Abstract:
This article critically interrogates the assumptions and critiques levelled at the Canadian Rangers by two ardent media critics: Robert Smol and Scott Gilmore. Situating the Canadian Rangers in the Canadian Armed Forces’ Arctic Operational Picture, it argues that the Rangers are an appropriate and operationally valued component of a Canadian military posture designed to address Northern risks across the defence-security-safety mission spectrum. Rather than seeing the Rangers as a sideline to the “serious” military show that Smol and Gilmore would like to see play out in the North, their proven ability to operate in difficult and austere environmental conditions – often reflecting applied Indigenous knowledge of their homelands – and to maintain interoperability with mission partners to address practical security challenges is highly valuable. By serving as the “Eyes, Ears, and Voice” of the CAF in their communities, the Rangers embody federal approaches to collaboration and partnership predicated on ideas that Northerners are best placed to make decisions in areas that impact them.

Abstract:
During the First World War the culture of the Canadian Army reflected the society of the time. Today Indigenous peoples are welcomed, their cultural heritage appreciated and encouraged. This transformation of the Canadian military can be explained in part by how our society has evolved but even more by how Indigenous members of the CAF have proven that they can ‘do the job.’ This article presents the perceptions of some Indigenous veterans who adapted, in various ways, to military culture while also retaining elements of their own culture. In most histories of Indigenous peoples in the Canadian military, the focus has been on how the Armed Forces changed them; but after a century it is increasingly clear how much Indigenous people have changed the military.

Abstract:
Indigenous peoples continue to be oppressed by racial discrimination enacted through legislation, policies and practices of the Canadian state, including the Canadian Armed Forces (CAF). Systemic racism, practiced through institutionalized policies and customary behaviour affecting people working in organizations, results in inequality for some groups and privileges for others. Since 2002 the CAF has been covered by the federal Employment Equity Act whose purpose is to address systemic discrimination by requiring employers to remove and prevent systemic barriers to equality for Indigenous people, women and “visible minorities” and to maintain a workforce that reflects the diversity of the Canadian population. Aside from its legal obligation, it is in the interest of the CAF to recruit and retain Indigenous People because they are an essential part of Canada’s labour supply. However Indigenous members of the CAF comprise a small and marginalized minority within a rigid, bureaucratic and culturally foreign organization. Implementing the Employment Equity Act could assist the CAF to address the Canadian state’s promise of reconciliation, fairness and equality for Indigenous people. This chapter reviews available evidence bearing on the CAF’s employment equity record, which presents a pattern of resistance to the Act’s requirements and failure to progress toward a representative workforce. In the absence of effective action to implement change, the CAF has yet to find a path from systemic racism toward employment equity for Indigenous People.

Abstract:
In the context of the Truth and Reconciliation Commission's report, the Canadian state is in the process of reaching out to Aboriginal communities. Public organizations must therefore be actively involved in integrating Aboriginal people into their communities so that they are representative of Canadian society as a whole. The question of the perceptions of Aboriginal employees becomes crucial because it may be a factor that facilitates or restricts the access of these people to public organizations. As such, Aboriginal people have a special, complex and rich relationship with the military. It seemed relevant for us to study the perception of the Canadian military with Aboriginal people. Using the theory of social representations, this research exposes the structure of these perceptions. We have discovered that the military perceives the army through the prism of excellence and legal authority. Thus, the perception scheme is not a priori an obstacle to the integration of Aboriginal people, but there are indeed prejudices and stereotypes on the periphery of the representational structure. These prejudices and stereotypes could constitute an obstacle to the effective integration of this population.

Abstract:
The focus of the last two decades (1994–2015) on the world’s Indigenous peoples has highlighted a number of critical issues that are central to Indigenous empowerment and resurgence in the quest for decolonization. The key issues include Indigenous peoples’ full and effective participation in decision making in matters that affect them, the pursuit of culturally sensitive development policies, or what is now termed self-determined development, and effective monitoring or stock-taking mechanisms and processes, not only for planning but also for measuring progress. A combination of factors, including access to information and communications technology amid current Indigenous resurgence and rapidly intensifying Indigenous interest in data sovereignty, places Indigenous peoples in a strong position to further their ongoing investment not only in self-repositioning but also for practical realization of their rights to self-determination.

