111. Dealing with China: Lessons Learned from Three Case Studies

Abstract:
The idea for this paper began after several conversations with Canadian friends and colleagues about the cases of Michael Kovrig and Michael Spavor. On December 10, 2018, Chinese officials detained the two Canadian citizens for “endangering state security”, 10 days after Canadian authorities arrested Meng Wanzhou, Huawei’s chief financial officer, on an extradition warrant from the United States, where she was wanted for bank fraud. Despite Chinese statements denying any connection between the two Michaels and Meng, some Canadians have argued the only way to gain their release is for Canada to release Meng – a classic “prisoner exchange”. Others, however, have argued just as forcefully that trading Meng for the two Canadians would only give legitimacy to China’s “hostage diplomacy”. One friend asked me if China had ever done anything like this before. How had those cases been resolved, and what would China do this time? Those were good questions. As a U.S. Foreign Service officer who has spent much of my career working on China – including at the U.S. embassy in Beijing from 2015-2018, where I analyzed the Communist Party leadership and China’s state security apparatus – I had some insight into Chinese foreign policy. I also had a personal connection to one of the cases. I knew Michael Kovrig – he had been one of my counterparts at the Canadian embassy in Beijing – and I had great respect for his work as a diplomat, and later as a senior advisor at the International Crisis Group. Moreover, because I was now on leave from the U.S. Department of State to serve as a Council on Foreign Relations International Affairs Fellow in Canada, I had time to look for some answers. And so I began trying to identify and analyze similar cases from the recent past. This paper is the result. It represents my own views, and although the Department of State has allowed me to publish it in my personal capacity, it does not necessarily reflect the views of the Department or the U.S. government.

112. COVID-19 and Canada’s Development Assitance in Sub-Saharan Africa

Abstract:
COVID-19 has created unprecedented challenges for governments around the world. In March 2020, the World Health Organization (WHO) declared the global outbreak of COVID-19 a pandemic. In addition to a worldwide health crisis, the pandemic has had far-reaching socioeconomic impacts that have been severest for the most vulnerable people and have exacerbated existing inequalities. This presents wealthy countries like Canada with a challenge: addressing the health crisis and economic fallout at home, while simultaneously supporting a global COVID-19 response and continuing to tackle existing development priorities. This report explores the implications of COVID-19 for Canada’s development assistance efforts in Sub-Saharan Africa (SSA). Given that 27 of the 28 poorest countries in the world are located in SSA and half of Canada’s Official Development Assistance (ODA) budget is expected to go to countries in Africa by 2021-22, it is a priority region. To date, Canada has maintained ODA spending levels, while also providing additional funds in support of global efforts to address COVID-19. Evidence suggests that pre-pandemic priorities in the region, such as gender equality, health, and food security, have not been derailed. Rather, the impact of the pandemic has reinforced the importance of core development objectives such as achieving the United Nations (UN) Sustainable Development Goals (SDGs). In particular, Canada’s Feminist International Assistance Policy (FIAP) is fit for purpose to address the gendered impact of the pandemic. It is clear that the pandemic does not affect men and women equally. While the right policy tools are in place, building back better will require Canadian resolve and leadership to stay the course and ensure the most vulnerable are not left behind.

113. Challenges and Prospects for the CPTPP in a Changing Global Economy: Taiwanese Accession and Canada’s Role

Abstract:
In the past, Canada has had to deal with the matter of Taiwan very delicately. China considers Taiwan to be an integral part of the nation: a rogue province that must eventually be reunified with the mainland. Since Canada relies much more on trade with China than with Taiwan, the stakes have favoured policies that avoid engaging with Taiwan in ways that would unnecessarily irritate China. As a result, there has been little appetite here for negotiating a bilateral trade deal with Taiwan. That attitude is finally changing. One main reason is because China is already angry with Canada, and vice versa. Relations between the two countries are at an all-time low, and domestic support for accommodating China is minimal. As a result, Canada is freer than before to consider negotiating a trade agreement with Taiwan. At the same time, Taiwan is interested in joining the Comprehensive and Progressive Trans-Pacific Partnership (CPTPP), to which Canada is already a party. By supporting Taiwan’s accession to the CPTPP, Canada can achieve a free-trade agreement with Taiwan without having to negotiate one bilaterally. The ability to do so under the aegis of a multilateral agreement should serve to mitigate any remaining concerns that China might further retaliate against Canada directly. However, striking back at China is not a reason for Canada to support Taiwan’s accession to the CPTPP. We should do so because it is in the interest of Canada and the other members of the CPTPP to add to the strength of the organization by welcoming an economy that is an important global trader and a key player in global supply chains. In addition, Taiwan is a country that is clearly willing and able to accept CPTPP disciplines. Canada should move quickly and enthusiastically to support Taiwan’s accession. The benefits of having Taiwan join Canada in a free-trade agreement are obvious. The opportunity to make it a reality is finally here. The Comprehensive and Progressive Trans-Pacific Partnership (CPTPP), which entered into force on Dec.30, 2018 for six of the 11 signatories that had completed ratification at that time (Australia, Canada, Japan, Mexico, New Zealand and Singapore),1 is a beacon of hope in a dark, protectionist landscape. Along with the Regional Comprehensive Economic Partnership (RCEP) agreement, which was signed on Nov. 15, 2020, the CPTPP advances the trade and investment liberalization agenda at a time when protectionist measures by some major trading countries are threatening to undo decades of progress. The commitments and new disciplines of the CPTPP are particularly important because of malaise infecting the World Trade Organization, where the work of the Appellate Body has now ground to a halt because of actions by the United States, and to offset the negative impact of the U.S.-China trade war now underway.

