Abstract:
Este artículo analiza la fase de formulación veredal de los Programas de Desarrollo con Enfoque Territorial (PDET), desde el enfoque crítico del giro hacia lo local y aporta evidencia empírica sobre el papel de los actores comunitarios que conforman lo local en dicho proceso. El análisis se enmarca en la literatura académica nacional e internacional sobre construcción de paz, que busca resaltar la importancia de la participación comunitaria en los procesos e iniciativas que tienen como objetivo la construcción de escenarios de futuro compartidos en los cuales la violencia no sea la protagonista. La pregunta de investigación es: ¿qué condiciones explican el nivel de participación de la formulación del PDET en la etapa veredal en el municipio de El Bagre (Antioquia)? Para ello, se realiza un estudio de caso, a través del rastreo de procesos. Tal rastreo permite afirmar que la fase de formulación del Pacto Comunitario para la Transformación Regional corresponde a un proceso participativo de inclusión simbólica, en el que los actores comunitarios tuvieron voz, pero no poder de decisión.

Abstract:
In Colombia, terrorism is not a new threat to national security. Terrorism historically has been closely linked to the existence of an internal armed conflict and to the evolution of the “method of action” (método de acción) carried out by its main and secondary actors (guerrilla fighters, drug traffickers, militiamen). This article aims to analyze the different types of terrorism that have existed in Colombia as well as the way they have affected security and, finally, present its evolution in the national political context, from the signing of the most recent peace accord to the present.

23. A Human Rights Approach to Conflict Resolution

Abstract:
The role of human rights abuses in the causes, dynamics, and consequences of conflict illustrate the importance of a human rights approach to conflict resolution:1 if human rights are part of the problem, they must be part of the solution. This essay aims to show how a human rights perspective can improve the odds of transforming violent conflicts into sustainable peace by enhancing the design and implementation of peace processes and conflict resolution practices. In doing so, we will clarify the main characteristics of a human rights approach to conflict resolution and identify a set of human rights standards to guide its implementation. We will then briefly analyze the Colombian and the Israeli-Palestinian peace processes, each through the lens of the human rights approach. These two cases illustrate opposite ends of the spectrum when considering the inclusion of human rights in conflict resolution. At one end, the Colombian peace process illustrates how negotiations and a final agreement can recognize peace as a human right, highlighting the need to transform the structural conditions of injustice and human rights violations that give rise to armed conflict. At the other end, in the Oslo Accords between Israel and the Palestine Liberation Organization, human rights are virtually absent despite the fact that systematic abuses are among the main underlying causes and consequences of the conflict. In the conclusion, we address one of the main criticisms and challenges of a human rights–based approach to conflict resolution.

Abstract:
Colombia’s recent history has been marked by internal armed conflict and efforts to end it. For nearly six decades of war the response of the Colombian state to the insurgent threat has primarily been one of military confrontation. But at the same time all of the country’s governments have also initiated political negotiation processes. Some of these initiatives have led to the demobilisation of several armed groups. In these scenarios, the Armed Forces have played an important role in the war, and a smaller one in the peace negotiations. This situation changed significantly with the recent negotiations with the Revolutionary Armed Forces of Colombia (Fuerzas Armadas Revolucionarias de Colombia/FARC). For the first time the Armed Forces (the military and police) played a key role in both the negotiations and the implementation of the peace agreement. This active involvement on the part of the state security forces has been an essential part of and key contributing factor to the most successful peace process in Colombia of the last six decades.

Tensions are rising on the Colombia-Venezuela border after a new guerrilla faction opted out of Colombia’s 2016 peace deal. With diplomatic ties between the two countries severed, the risk of escalation is high. Bogotá and Caracas should open channels of communication to avoid inter-state clashes. What’s new? Former commanders of the demobilised Revolutionary Armed Forces of Colombia (FARC) announced the creation of a new dissident faction from a location seemingly close to the Colombia-Venezuela border, triggering accusations from Bogotá that Venezuelan President Nicolás Maduro’s government is sheltering and supporting the group. Why does it matter? Already at loggerheads over Maduro’s legitimacy, the Colombian and Venezuelan governments could stumble into conflict along a 2,200km border crossed daily by thousands of migrants and exploited by non-state armed and criminal groups. A major Venezuelan troop deployment and Colombia’s invocation of a mutual defence pact have heightened the risk. What should be done? The emergence of the new FARC dissident faction underscores that the Colombian government should redouble efforts to reintegrate former fighters into civilian life. Colombia and Venezuela should work to repair their diplomatic rupture and, in the meantime, establish communication channels to mitigate the risk of misunderstandings over border violence.

ince the 1960s, Colombia has been faced with a situation of armed violence that has plunged the country in insecurity and crisis. Groups of farmers had created self-defense militias, which later turned into guerrilla groups, over agrarian disputes with the government. The violence turned into a conflict between state forces, paramilitary groups, and guerrilla groups such as the Revolutionary Armed Forces (FARC), amongst others. In 2016, the Colombian government and the FARC signed a peace agreement which put an end to more than 60 years of civil war. However, three years later, the humanitarian reality in Colombia is still far from resolved. The International Committee of the Red Cross (ICRC) reported that the humanitarian situation in Colombia had in fact decayed in 2018. According to the ICRC, this was a consequence of the five remaining armed conflicts with other groups that were running in parallel, and the ineffective state response to these conflicts in certain rural communities, such asthe Catatumbo and the Cauca regions.

Societies that have experienced violent conflict face considerable challenges in building sustainable peace. One crucial question they need to address is how to deal with their violent past and atrocities that were committed – for example, whether perpetrators should be held accountable by judicial means, or whether the focus should be laid on truth telling and the compensation of victims. Transitional justice (TJ) offers a range of instruments that aim to help societies come to terms with their history of violent conflict. Systematic, empirical analyses of TJ instruments have been emerging over the last years. This Briefing Paper summarises the policy-relevant insights they provide regarding the main TJ instruments: trials; truth commissions; reparations for victims; and amnesties.
