that this presented to the EU. It then goes on to discuss the emerging world powers, the Arab Spring, the world's conflict areas, security policy, Denmark's north-ern neighbours and various global issues, such as development cooperation, green growth and human rights. Finally, some reflections are offered on the core tasks of the Danish Ministry of Foreign Affairs at a time when there is increased pressure on Denmark's public finances and the world influence of Denmark's traditional partners and allies is waning.

This paper will touch upon developments in bilateral relations between Denmark and Turkey and the conditions for Turkey's accession process to the EU in light of the 2012 Danish presidency. While Danish-Turkish relations have been hurt by recent events, such as the political disputes over freedom of speech and the press surrounding the Cartoon Controversy and the Roj TV Affair, at the same time Turkey's stalled negotiation talks with the EU amid freedom of expression issues, human rights concerns, and the unsolved Cyprus dispute have not effectively moved forward since 2010. As a result, the six-months Denmark presidency, preceding the Republic of Cyprus during the second half of 2012, has both demonstrated willingness for closer dialogue and continued EU integration of Turkey and given a genuine gesture towards improved bilateral ties.

30. Legal order free of pillars: European Courts' jurisdiction in the post-Treaty of Lisbon setting

Abstract:
From the legal point of view, the most important change ushered in by the Treaty of Lisbon concerns the scope of the jurisdiction of the Court of Justice of the European Union. This was widened due to the dismantling of the pillar structure. As a general rule, the jurisdiction of the European Courts now covers previous third pillar matters as well, namely criminal law and police co-operation. The dismantling of the pillar structure did not, however, affect the Common Foreign and Security Policy. The Union Courts still do not have jurisdiction in this area. This rule has two important exceptions. Although the Area of Freedom, Security and Justice is communitarised and more coherent than before, the previous limits in its territorial scope, namely the opt-outs of the UK, Ireland and Denmark, did not disappear, so limits in the Courts' jurisdiction remain. The Treaty of Lisbon amendments did not change the fundamentals of the judicial doctrines, such as the direct effect and primacy of European Union law. Importantly, the application of these doctrines was widened instead, owing to the depillarisation. The Treaty of Lisbon amendments meant that the decisions of the European Council and European Union bodies, offices and agencies can be reviewed under the preliminary ruling procedure. The Treaty of Lisbon changed the much-debated criteria for the standing of non-privileged applicants in actions to review the legality of the European Union acts.