114. Canada’s Historical Search for Trade Markets

When U.S. President Donald Trump was elected in 2016 on a promise to cancel the North American Free Trade Agreement (NAFTA), Canada risked losing the free-trade regime that it had enjoyed with the U.S. since the original U.S.-Canada Free Trade Agreement took effect in 1989. Those who came to Canada’s rescue, by persuading the Trump administration to eventually make a new deal, the United States-Mexico-Canada agreement, were Canada’s trading partners in the United States, whose interests were threatened: Nearly two-thirds of U.S. states now have Canada as their most important trading partner. This was indicative of a long-term trade pattern of an ever-increasing closeness in trade between the U.S. and Canada. It is a pattern that started since before Confederation and in spite of not a few attempts in Canada to diversify exports away from the U.S. However, that simply cannot happen in any meaningful way: The 170-year-old pattern of Canada-U.S. trade is now so permanent as to be utterly irreversible. Since the decision by Britain to end tariff preferences for its colonies in the mid-19th century, Canada has naturally sought to penetrate the U.S. market for its exports. The desire has not always been mutual: American protectionism has, at times, hampered the export of Canadian products to the U.S., although tariff barriers have failed to stop what is a seemingly natural and, in many ways, necessary north-south flow of goods and services. Even Canadian attempts to reorient its own trade emphasis to enhance domestic east-west trade, or to expand into countries beyond the United States have made little difference. The trading relationship between Canada and the U.S. has endured through wars and in peacetime, through Republican administrations and Democratic ones. It will only continue to grow. Fantasizing about some markedly different trading future is therefore a waste of Canada’s time and energy, which should instead be expended on further penetrating the American marketplace and solidifying ties with state and local governments, local manufacturing associations, Congress and new industries. Canada should take advantage of its new trade deal with the U.S. to integrate the Canadian economy as fully into that of the U.S. as possible. There may be others like President Trump or some like him in Canada, who try to disrupt the trade relationship. That even Trump eventually was persuaded to agree to free trade with Canada is evidence, however, that an ever-closer trading relationship is simply a reality that cannot be stopped.

115. Sharing the Burden: Lessons from the European Return to Multidimensional Peacekeeping

Since 2013, after years of near absence from the continent, a number of European countries, along with Canada, have again deployed to UN peacekeeping missions in Africa. The European presence in UN peacekeeping in Africa is now nearly at its largest since the mid-1990s. These countries provide much-needed high-end capabilities, as well as political and financial capital, to UN peacekeeping operations. Nonetheless, securing and sustaining European contributions to these types of peacekeeping operations remains an uphill battle for the UN. This paper draws lessons from this renewed engagement by European countries and Canada, both from their point of view, as well as from that of the UN Secretariat, UN field missions, and other troop contributors. It aims to explore how these bodies and other countries can best work together in a collective endeavor to improve UN peacekeeping’s efficiency and effectiveness. Toward this end, the paper recommends a number of actions to the UN Secretariat: Build peacekeeping operations around first-class medical systems; Focus on improving processes for casualty evacuation; Strengthen the UN’s capacity to foster partnerships among troop-contributing countries; Engage Europe strategically and politically; Be flexible and make European contributors (and others) feel included in planning; Continue educating European contributors about UN peacekeeping; Do not limit engagement with European contributors to high-end capabilities; Ensure European contributors adhere to UN standards; and Encourage European contributors to commit to longer deployments.