16. Indigenous Elder Societies as Leaders for Global Protected Areas Governance

Abstract:
Many models for parks and protected areas have been created globally to preserve biodiversity and natural heritage and to provide visitors with “wild places” to experience. This establishment of conventional parks and protected areas has typically been done through governance processes that do not acknowledge Indigenous peoples, including their connections to and their governance systems for such areas. Area-based conservation through parks and protected areas has, therefore, displaced and systematically oppressed Indigenous Peoples, disenfranchising them from their custodial roles and responsibilities within their traditional territories. In addition to oppression, conventional governance systems have also produced intrusive infrastructure and circulated tourists, creating human-wildlife conflict that often results in wildlife mortality. Through disenfranchising Indigenous peoples of their traditional territories, parks and protected areas in colonized regions of the world have separated nature from the societies that have the most deeply embedded place-based knowledge systems and governance structures.

Abstract:
Diversity and Inclusion are terms that are commonplace across various industries, including the hiring practices of corporations and in representation at educational institutions. We see diversity and representation play an important role in the democratic nomination race for the 2020 U.S. presidential election, sometimes mentioned only to gain political advantage. Diversity, in terms of whose story gets told and whose doesn’t, is a theme that is woven throughout a variety of global issues, but often takes a backseat to the bigger news stories that tend to dominate media outlets. Yet, diversity or lack thereof is often implicated upon closer examination of global issues. Climate change, development, violent conflict, terrorism, human rights violations, reform of global governance, and problems of democratic representation throughout the globe are closely tied to issues of diversity. Increasingly, questions of diversity and inclusion present a pathway to solutions to many of these problems. For the 21st volume of the Journal, we wished to showcase and champion diversity and representation in academia by bringing the voices of diverse writers and less familiar topics to our readers. This issue features three articles on indigenous rights. Sheelagh Daniels-Mayes and Kristina Sehlin MacNeil write on the concept of diplomacy, focusing primarily on the lesser recognized diplomacies of First Peoples in Australia and Sweden. Priscila Ribeiro Prado Barros posits that the growing involvement of Indigenous Peoples in Brazil, in the defense of their own affairs, have triggered the emergence of a new organizing logic, which considers rights as more important than territorial authority. Finally, Erica Neeganagwedgin examines the Canadian federal government’s 1969 Statement of the Government on Indian Policy and the recent Indigenous Rights Framework that the Canadian government introduced in 2018. The remaining three articles discuss diversity in employment at the UN, the issue of ethnic diversity in the two Sudans, and how international law affects refugees in the Caribbean. Harold Heredia discusses the importance of diversity at the UN as stated in the organization’s charter in Article 101. Luka Kuol examines the case of the two Sudans to argue that ethnic diversity can become a curse when there is a governance deficit that is manifested in social contracts and systems of government that abhor and detest diversity. Westmin James’ article asserts that both international treaty law and customary international law may appropriately aid constitutional interpretation and can protect asylum seekers or refugees from being repatriated to their home country. Our strong desire to provide a platform for less familiar topics was the driving force behind the creation of this issue. We hope you enjoy this issue and the diverse topics that it touches on.

18. Reconciliation beyond the Box: The UN Declaration and Plurinational Federalism in Canada

Abstract:
Prime Minister Justin Trudeau has publicly shared a vision of a plurinational state brought about through truth and reconciliation. He has expressed hope that Canadians are ready to rectify past wrongs and undo the legacy of colonialism by using the United Nations Declaration on the Rights of Indigenous Peoples (UN Declaration) as “a way forward” to achieve self-determination, dignity and respect for Indigenous peoples. Many have questioned the government’s commitment to reconciliation built upon nation-to-nation and government-to-government relationships. Governmental support of major development projects such as the Trans Mountain Pipeline Expansion, against strong opposition from some Indigenous voices, has created skepticism. Many Indigenous leaders have expressed concerns about how changes to a number of laws currently making their way through Parliament will impact Indigenous people, and whether their concerns are being fully heard by government. With respect to the government’s rights recognition and implementation framework, some Indigenous communities argue that the focus should be on the affirmation rather than the mere recognition of rights that are already enshrined in the UN Declaration. This paper looks at the history of Indigenous treaty making in Canada, the history of the courts’ statements regarding Crown sovereignty, underlying title and legislative power, and how the UN Declaration might lead Canada and Indigenous peoples toward genuine nation-to-nation relationships.

