1. A Path Not Taken: A Historical Interpretation of the Roots of Contemporary Crime in Central America

Abstract:
Has Central America always been a dangerous place? During the early 1980s, in the provincial city of Chichigalpa, Nicaragua, one could walk anywhere and at any time without fearing crime. The Frente Sandinista de Liberación Nacional (FSLN), a leftist guerrilla organization founded in 1961 that had led the Ni- caraguan Revolution to triumph in 1979, ruled the country.1 Remarkably, its police force, the Policía Sandinista, was neither feared nor scorned, even by the anti-Sandinista sectors of the community. Neither crime nor its absence were a topic of conversation in Chichigalpa, nor were they a concern in the U.S. media, despite the media’s obsession with all things Sandinista.2 If the media or the Reagan administration had commented on the low levels of crime in Nica- ragua, they likely would have criticized the FSLN for that too, citing a highly regimented surveillance society as its cause.3 On the contrary, any surveillance that did exist in Nicaragua in the early 1980s derived from enhanced forms of solidarity against what was largely perceived as an external threat: the Contras— the United States-backed, counter-revolutionary forces composed of former Somoza supporters, Nicaraguan-dictatorship exiles, and ex-Guardia o:cers. 9is military force eventually received signi5cant peasant support in the central and eastern parts of the country.4 One institution that fomented solidarity was the Comités de Defensa Sandinista (CDS). Organized immediately preceding and following the revolutionary triumph of July 1979, the CDS began as a group of relatively democratic organizations that promoted community development as well as security.5 Over the next few years, through nightly patrols, they increas- ingly focused on the surveillance of potential Contra terrorist activities. While such e;orts certainly contributed to crime reduction, the democratic character of the organizations also eroded, as a top-down emphasis on national defense became predominant among the CDSs.

2. One Year after the U.S.-Mexico Agreement: Reshaping Mexico’s Migration Policies

On June 7, 2019, after months of heightened Central American migration through Mexico to the United States, the Mexican and U.S. governments signed an agreement to work together to manage the migration of Central American asylum seekers and other migrants. This ushered in an intense period of policy and institutional change that is reshaping Mexico’s immigration enforcement and humanitarian protection systems. After being threatened with steep tariffs on Mexican goods, Mexico agreed to step up enforcement efforts, accepted the expansion of the U.S. Migrant Protection Protocols (MPP, also known as Remain in Mexico) along the U.S.-Mexico border, and promised to increase collaboration with the United States to disrupt migrant-smuggling networks. In turn, the United States pledged to expedite the asylum cases of migrants waiting in Mexico under MPP and invest in economic development efforts in southern Mexico and Central America to address the drivers of migration. While the full impact of the deal will likely take years to unfold, this policy brief takes stock of what has changed in the first year since its signing. It charts trends in migrant apprehensions and returns by Mexican authorities, and the volume of asylum applications filed in Mexico. The brief also examines challenges that have intensified during this time, including the precarious conditions many migrants face while waiting in Mexican border communities for their U.S. asylum cases to be heard and the COVID-19 pandemic that hit in early 2020. Looking ahead, the brief highlights opportunities for further policy development.

3. What’s Wrong with Temporary Protected Status and How to Fix It: Exploring a Complementary Protection Regime

Temporary Protected Status (TPS) became part of the US protection regime in 1990 to expand protection beyond what had been available under the US Refugee Act of 1980, which had limited asylum to those who met the refugee definition from the United Nations’ 1951 Refugee Convention. The TPS statute authorized the attorney general to designate foreign countries for TPS based on armed conflict, environmental disasters, and other extraordinary and temporary conditions that prevent designated nationals from returning in safety. While providing blanket protection that very likely has saved lives, TPS has nonetheless proven to be a blunt instrument that has frustrated advocates on both sides of the larger immigration debate. This article evaluates the purpose and effectiveness of the TPS statute and identifies inadequacies in the TPS regime and related protection gaps in the US asylum system. It argues that TPS has not proven to be an effective mechanism for the United States to protect foreigners from generalized conditions of danger in their home countries. It calls for changing the US protection regime to make it more responsive to the risks many asylum seekers actually face by creating a broader “complementary protection” standard and a more effective procedure for assessing individual protection claims, while reserving “temporary protection” for rare situations of mass influx that overwhelm the government’s capacity to process individual asylum claims. The article looks at alternative models for complementary protection from other jurisdictions, and shows how the US asylum and TPS system (in contrast to most other jurisdictions) fails to provide a mechanism for protecting arriving asylum seekers who do not qualify as refugees but who nevertheless would be at real risk of serious harm based on cruel, inhuman, or degrading treatment or punishment or because of situations of violence or other exceptional circumstances, including natural or human-made disasters or other serious events that disturb public order, that would threaten their lives or personal security. The article proposes that the United States adopt an individualized complementary protection standard for arriving asylum seekers who are not able to meet the 1951 Refugee Convention standard but who would face a serious threat to life or physical integrity if returned because of a real risk of (1) cruel, inhuman, or degrading treatment or punishment; (2) violence; or (3) exceptional situations, for which there is no adequate domestic remedy.

