Abstract:
Chinese fishing vessels and maritime militias were found in Philippine waters on April 12, 2021. Diplomatic protests raised by the Philippines have been ignored by China, which still claims most of the South China Sea, although in 2016 The Permanent Court of Arbitration at The Hague under Annex VII of the United Nations (UN) Convention on the Law of the Sea (UNCLOS), ruled that such a claim is inconsistent with international law. In the article, the authors use a normative research method and a comprehensive literature review in which sources are obtained from secondary data. The results show that China violates the tribunal ruling by infringing the sovereign rights of the Philippines’ Exclusive Economic Zone (EEZ). For the avoidance and prevention of further issues between the two states, the establishment of a Provisional Measures Zone (PMZ) may be used as a settlement.

12. The Distortion of UN Resolution 2758 to Limit Taiwan’s Access to the United Nations

Abstract:
There is a campaign underway by the People’s Republic of China (PRC) to reinterpret UN Resolution 2758 as based on its “One China” Principle and spread the fallacy that, through the resolution, UN member states came to a determination that Taiwan is a part of the PRC. Yet, in passing the resolution in 1971, the countries solely intended to grant the seat occupied by the Republic of China in the General Assembly and the Security Council to the PRC. This is reflected in the official historic record and meeting minutes as well as in the resolutions raised at the time for the General Assembly’s consideration. The PRC understood then that the resolution did not contain the Taiwan conclusions it wanted. Prime Minister Zhou Enlai noted that, if Resolution 2758 passed, “the status of Taiwan is not yet decided.” Beijing, through its proxies at the UN, expressed its unwillingness to join the organization if it allowed “‘two Chinas,’ ‘one China, one Taiwan,’ or ‘the status of Taiwan remaining to be determined.’” However, given that Beijing did not enjoy the same level of international influence then as it does today, it did not reject the resolution when it passed. Instead, PRC officials assumed the “China” seat and only later began to leverage their position to promote Beijing’s stance on Taiwan at the UN level. The PRC’s efforts to rewrite Taiwan’s status at the UN ramped up in the 1990s and early 2000s at the same time as the island’s democratization. The PRC has since worked to “internationalize” its “One China” Principle and to conflate it with UN Resolution 2758, a revisionist shift from the original intent of the document. Beijing has managed to further institutionalize and normalize its stance on Taiwan within the UN by signing secret agreements with UN bodies, restricting Taiwan’s access to the UN and its facilities, and embedding PRC nationals across various levels of UN staff. The UN and its specialized agencies have not made the texts of these agreements, such as that of the 2005 memorandum of understanding (MOU) between the PRC and the World Health Organization, available to the public or to any entity beyond the main signatories, though leaked guidance memos provide insights into the scope of the MOU’s content (See Appendix B). The PRC has likewise sought to force its views on nomenclature relating to Taiwan within the UN. This includes withholding UN accreditation from NGOs and civil society groups that do not refer to Taiwan as a part of the PRC in their organizational materials or on their websites. Recently, it has come to light that the PRC and its representatives have altered historic UN documents to change references of “Taiwan” to “Taiwan, Province of China.” (Examples are presented in a case study.) These developments have played out alongside marked shifts in the guidance of the UN Office of Legal Affairs on Taiwan, where it only 15 years ago cited an ambiguous and undefined “One China” policy, but now reiterates the PRC position on Taiwan. The PRC has likewise used UN Resolution 2758 and bilateral normalization agreements with other member states to falsely claim that its “One China” Principle is a universally accepted norm. It has also ensured that a plurality of countries back its views at the UN level and will cast votes alongside it—particularly on issues of Taiwan’s participation—and it reinforces this support through economic pressure on governments. The PRC’s efforts to constrain Taiwan at the UN have broader implications for international governance, as it shows a prioritization of one member state’s national interests over the global community’s—as exemplified by Taiwan’s damaging exclusion from global health debates during the coronavirus pandemic. The United States opposes the PRC’s attempts to redefine UN Resolution 2758 and has pushed back against UN statements claiming that Taiwan is a province of the PRC, including issuing a 2007 “non-paper” asserting its position that Taiwan’s status is not yet determined. The PRC has recently attempted to use its narrative of the “One China” Principle as embedded in UN Resolution 2758 to call into question the legitimacy of longstanding US policy on Taiwan—including the Taiwan Relations Act, which is US law.

Abstract:
Myanmar is blessed as well as cursed by its geography. Sandwiched between Asia’s heavyweights, China and India, it is potentially in a favorable position for trade and economic relations with both countries. However, trade and economic relations are secondary to China’s geopolitical and security interests in Myanmar. China´s main objective in Myanmar is to gain access to the Indian Ocean through Myanmar and gain control over a dual-use deep-sea port in Kyauk Phyu on Myanmar´s west coast. Another priority for China involves managing the stability of the two countries´ 2,000 km shared border. The porous border region has for decades played host to armed conflicts and is also the center of a billion- dollar drugs production and trafficking network. China regards Myanmar as forming part of its neighborhood, an extension of its national interests, and is extremely sensitive to any western engagement along its borders.