19. Comparative Approaches to Reconciliation: Canada, United States of America, Australia and New Zealand

Abstract:
This paper examines the approaches taken by the Governments of Canada, Australia, New Zealand and the United States to address the issue of reconciliation with Indigenous peoples. A wide array of activities have been employed in these countries to improve relations with Indigenous communities. The paper notes that no single program or policy can address reconciliation, and that much remains to be done in order to achieve societies that are cognizant of the historical and contemporary contexts that have contributed to the current socio-economic reality of Indigenous peoples in the four countries examined. The definition of reconciliation is also complex and no single definition can be deemed to capture the dynamic of state and community relations. The review of policies and programs addressing reconciliation in the four countries examined is not exhaustive in nature. Programs and policies have been chosen based on government and community feedback indicating they were making a difference. From these experiences, key elements of programs and policies required to address reconciliation are compiled. The findings stress that reconciliation is a long-term process, based on truth, informed decision-making and accountability on the part of all partners involved. The United Nations Declaration on the Rights of Indigenous Peoples (UNDRIP) is used as a lens to observe whether it can be used to address reconciliation efforts in a constructive manner. Many experts argue that the spirit of the UNDRIP could act as a symbolic guide and framework to address reconciliation efforts. In conclusion, the paper notes that reconciliation efforts in each country will require support and long term commitment from all sectors of society. It will also require the renewal of a partnership based on mutual long-term goals and objectives. The partnership must be closely monitored, supported and be based on mutual respect and accountability if it is to flourish.

20. Social Innovation and Aboriginal Communities

Abstract:
Improving the lives and contributing to a more resilient society requires breakthrough ideas and approaches, game changing strategies and collaborations, and continuous innovation. Social innovation combines all of the above and is already bringing significant advances in areas such as reducing prisoner reoffending, caring for children and the elderly, community regeneration, financial inclusion, and supported housing. It has the potential to generate great benefits to the Indigenous communities in developed countries. While governments in Canada acknowledged the importance of social capital and social economy, and have been active in these areas in the recent years, a cross-sectoral national strategy to advance social innovation needs to be in place. There is no established labour market policy or program in Canada that would have social innovation aspects embedded in it as compared for example to the EU. The new policies are required for the further development of social finance and social enterprise sector. In September 2014, the Canadian National Advisory Board published the report Mobilizing Private Capital for Public Good: Priorities for Canada. The recommendations in the report for the domestic policy agenda are seen as a basis in this environmental scan for the potential future developments in the social innovation arena. More specific considerations for urban Aboriginal communities in Canada are also offered in this paper. Overall, this environmental scan attempts to (1) offer a vocabulary and an analysis of social innovation activity internationally and in Indigenous communities in particular, (2) discuss key issues and innovative approaches in labour market programming in Canada and abroad, and (3) offer considerations for Aboriginal communities in Canada to continue and expand the dialog with the policy makers. However, given the complexity of the issues that Aboriginal communities are facing, most considerations and recommendations are context-dependent and require further research. The research field of social innovation in the context of Aboriginal communities can be described as an opportunity not only to explore trust, balance, respect, and understanding in relationships between indigenous and non-indigenous peoples, but also to focus on the market-based strategies to achieve business targets while creating public social benefit. There still remains a gap in both literature documenting the statistics on Indigenous social enterprises and impact investing in Aboriginal businesses, the means of addressing issues in building Indigenous social enterprise pipeline, and the mechanisms in place for evaluating the effectiveness of the government or other programs targeted at improving Indigenous economic development through social innovation. Future research directions should focus on the abovementioned issues as well as on applications for innovations in job skills training and labour market programming in Canada and abroad.