116. United G20 must pave the way for robust post-COVID-19 recovery

The world is facing unprecedented health and economic crises that require a global solution. Governments have locked down their economies to contain the mounting death toll from the COVID-19 pandemic. With this response well underway, now is the time to move into a recovery effort. This will require a coordinated response to the health emergency and a global growth plan that is based on synchronized monetary, fiscal, and debt relief policies. Failure to act will risk a substantial shock to the postwar order established by the United States and its allies more than seventy years ago. The most effective global forum for coordinating this recovery effort is the Group of 20 (G20), which led the way out of the global financial crisis (GFC) in 2009, the closest parallel we have to the current catastrophe. Eleven years ago, world leaders used the G20 meeting in London as the forum to deliver a unified response and a massive fiscal stimulus that helped stem economic free fall and prevented the recession from becoming a second Great Depression. A decade on, it is clear that the G20 is the only body with the clout to save the global economy. This does not mean that the G20 should be the only forum for actions for its member states. The United States, for example, should also work closely with like-minded states that support a rules-based world order, and there are many other fora where it can and must be active with partners and allies. But no others share the G20’s depth and breadth in the key focus areas for recovery. The other multilateral organizations that could take up the challenge lack either the substance or membership. The United Nations may count all countries as members but is too unwieldly to coordinate a response. The International Monetary Fund (IMF) has the resources but requires direction from its 189 members. The Group of Seven (G7), which once oversaw financial and economic management, does not include the fast-growing emerging economies. The G20 represents both the world’s richest and fastest-growing countries, making it the forum for international collaboration. It combines that representation with agility.

117. Assessing Indian digital trade policies: Will they support a $5 trillion economy?

The ongoing COVID-19 pandemic has forced nearly all public policy questions to be seen through the lens of how to detect and respond to the disease as it spreads rapidly across the globe. These include obvious questions of national health care policy and whether there is a place for international efforts to coordinate their national responses. Trade policy has come to the fore as a growing number of countries restrict exports of critical medical supplies to ensure sufficient availability for patients in-country. In this crisis, international collaboration to keep trade flowing has been limited and has not prevented many countries from imposing new trade restrictions. The importance of digital policies has grown as countries seek to harness the tools of big data, artificial intelligence (AI), and vital infrastructure to trace outbreaks of the virus and assist efforts to find cures and vaccines. While digital tools are proving vital in efforts to track outbreaks and trace contacts, legitimate concerns are growing about potentially invasive government surveillance even after the virus retreats. These policy areas—health, trade, and digital—overlap in the international, national, and local efforts to reduce the duration of the pandemic and mitigate its effects with respect to human lives and economic well-being. The analysis in this paper, while initially conducted before anyone had ever heard of COVID-19, has been impacted by its sudden emergence and will likely require updating to assess the experiences of this ongoing crisis. The paper, which focuses on the U.S.-India bilateral relationship, concludes with a series of questions, as opposed to policy recommendations. This is due partly to the very complexity that all governments confront in mapping out digital policies given the ubiquitous role digital networks and devices play in our daily lives. But these questions may have even more tangible relevance now that COVID-19 is forcing a reckoning with a severe interruption in global economic growth, which could be on the scale of the Great Depression in the 1930s. Ultimately, the governments of India, the United States, and other nations will determine for themselves what answers are relevant to their individual circumstances.

118. International Intellectual Property after the New NAFTA

Abstract:
The Canada-United States-Mexico Agreement (CUSMA) is the new high-water mark in international intellectual property (IP) law. CUSMA includes most of the Trans-Pacific Partnership provisions that were suspended in the Comprehensive and Progressive Trans-Pacific Partnership, except for a few pharmaceutical-related provisions amended after signing. Canada will be required to make meaningful changes to domestic IP laws, including copyright term extension, criminal penalties for tampering with digital rights management information, restoration of patent terms to compensate for administrative and regulatory delays, broader and longer protection for undisclosed testing data and other data, new civil and criminal remedies for the misappropriation of trade secrets, and additional powers for customs officials to seize and destroy IP-infringing goods.

This paper compares the different responses of the United States, Canada and Germany to data risks posed by popular apps such as FaceApp, Facebook, Strava, TikTok and ToTok. These apps and many others store troves of personal data that can be hacked and misused, putting users (and the countries in which they live) at risk.

120. Indigenous Reserve Lands in Canada Face High Flood Risk

Abstract:
Nearly every year, Indigenous peoples in First Nations communities face property damage, disrupted livelihoods and the severe social and psychological burdens associated with evacuation due to flooding. Perhaps the most striking example is the recurrent flooding that afflicts the Kashechewan First Nation in Northern Ontario, whose residents have been forced to evacuate their homes every spring for 17 years. Although it’s known that Indigenous communities face a greater flood risk and experience more flood emergencies than the general Canadian population, the scope and magnitude of the current threat, and how it might evolve under climate change, has been little studied. This policy brief reports on research at the University of Waterloo that is assessing, quantifying and mapping the flood risk to Indigenous peoples living on reserve lands and includes policy recommendations to help with better understanding and reducing that risk.