Abstract:
As China grows into a global power, it is forming a closer relationship with the international community. In the process, the nation is experiencing increasing levels of diplomatic friction, such as confrontation and conflict with other countries, as well as cooperation. Accordingly, this study analyzes China's response to various forms of diplomatic friction, as Korea seeks an effective response to possible friction with China in the future. More specifically, China's response to diplomatic friction was examined through various cases, with the aim of categorizing China’s response measures based on these examples. In addition, this study aims to prepare for possible friction with China in the future by identifying factors that differ in China's response to diplomatic friction.

Abstract:
Shows of force from China’s People’s Liberation Army exist on a continuum from peace to war and can be characterized as coercive or annihilative. In this report, Executive Director Mark Stokes and Associate Director of Programs Eric Lee examine kinetic and non-kinetic threats posed to Taiwan by the People’s Liberation Army. The authors explore the history of Taiwan’s early warning infrastructure and radar order of battle. They then assess how these capabilities support Taiwan’s air sovereignty missions of surveillance and control around its territories. They conclude by suggesting ways the United States can bolster Taiwan’s early warning capabilities.

Seapower has come to cyberspace as a measure of the so-called greatest transfer of wealth in history given the efforts of China and other states to steal intellectual property online. But the first greatest transfer of wealth comprised Europe’s rise to prominence post-1500 ACE. What historians call the “rise of the West” came to fruition with a forfeiture of the ideological promise of sharing the benefits of Western civilization worldwide. Cyberspace promises to align both threads of the new naval power, economic gain, and ideological conviction, a novel change in the history of conflict at sea all made possible by the technical marvel of cyberspace.

Abstract:
Belt and Road Initiative is China’s global infrastructure program. This long-term investment strategy is aimed at improving regional cooperation, increased trade and economic integration by linking Asia with Europe and Africa through maritime and land networks. South Asia is vital for Belt and Road Initiative of China. China views South Asia as a priority zone because its geostrategic location will contribute a lot in the preferment of the BRI. This research intends to highlight the geo-strategic and geo-economic implications of BRI on security and economy of South Asian states. This study is carried out using qualitative research methodology. Data was collected through primary and secondary sources including books, journals, research papers, articles and videos of seminars and conferences on the concerned topic and interviews of experts of BRI and CPEC were also conducted. According to the research, BRI is the manifestation of Mackinder’s heartland theory. BRI fortifies intra-state transport connectivity, improves international connectivity, will help to ease power shortages and facilitate economic modernization and industrialization in South Asia. The findings of this research show that China is expanding its diplomatic influence through its economic presence in South Asia causing serious challenges to India’s power in the region and USA’s status of global hegemon. Along with the opportunities of BRI, there are a number of risks of political instability, poor law and order situation, corruption, terrorism and extremism in South Asia, hindering the smooth functioning of BRI projects. Also there is a fear of Chinese debt trap and loss of sovereignty in South Asian states making them reluctant to fully permit the execution of Chinese led projects on their land.

19. The Evolving Cross-Strait Policy of the Democratic Progressive Party in Taiwan

This talk was composed of three main sections. First, Dr. Chen introduced the DPP's evolving cross-Strait policy by breaking it down into three respective phrases:1990s, 2000s, and 2010s. Then he explained why the party changed from championing independence versus unification in 1990s; intraparty power struggle between de facto and de jure independence in 2000s; and reach the current position of "opposition to de facto unification under one China" rather than "pursuit of Taiwan de jure independence" in 2010s. Second, he shared his research finding and understanding regarding the DPP's view towards the status quo of cross-Strait relations. Third, he discussed the change and continuity of the DPP's position towards sovereignty and cross-Strait relations. Jason Chen has served in different positions in the Democratic Progressive Party for years mainly covering the party's external relations including cross-Strait relations and national security. His last position with the DPP was advisor (Section of National Security) in New Frontier Foundation, the DPP's think tank.

Abstract:
This report traces the origins and development of China’s current naval strategy: “Near Seas Defense and Far Seas Protection.” Near Seas Defense is a regional, defensive concept concerned with ensuring China’s territorial sovereignty and maritime rights and interests. Its primary focus is preparing to fight and win informatized local wars within the first island chain. Far Seas Protection has both peacetime and wartime elements. In peacetime, the Chinese navy is expected to conduct a range of “non-war military operations” such as participating in international peacekeeping, providing humanitarian assistance and disaster relief, evacuating Chinese citizens from danger, and engaging in joint exercises and naval diplomacy. In wartime, the PLAN could be tasked with securing China’s use of strategic sea lanes and striking important nodes and high-value targets in the enemy’s strategic depth. Nears Seas Defense and Far Seas Protection is rooted in the ideas of Alfred Thayer Mahan and Mao Zedong.
