241. Global Strategic Patenting and Innovation—Policy and Research Implications

Abstract:
As an exclusionary property right, patents invite their use as a strategic weapon to shape markets and to reap monopoly rents through patent monetization. The increasing variety and global reach of strategic patenting strategies pose new and under-researched challenges for the international distribution of innovation gains. This think piece explores the proliferation of strategic patenting strategies, and highlights the growing complexity and uncertainty of the international patent system that result from the increasing use of patents as market deterrents and as a new asset class. Part One of the paper introduces four manifestations of strategic patenting that are well documented in the literature, i.e. the use of standard-essential patents (SEPs) as entry deterrents; aggressive patent infringement litigation that has galvanized the smart phone wars, with Apple as the pioneer; the proliferation of patent monetization services; and the use of cross-border patent licensing as a tool for corporate transfer pricing and tax planning. While existing research provides important insights into the drivers, we lack systematic theoretical and empirical research on how strategic patenting affects the international distribution of innovation gains. Part Two seeks to shed light on two recent forms of strategic patenting which need both theoretical and empirical case study research, i.e. the rise of Sovereign Patent Funds (SPFs), and first signs of patent-avoiding latecomer strategies, with China's Xiaomi as the most prominent example. The paper concludes with questions for policy and further research.

"China represents and will remain the most significant competitor to the United States for decades to come. As such, the need for a more coherent U.S. response to increasing Chinese power is long overdue," write CFR Senior Fellow Robert D. Blackwill and Carnegie Endowment for International Peace Senior Associate Ashley J. Tellis in a new Council Special Report, Revising U.S. Grand Strategy Toward China. "Because the American effort to 'integrate' China into the liberal international order has now generated new threats to U.S. primacy in Asia—and could result in a consequential challenge to American power globally—Washington needs a new grand strategy toward China that centers on balancing the rise of Chinese power rather than continuing to assist its ascendancy." The authors argue that such a strategy is designed to limit the dangers that China's geoeconomic and military power pose to U.S. national interests in Asia and globally, even as the United States and its allies maintain diplomatic and economic interactions with China.

Abstract:
India and China, rising powers in the Indo-Pacific, are moving from the test and design phase of sea-based nuclear weapon platforms to active deployment. In the long-term, these new ballistic missile-carrying nuclear submarines could lead to greater strategic stability in the region. But only once systems that ensure their safe and credible operation are put in place. The deployment of these weapons will also exacerbate existing regional tensions over the South China Sea and the Bay of Bengal, and drive the deployment of ballistic missile defence systems and enhanced anti-submarine warfare capabilities in the region.

Regional security is being adversely affected by a worsening perception gap between China and other regional powers in the Indo-Pacific. What China sees as the legitimate defence of its interests others in the region see as assertive behaviour. There are some real differences in interests between China and other regional players in the Indo-Pacific, but tensions can also be moderated by efforts to address the perception gap.

The government of Prime Minister Narendra Modi has pro-actively pursued India’s agenda of modernising and indigenising its defence sector by clearing several long-pending demands of the Indian military for equipment. India’s rapidly-obsolescing military hardware has made this push imperative—the ageing of the hardware has been prominently highlighted by a string of naval accidents in the last two years and the rapidly depleting strength of the air force squadron, with the de-induction of old aircraft and delays in inducting replacements. Externally, raging border disputes with China and Pakistan, and the growing presence of the Chinese Navy in the Indian Ocean region, continue to be threats that call for an updating of the Indian defence sector.

Abstract:
In the first four months of 2015, senior State and Defense Department officials as well as flag-rank military officers visited Southeast Asia, all emphasizing ASEAN’s importance for the Obama administration’s rebalance policy. The US is building a rotational force deployment capacity in the region along with military assistance to allies and partners, especially for increasing their maritime security capabilities. Washington and Manila await a Supreme Court decision regarding the constitutionality of the April 2014 Enhanced Defense Cooperation Agreement (EDCA), which will permit better access for US forces. Washington has also emphasized Vietnam’s importance to the rebalance, currently concentrating on improving coast guard relations. However, the US was dismayed that Hanoi permitted Russian tanker aircraft to fly out of Cam Ranh Bay to refuel bombers that flew near US bases in Guam. The Indonesian Navy has shown interest in more naval exercises with the US around the Natuna Islands. Problems persist in US-Thai relations as the military consolidates its rule. Although the annual Cobra Gold exercise took place in February, Washington scaled back US participation and significantly reduced the kinetic component. Planning for next year’s exercise is in limbo. Finally, Japan and India have shown support for maritime security buildups and an enhanced naval presence in the South China Sea.

Abstract:
Despite ongoing discussions of history and present-day issues related to the Senkaku/Diaoyu Islands, there was a general sense in both Tokyo and Beijing that relations were slowly moving in the right direction. Meetings took place between senior diplomats and political leaders. Slowly gaining traction, engagement culminated in the April 22 Xi-Abe meeting in Bandung, Indonesia, featuring smiles, handshakes, and a 25-minute talk – a far different picture of the relationship than that presented at the November meeting in Beijing. However, Xi and other Chinese officials consistently made it clear that progress in restoring relations would depend significantly on Japan’s proper understanding of history, in particular Prime Minster Abe’s much anticipated statement commemorating the 70th anniversary of the end of the war.

In the wake of the 18th Central Committee’s Third Plenum in November 2013, the People’s Republic of China (PRC) Ministry of National Defense (MND) announced the establishment of its first air defense identification zone (ADIZ). Assessments of the ADIZ to date have focused in large part on implications for territorial and maritime disputes in region. However, other potential drivers may offer additional context for the decision. Among these include coercion of Taiwan, unprecedented changes in China’s national airspace management system, and technical advances that have enhanced interoperability between the People’s Liberation Army Air Force (PLAAF) and Navy (PLAN).

250. Japan's New Security Policy: Breaking Away from the Post–War Regime?

Abstract:
China is challenging the regional balance of power in East Asia through a military buildup and an increasingly assertive foreign policy. The US is forced to find the right balance between cooperating with China while benefiting from its economic rise, and countering China's regional reach by carrying out its self-declared "pivot" to Asia in spite of domestic and budgetary constraints. With just over one year in office, Japan's Prime Minister Shinzo Abe has received wide domestic support for his ambitious plans to revive Japan's economy through his threefold policy of Abenomics. At the same time, however, he has implemented a number of significant policies in the defence and security sphere. In response to China's military rise, the Abe administration increased and recalibrated the defence budget. Furthermore, in order to reinforce the alliance with the US, the government approved the creation of a US-style National Security Council, passed a Secrecy Bill, and aims to reverse Japan's self-imposed ban on exercising the right to collective self-defence. Under the banner of "proactive pacifism", the Abe cabinet is seizing the momentum caused by the changing regional power dynamics in order to edge closer towards "breaking away from the postwar regime". A proposed revision of Japan's constitution, unchanged since 1947, symbolizes the ruling Liberal Democratic Party's (LDP) objective to bring about a more autonomous role for Japan both in the security alliance with the US and as an international actor.