4. The Accuracy Of Proxy Means Tests For Immigrant Populations: A Case Study In Colombia

Abstract:
This paper examines the accuracy of proxy means tests (PMTs) for identifying low-income households among migrant and refugee populations. Specifically, it develops a PMT model based on Colombia’s SISBEN system, and evaluates its ability to identify poverty among recent and established Venezuelan migrants and refugees. It finds that these groups have significantly higher rates of exclusion errors relative to native Colombians, which could prevent them from accessing valuable social services. These findings are robust to a number of specifications, and the issue is not resolved by simply including immigration status within the model. Additionally, occupational downgrading is identified as the most likely mechanism for this effect, as Venezuelan migrants and refugees in Colombia generally have lower returns to education when compared with native Colombians. These results should inspire caution when choosing to use PMTs for targeting, and it is recommended that all policymakers evaluate the accuracy of their PMTs for vulnerable subpopulations prior to implementation.

Natalie Scenters-Zapico is a poet from the United States-Mexico border towns of El Paso, Texas, and Ciudad Juarez, Chihuahua, Mexico. Her work, like her origin, is about borders. In her debut collection, The Verging Cities, Scenters-Zapico explores immigration, marriage, and femicide in the realm of border culture and identity [1]. She expands these themes in her second collection, Lima :: Limón, where she creates a scathing depiction of the brutal machismo that conditions a Mexican woman’s experience. Lima :: Limon is especially personal to Scenters-Zapico. Her lyrical passages draw from the music of her childhood. In an age where distorted narratives about immigration lead to family separation and threaten asylum seekers, Lima :: Limon’s intimacy is especially critical. Unlike the efficacy of border policy or trade negotiations, Scenters-Zapico’s personal narrative is undeniable—as are the harrowing experiences of millions of Mexican women.

9. Sustainable Reintegration: Strategies to Support Migrants Returning to Mexico and Central America

As U.S. deportations to Mexico continue at substantial levels and the numbers returned by both the U.S. and Mexican governments to El Salvador, Guatemala, and Honduras are increasing, it has become more urgent for countries in the region to develop successful reception and reintegration programs that meet the diverse needs of returning migrants. Between fiscal years 2012-18, the United States carried out approximately 1.8 million repatriations of Mexican migrants, and the United States and Mexico together accomplished 1.4 million returns of migrants from the three Northern Triangle countries. Drawing on fieldwork and interviews with government officials, researchers, representatives of civil-society and international organizations, as well as returning migrants, this report highlights promising reintegration strategies and pressing challenges. Mexico and the three Northern Triangle countries exhibit different levels of capacity and degrees of implementation in their reception and reintegration programs. While most deported migrants now receive basic reception services, their access to reintegration services is somewhat more mixed. Among the challenges: Difficulty obtaining the official ID that allows returning migrants to access these services, limited awareness and geographic distribution of services, difficulty matching returning migrants’ skills with labor-market needs, and barriers to reintegration posed by social stigmatization and employment discrimination. The report offers a range of recommendations to governments and others, including: Prepare migrants for reintegration prior to their return, even before deportation; issue primary ID documents from abroad or upon reception; and ensure reintegration services tap into returning migrants' cultural roots. Improving reception and reintegration services represents a long-term investment for both destination and origin countries, the authors conclude, holding the potential to reduce re-migration while enabling countries of origin to benefit from the skills and assets migrants have acquired abroad.

10. Fight and Flight: Tackling the Roots of Honduras’ Emergency

Despite U.S. restrictions on Central American migration, Hondurans are fleeing north in record numbers as the country struggles with polarised government, corruption, poverty and violence. With outside help, Tegucigalpa should revisit its heavy-handed security policies and enact judicial and electoral reforms to avert future upheaval. What happened? Months of street protests and a mass northward exodus, despite a sustained U.S. campaign to deter Central American migrants, illustrate the depth of despair in Honduras at political leaders, gang violence, extortion, poverty and inequality. Why does it matter? State security crackdowns against a backdrop of extreme political polarisation dating back to the 2009 coup, fuelled by scandals over alleged links between the ruling party and criminal networks, could further fuel violent unrest. Washington’s fixation on bottling up migrant flows in the region risks making a bad situation worse. What should be done? With support from the U.S. and other donors, the Honduran government should enact electoral and anti-corruption reforms and grant stronger investigative powers to the judiciary and police, avoid heavy-handed responses to civil unrest, and fund programs that address urgent humanitarian needs while also reducing violence, a key driver of migration.
